In the United States, report a prosecutor to the professional discipline office with authority over that attorney: the U.S. Department of Justice’s Office of Professional Responsibility (OPR) handles qualifying complaints about DOJ attorneys, while state and local prosecutors generally fall under the relevant state attorney discipline authority. A disciplinary complaint is separate from a request for relief in an active case and should not be expected to change its outcome or pause a deadline.
First identify the prosecutor’s employer and the case jurisdiction
Start by checking whether the prosecutor works for the U.S. Department of Justice or for a state, county, or city office. The employer determines which oversight body may have authority. DOJ OPR says it does not investigate state or local officials, and it generally does not accept complaints from people outside DOJ about judges or attorneys who are not employed by DOJ. California is one example, not a nationwide rule: the State Bar of California’s Office of Chief Trial Counsel reviews complaints about attorneys licensed in California. Its public page directs complainants to an online form and says it reviews approximately 24,000 attorney-misconduct complaints annually; the page does not state the year for that figure. How to submit a complaint about a DOJ prosecutor
OPR says members of the public, including criminal defendants and civil litigants, may submit serious, non-frivolous allegations of professional misconduct by DOJ attorneys connected to their federal investigative, litigation, or legal-advice duties. Its submission page says: “Complaints against Department attorneys involving professional misconduct should be submitted to OPR in writing.”

- Use OPR’s current instructions. Submit through the OPR online complaint form or by mail. Check that page before filing in case its instructions have changed.
- Identify the people and matter. Provide your name and contact information, the DOJ attorney’s name and title, and the case name and jurisdiction if available.
- Describe the conduct clearly. State what happened and include relevant dates and other information that helps explain the allegation.
- Attach relevant records. Include supporting documents and retain copies of everything you submit.

How to report a state or local prosecutor
Find the official attorney disciplinary authority for the state where the prosecutor is licensed or where the relevant process applies. Use that authority’s own website and current filing instructions; do not assume that another state’s form, deadline, or privacy rules apply.

California example
For a California-licensed attorney, the State Bar’s Office of Chief Trial Counsel accepts public complaints through its online process. The State Bar cautions that an anonymous report may be harder to investigate because staff cannot ask the complainant follow-up questions. It also warns that investigated facts—and in some circumstances the complainant’s identity—may be disclosed. Read the State Bar’s complaint instructions before deciding what information to provide.
Do not assume that a state Attorney General is the general complaint office for a local prosecutor. In California, the Attorney General says complaints about California attorneys should go to the State Bar. The California office also says it ordinarily would not enter a local criminal charging matter unless the district attorney has a conflict that prevents a charging decision, and that it cannot represent private individuals or give them legal advice. Prepare a factual, supportable account
Follow the selected agency’s form and requirements. A concise chronology can help make a complaint easier to assess, even when the agency does not require that format. Organize relevant details such as:
- When the event occurred and who was involved.
- What you personally saw, heard, or received, separated from what you infer.
- What available records show, such as court filings or correspondence.
- Why the conduct concerns you, stated without claims you cannot support.
Be accurate and measured. The California State Bar requires complainants to certify that their information is true and correct and warns against knowingly false and malicious reports. Before submitting sensitive details, check the authority’s privacy rules: requesting anonymity does not necessarily prevent disclosure of information or identity.

A discipline complaint is not a way to change an active case
A professional-conduct complaint and a request for a court remedy are different processes. OPR says it refrains from investigating allegations about matters submitted, or that could have been submitted, to a court during ongoing litigation. That limitation makes it especially important not to treat OPR as a substitute for raising an issue through the court process.
The California State Bar likewise says its Office of Chief Trial Counsel cannot change a case outcome, act as the complainant’s attorney, or provide legal advice. A disciplinary complaint should not be treated as a way to reverse a ruling, dismiss charges, obtain a new trial, or stop a deadline.

If the concern may affect a pending criminal case, preserve relevant records and promptly speak with defense counsel or another lawyer authorized in that jurisdiction. Explain the specific event and ask whether a court remedy is available and what deadline applies. The appropriate procedure depends on the court, jurisdiction, and stage of the case.
