To request records about an automated license plate reader (ALPR) program, identify the agency likely to hold them, follow its public-records instructions, and ask for specific existing records covering a defined period. Start with policies, contracts, sharing agreements, retention schedules, and aggregate or audit reports; do not assume individual plate-scan data is public or still retained. Federal FOIA covers federal agencies only. State and local requests follow the applicable state or local law.
1. Check what the agency has already published
Search the police department or sheriff’s website, the city or county clerk’s records page, procurement records, and any transparency portal. Look for ALPR or LPR policies, contracts, reports, and request instructions. FOIA.gov also recommends checking for published records before filing a federal request: How to Make a FOIA Request.
2. Send the request to the likely records custodian
For a federal agency, use the correct agency or component’s request channel. Federal FOIA does not apply to state or local governments; for those records, follow the agency’s instructions and the governing public-records law. The law may be called something other than “FOIA.”
If you are unsure which office holds the records, start with the agency’s published records contact. A vendor’s role in providing an ALPR system does not by itself establish that the vendor is the public-records custodian; determine whether the agency controls the records and how the applicable law treats them.

3. Ask for records, not answers to questions
Describe the documents or data you seek, not a question you want the agency to investigate. Federal FOIA guidance says a request must be written and reasonably describe the records. An agency generally is not required under FOIA to create a new record, analyze data, or answer questions. As FOIA.gov puts it, “The request simply must be in writing and reasonably describe the records you seek.” Local laws may set different requirements.
Include a date range, the relevant agency unit or system if known, and your preferred format. Keep the scope manageable: you can separate high-volume record categories or time periods into distinct requests. Where local rules allow, ask the agency to contact you before fees exceed a specified amount. Fees, processing times, and response deadlines depend on the applicable law and agency; check its current instructions rather than assuming a standard timeline.
4. Choose useful ALPR record categories
Request records the agency may already maintain. Policies and administrative records can be practical starting points, while raw plate-level reads may be restricted, exempt, or already deleted.

- Current ALPR policies, operating procedures, and public-facing privacy policies.
- Contracts, purchase orders, renewals, and vendor statements of work.
- Data-sharing agreements, memoranda of understanding, and records identifying partner agencies.
- Retention schedules and deletion or preservation policies.
- Existing aggregate scan, alert, hit, or usage reports, if maintained and releasable.
- Audit or access logs for a defined period, if maintained and releasable.
- Training, audit, or oversight records about system use.
- Records describing camera locations or deployment decisions, recognizing that security or other exemptions may apply.
- For a specific incident, narrowly identified records using a date, location, or case number. Do not assume you can obtain personally identifiable plate-scan data.

5. Adapt this sample request
Replace the bracketed details and adjust the terminology, legal citation, fee language, and any appeal statement to the agency’s procedure and jurisdiction.
Under the applicable public-records law, I request electronic copies of existing records concerning [agency]’s automated license plate reader (ALPR/LPR) program for [date range]: (1) current policies and procedures; (2) contracts, purchase orders, and renewals; (3) data-sharing agreements; (4) retention and deletion schedules; and (5) existing aggregate usage or audit reports. I am not requesting that the agency create a new record or answer questions. Please provide records in electronic form where readily available. If any part is withheld, please identify the legal basis and release reasonably segregable portions. Please contact me before incurring fees above [amount], if permitted by applicable rules.

There is no single disclosure rule or retention period for all ALPR records. Access depends on the jurisdiction, the record type, and applicable exemptions; retention also depends on the agency’s policy and legal obligations. An agency’s stated practice should not be mistaken for a nationwide rule or proof of what happened to a particular record.

State rules differ and can change. The National Conference of State Legislatures’ overview is a useful starting point, but verify the controlling statute, current agency policy, records schedule, and request instructions: Automated License Plate Readers: State Statutes.
7. If the agency withholds records or denies the request
Ask the agency to identify the specific legal basis for withholding material and to release any portions that can be separated from exempt information. Then use the appeal or review process in the applicable law and follow its instructions. Federal FOIA has exemptions, but local appeal grounds and deadlines vary; check the notice and governing rules for your request.
