Before sharing or submitting a disputed clip, preserve the original and its source, document every known transfer or change, look for independent corroboration, and involve a qualified digital-forensics examiner and your lawyer when the stakes are material. A court’s admissibility decision depends on the jurisdiction and case facts.
What can you establish—and what can’t you?
Verification is not one yes-or-no test. Different checks can help answer different questions: who or what produced a file, whether it has been edited, whether a manipulation is detectable, and whether the event shown actually happened. A clip that looks internally consistent is not, by itself, proof of the depicted event. The National Center for State Courts’ (NCSC) guidance for courts assessing unacknowledged AI-generated evidence asks about the source and handling of evidence and whether another source can corroborate it: Evaluating unacknowledged AI-generated evidence.
For a consequential dispute, treat a preliminary check as a way to preserve leads and identify questions—not as a verdict. Do not describe a clip as authentic or fabricated solely because a detector, a timestamp, or a content credential says so.
How do you preserve a video for court?
Start before investigating the clip. NIST identifies secure acquisition, storage, and analysis as important parts of digital evidence handling. The steps below are practical preservation guidance, not a claim that every item is a legal requirement: NIST Digital Forensics.

1. Stop circulating the only copy
Do not edit, crop, annotate, re-encode, or repeatedly forward the only available file. If you have the device or account from which it came, preserve that source and the surrounding context when feasible. Avoid attempting a hands-on examination of a contested original if that could change it; ask counsel or a forensic examiner how to proceed.

2. Preserve what you received and where it came from
Keep the native file, the original device or source account if available, and the download or export context. Retain the original message, email, platform link, or other record through which you received it. Do not silently substitute a later download or a converted version for the file first obtained.

3. Make a documented working copy
Keep a separate copy for viewing or examination and label it as a working copy. Record how it was made and where each copy is stored. If a format conversion or other processing is necessary, preserve the unaltered source and document the operation and resulting file rather than replacing the source.

4. Start a custody and handling log
For each known handoff or action, note the date, time and time zone; the person; what they did; the source and destination; the filename; the transfer method; and any conversion or processing. Preserve records that show how the file was received and transferred. NCSC’s court guidance specifically raises questions about source, acquisition, custody, storage, and alterations; the log fields here are a practical way to answer them.

5. Preserve related material
Keep associated audio, adjacent footage, alternate camera views, related unedited files, contemporaneous records, and the original device or account where available. If two versions differ, preserve both and document the differences; do not overwrite one with the other.
How can you tell if a video is AI-generated?
Use checks as separate lines of inquiry. A result about file history does not necessarily answer whether the pictured event occurred, and a clue about synthetic generation does not by itself identify who made the clip or when.

Can an AI detector prove a video is fake?
No. A detector’s output is evidence about what that tool found under particular conditions, not a standalone determination of authenticity. NIST’s Guardians of Forensic Evidence work identifies challenges including generalization, real-world usability, and robustness to compression and post-processing. Its program describes evaluation concerns such as representative data, defined forensic tasks, performance measurement using ROC curves and AUC, and continuing reassessment: NIST, Guardians of Forensic Evidence: Evaluating Analytic Systems Against AI-Generated Deepfakes; NIST Guardians of Forensic Evidence program.
Those evaluation measures are not an accuracy figure for a consumer tool or a particular courtroom clip. The cited NIST and court guidance does not provide a broadly applicable detector-accuracy statistic for authenticating courtroom video. Do not transfer a benchmark result to a clip unless its test conditions actually match.

- Tool name and version, date used, settings, and the file identifier or hash supplied to the examiner.
- The exact input file and whether it was compressed, converted, or otherwise processed before analysis.
- The tool provider’s stated tested media and manipulation types, conditions, error behavior, and known limitations.
- The output as reported, without recasting a score as a universal probability that the clip is authentic.
Ask whether the tool was evaluated on the relevant type of video and realistic post-processing, what false-positive and false-negative behavior applies in those conditions, and whether a qualified examiner can explain the method and its limits. NIST’s January 2025 discussion of analytic systems against AI-generated deepfakes is available at NIST’s Guardians of Forensic Evidence publication.
What should you ask a forensic examiner and your lawyer?
If authenticity is materially contested, involve counsel and a qualified digital-forensics examiner before public distribution or court submission. NCSC’s bench-card guidance identifies issues a court may ask about, including the evidence’s source, its handling and alteration, forensic methods, and whether an expert can explain them. It also notes the possibility of expert testimony: NCSC guidance on unacknowledged AI-generated evidence.
Ask the examiner to explain how the evidence was acquired and preserved; what analyses were performed; how the methods were validated for the relevant media and conditions; what the known limitations are; and whether another qualified person could repeat the process. Ask counsel how local rules, the case record, and any expert requirements affect whether and how to use the evidence.

Does one U.S. rule decide whether a video is admissible?
No nationwide deepfake rule can be inferred from the cited materials. The TRI/NCSC AI Policy Consortium for Law & Courts published bench cards on April 1, 2025 for acknowledged and unacknowledged AI-generated evidence. The unacknowledged-evidence card offers questions to help a trial court assess authenticity; it is guidance, not a universal statutory checklist or a guarantee of admission. The companion card addresses acknowledged AI-generated evidence: Evaluating acknowledged AI-generated evidence.
The U.S. Advisory Committee on Evidence Rules’ November 5, 2025 agenda book includes discussion and draft language for a proposed Federal Rule of Evidence 901(c). The draft would, after an opponent presents evidence sufficient to support a finding of generative-AI fabrication and warrant inquiry, require the proponent to demonstrate that the item is more likely than not authentic. That language is a proposal in the cited committee materials, not an adopted rule established by that document.
