Before signing or buying, identify the exact company that will be responsible for your home, verify its license and insurance with the relevant authorities, and check its complaint history, public records, financial disclosures (if available), contract, and warranty. No single rating or record can establish whether a builder is reliable or will finish a particular home. Treat online complaints as leads to verify, and compare evidence from several sources.

Start with the company named in the contract

A builder’s advertising name may not be the legal entity that signs your agreement. Record the exact contracting company, any trade names, its parent company, and any project-specific entity named in the documents. This matters when checking licenses, court records, financial disclosures, and who is responsible for completing the work or honoring the warranty.

  1. Search the state business registry and the state or local contractor or homebuilder licensing database for the exact legal name. Confirm the status with the responsible agency, rather than relying only on the builder’s website or a directory.
  2. Ask for proof of current insurance. Where practical, verify the policy details with the insurer. The FTC advises consumers to check a contractor’s license with state or county government and ask for proof of insurance; requirements vary by location.   3. Check for disciplinary actions and make sure any record you find refers to the same company or people. Similar business names can lead to mistaken matches.

Keep the state and local jurisdiction in view throughout your checks. Licensing, insurance rules, public-record access, lien procedures, warranty rights, and available remedies are not uniform across the United States.

How should you assess reviews and complaints?

Search the builder’s exact name and meaningful variations with terms such as “complaint,” “review,” “warranty,” “lawsuit,” “lien,” and “bankruptcy.” Check the Better Business Bureau (BBB), local and state consumer-protection offices, and the local home builders association. The FTC’s advice is to “Read reviews with a critical eye.”

Look for patterns and documented outcomes

For each relevant complaint, note its date, location, subject, status, the builder’s response, and any documented resolution. Repeated reports about unresolved warranty repairs, delays, workmanship, or alleged nonpayment to subcontractors may point to questions worth investigating. A complaint is an allegation, not a finding of fact; look for supporting records before treating it as established.

Put complaint counts in context

BBB profiles are one source, not a pass/fail test. BBB says profiles generally cover three years, may not include all complaint text, and do not guarantee the accuracy or completeness of profile information or endorse a business. It also advises readers to consider the company’s size and transaction volume, complaint details, and responses. Its D.R. Horton business profile illustrates the profile format and caveats; it is not an assessment of other builders. A raw complaint total does not establish a company’s quality or financial condition.

What can public financial records tell you?

If the builder or its parent is publicly traded, review its latest annual and quarterly filings through SEC EDGAR. Note the company and reporting period for each filing, then compare trends across more than one period. Relevant disclosures include cash and liquidity, debt and maturities, cash flow, land and inventory commitments, warranty liabilities, litigation, and management’s stated risk factors.

Financial statements describe the reporting company, not necessarily the local subsidiary or project entity that signed your contract. A public parent’s disclosures are not a guarantee that a particular subdivision or home will be completed. A 2022 homebuilder annual report filed with the SEC, for example, discusses construction-defect and home-warranty claims, insurance limits and costs, and estimation uncertainty as business risks. It is an example of the kinds of disclosures to look for, not a current financial assessment of another builder. Read the 2022 annual report filing.

If the builder is privately held

A private builder may not publish financial statements comparable to a public company’s filings. Limited public financial information is not proof of either financial weakness or strength. Ask what financial statements or other evidence of completion capacity the builder can share. Ask whether deposits or upgrade payments are protected by escrow, a bond, a letter of credit, a parent guarantee, or another arrangement, and verify what is available and enforceable under local law. A refusal to share information is a reason to ask more questions, not proof of insolvency by itself.

Do not assume that every homebuilder must provide financial statements under a federal rule. The CFPB’s 12 CFR § 1010.212 sets financial-information requirements for developers covered by the regulation’s land-sale rules, with defined scope and exceptions. It is not a universal disclosure rule for builders or new-home purchases.

Which official records should you search?

Use the relevant state, county, and federal sources to check for adverse records, and match each result to the correct entity. Record dates and outcomes so you can distinguish an unresolved claim from a judgment, a resolved case, or an unrelated company.

  • Licensing records: Search for current status, disciplinary actions, and any public complaints or orders.
  • Court records: Search state and county courts for lawsuits, judgments, and other proceedings; check federal bankruptcy records where relevant.
  • Land and lien records: Check the county recorder or land-record office for liens and related filings. Lien rules, notice requirements, and releases vary by state, so consult local legal or title professionals if a possible lien could affect your purchase.
  • Permits and inspections: Ask the local building department about permits and inspection records for the subdivision or individual lot, where available.

An online post or complaint can help identify what to look for, but verify important claims in primary records. A pending lawsuit is not the same as a court finding, and a record involving a similarly named business may not concern your builder.

Read the contract, warranty, and project documents

Reputation research cannot replace reviewing the particular deal. Read the purchase or construction contract, warranty, specifications, completion schedule, change-order process, payment schedule, dispute terms, and any completion assurance. Check who handles post-closing warranty service, how a claim must be submitted, and what remedies the documents provide. Put important assurances in the signed documents rather than relying on verbal promises.

The FTC recommends written contractor agreements that identify the parties, scope, materials, dates, and price. Its guidance concerns home-improvement contracting; how specific terms apply to a new-home purchase depends on the contract and local law. If a contract term, payment protection, or possible lien raises a material concern, seek appropriately qualified local advice before signing or paying.

How can you check the individual home as it is built?

A builder’s company-wide reputation does not establish the condition of a particular home. Follow construction progress, keep written records, and raise concerns promptly. Check permit and inspection information with the local building department, and consider an independent home inspector or construction expert at suitable stages and before closing. North Carolina DOJ recommends monitoring the project and considering expert inspection in its state-specific home improvement guidance; it is consumer guidance for North Carolina, not a nationwide legal requirement.

How to compare two or more builders

Use the same evidence categories for each builder. There is no universal score or generally applicable statistic that predicts an individual builder’s reputation or ability to complete a particular project. Note what you could verify and what remains unknown rather than converting incomplete records into a numerical rating.
