Use an age-check method that reveals only whether you meet the required threshold, if the service offers one. Before proceeding, check what the site and any separate verifier collect, why they collect it, how long they retain it, who they share it with, and whether the result can be linked to your account or activity. An age-check requirement does not mean every verification method handles data safely.
Start by checking what the service needs to know
A site may need to establish that you meet an age threshold, not learn your full date of birth or see the details on your identity document. A threshold result such as “over 18” can disclose less than sending a birth date or document image. The European Commission says age verification should be separate from a platform’s other data collection and describes anonymised age tokens as a way to avoid disclosing additional personal data. European Commission DSA guidelines.
Check both parties involved: the website requesting the check and the company or organisation performing it. A third-party verifier may handle documents, biometric data, or account information even if the website receives only a pass/fail result. Look for the stated purpose, retention period, deletion process, sharing practices, and whether the result is associated with an account or browsing activity. The ICO’s joint principles say providers should demonstrate that their approach is privacy-preserving, effective, and proportionate. ICO joint age-assurance principles.
Compare the available ways to prove your age
No method is automatically private or available everywhere. Compare what the requesting site receives with what the verifier processes and keeps, and consider accuracy, resistance to circumvention, accessibility, and whether the method is accepted where you live.

| Method | Privacy questions to ask | Important qualification |
|---|---|---|
| Government ID or passport | Does the verifier need to process the full document? Does the site receive only an age result? Is the image retained or shared? | The European Commission describes using an ID to certify age within its proposed app design; this does not establish how every provider handles documents. European Commission FAQ. |
| National eID or digital credential | Can it disclose only the age attribute, and can the proof be linked to later activity? | The Commission lists national eID as a possible setup route. Privacy depends on the credential and its implementation. European Commission FAQ. |
| Third-party app or in-person certification | Who operates the service, what data does it process, and what does it retain? | These are among the setup options described for the Commission’s solution; local availability and practices may differ. European Commission FAQ. |
| Payment card | Does the specific card method actually establish the required age, or merely confirm payment details? | Ofcom cautions that some debit cards do not require the user to be over 18, so they do not prove an 18+ threshold. Ofcom age-assurance duties. |
A lower-disclosure method still needs to work accurately and avoid unjustified exclusion. The European Commission lists accuracy, reliability, robustness, non-intrusiveness, and non-discrimination as desired qualities; the ICO principles also emphasise proportionality. ICO joint age-assurance principles.
Use this privacy check before submitting anything
- Confirm the request is expected. Make sure you are on the service you intended to use and that the age-check prompt comes from its official site or app.
- Identify the verifier. Check whether the site performs the check itself or sends you to a named outside provider. Review the privacy information for both.
- Look for a threshold-only option. Prefer a method that returns a yes/no age result without showing the site your exact birth date, identity number, or document image, when that method is available and accepted.
- Check purpose and retention. Find out why the information is processed, how long it is kept, how deletion works, and whether it is shared. If those details are missing or unclear, ask the service or choose another supported option if one exists.
- Consider linkage. Look for whether the proof is tied to a persistent account, device, payment, or browsing activity. A proof that cannot be linked to later use is preferable when it meets the service’s requirements.
- Pause if the method seems excessive. If the only option asks for more information than appears necessary, check the service’s official explanation and the rules where you live before proceeding.
These are practical applications of data minimisation and proportionality, not a guarantee that a particular vendor is safe or a legal test that applies in every country. The European Commission recommends processing only attributes strictly necessary for age assurance and says age assurance should not be used to identify, locate, profile, or track people. Commission Recommendation (EU) 2026/1035.

What EU, UK, and US guidance means for your privacy
European Union: a privacy-oriented design, with local implementation still relevant
The European Commission describes its age-verification solution as open source and designed so user data is not shared with the requesting platform. Its FAQ lists certification using a biometric passport or ID card, national eID, a pre-installed third-party app such as a banking app, or in-person verification. These are proposed setup options, not proof that every Member State has the same implementation or that a reader’s national app is available. European Commission FAQ.
The Commission says the link to the proof provider is cut after proof of age is received, with no further data exchanged. It says the technical solution was feature-ready for customisation on 15 April 2026. A 29 April 2026 recommendation encourages Member States to make privacy-preserving tools available by 31 December 2026. Those are design and implementation milestones, not evidence of universal availability. European Commission: The EU approach to age verification European Commission common-approach recommendation.

United Kingdom: age-assurance duties sit alongside data-protection obligations
Ofcom’s age-assurance guidance under the Online Safety Act was last updated on 2 September 2026. It directs services to comply with data-protection law as they meet their duties. Its warning about debit cards is practical: a card that can be obtained without being 18 cannot establish that a user meets an 18+ threshold. Ofcom age-assurance duties.

United States: the FTC policy is limited to COPPA enforcement
In February 2026, the Federal Trade Commission said it would not bring an enforcement action under the COPPA Rule against certain operators using personal information solely to determine age, subject to the policy’s conditions. The statement also says operators should take reasonable steps to use methods likely to produce reasonably accurate results. This is a specific COPPA enforcement policy, not general approval of age-check vendors or a universal privacy guarantee. FTC COPPA age-verification policy statement.

For you, that means checking whether the service requests only what it needs, whether a verifier is clearly identified, and whether the stated handling of the data is understandable. The right choice depends on the method the service supports, its privacy practices, and the rules in your location. If those details are not clear, do not assume that an age-check prompt is safe merely because it is required.
