To prepare for arbitration, first check the agreement, applicable provider rules and the arbitrator’s orders; then build a focused evidence set that connects each important fact to a clearly labeled document or witness. Deadlines, information exchange, exhibit formats and hearing procedures vary by case, so follow your case’s instructions rather than assuming court procedures apply.
Start with the rules and instructions for your case
Before collecting or formatting exhibits, identify what governs your arbitration. Review the arbitration clause or agreement, case notice, administering provider’s rules and any procedural orders. The American Arbitration Association (AAA) describes these materials as important to how information is exchanged and evidence is submitted in AAA cases; other providers and cases may differ. Make a deadline list that covers document exchange, witness information, pre-hearing submissions and final exhibits. Note any directions about exhibit numbering, delivery method, copies or originals, and whether the parties should coordinate a joint exhibit set. If an instruction is unclear, raise the question with the case administrator or arbitrator using the communication process permitted in your case.
Do not assume arbitration includes broad discovery or uses courtroom evidence rules. The AAA says information exchange is often more limited than in litigation and that some expedited cases may require only exchanging exhibits intended for the hearing. The applicable agreement, rules, orders and law control your case.

Map each claim or defense to the facts and evidence
Organize around what the arbitrator must decide, not around every record you possess. For each claim or defense, list the factual points that matter, the material that supports them, and evidence that could weaken or contradict your position. This creates a practical filter for deciding what belongs in the hearing set.

Use the table as a working map, not as a substitute for the exhibits themselves. Keep each selected record tied to a factual purpose. A large, unfiltered archive can make the important evidence harder to find.

Gather and preserve relevant records
Depending on the dispute, useful records may include the agreement and amendments, notices, correspondence, invoices, reports, photographs and other documents connected to the events at issue. Preserve originals or reliable copies, and retain metadata when it may matter—for example, when a document’s creation date or message history is disputed.
The AAA preparation guide advises that original documents or certified copies tend to carry more weight. Treat that as general preparation guidance, not a universal rule about admissibility or what an arbitrator must accept. Check your case’s instructions before submitting originals or making copies available.

Build an index and a findable exhibit set
Create a master index so you and the arbitrator can locate each item quickly. Include an identifier, date, short description, source and the issue it supports. Use consistent exhibit labels and filenames throughout the index, hearing outline and submissions.
- Use chronological order when the sequence of events is central.
- Use topic-based sections when the arbitrator needs to compare distinct claims, defenses or issues.
- Combine the approaches when separate issues each have their own timeline.
Choose paper or digital organization according to the case’s directions and hearing format. A labeled binder with numbered tabs can be useful if paper exhibits are permitted or needed; digital files can use descriptive names, bookmarks or an agreed index if allowed. Neither format is universally required or preferred. Confirm how all participants will access the same exhibits, especially in a remote hearing.

The AAA’s guide states: “Organized, labeled files—whether in digital form or printed binders—help you stay prepared and show the arbitrator that you are well-prepared.”
Prepare witnesses and plan how evidence will be presented
Identify what each witness personally knows and which records relate to that testimony. Prepare concise outlines that connect the witness’s account to the issues and exhibits. The AAA guide recommends rehearsing expected testimony and examination scenarios; preparation should not turn into coaching a witness to give false or scripted testimony.

Confirm whether testimony will be live, remote or presented in another permitted format, and whether the witness must be available for questions. The ABA’s practitioner guidance discusses planning witness presentation with the arbitrator. Raise availability, interpreters, transcripts and expert evidence when relevant during the preliminary or final pre-hearing conference. The actual process depends on the rules and orders in your case.

Plan an opening that identifies the dispute and the result you are requesting. Prepare a closing that connects the evidence presented to that requested result. Keep a quick-reference outline with exhibit identifiers, witness topics and the order in which you expect to use them.
- Practice locating each exhibit from its index entry or filename.
- Rehearse transitions between a witness, the relevant record and the point that record helps establish.
- Practice answering likely questions directly, including questions about evidence that does not support your position.
- Confirm any needs for a transcript, interpreter or post-hearing submission under the case instructions.
The AAA guide recommends preparing openings, closings, witness examination outlines and exhibits; a mock hearing is one possible way to practice the presentation.
Check the case-specific choices before finalizing

Keep the procedure specific to your arbitration
Evidence exchange, witness procedures, subpoenas and deadlines can vary with the contract, incorporated rules, provider, arbitrator’s orders, jurisdiction and type of dispute. The AAA lifecycle information describes AAA-administered proceedings and should not be treated as a universal rulebook. The ABA’s Model Rules for Fee Arbitration are a model for fee arbitration, not general rules for every arbitration. If substantial financial, employment, consumer or other legal rights are at stake, consider advice from a qualified lawyer in the relevant jurisdiction.
