Do not spread chromium-contaminated biochar on soil, compost it, put it in ordinary trash, or wash it away based on the fact that it is biochar. First determine whether it is hazardous waste, and manage it under applicable hazardous-waste rules while its status is uncertain. The correct disposal route depends on the material, your generator status, your location, and whether a receiving facility will accept it.
Why biochar should not be treated as ordinary garden material
Biochar’s name or intended use does not establish that chromium-contaminated material is safe for reuse or ordinary disposal. The U.S. Environmental Protection Agency (EPA) describes clean cellulosic biomass processed into biochar as a traditional product for certain Clean Air Act purposes; that statement does not establish a safe route for contaminated biochar. The waste must be evaluated under the applicable hazardous-waste rules.
EPA’s hazardous-waste determination framework considers whether a waste is listed or exhibits a hazardous characteristic. Accordingly, a chromium result alone may not resolve every question about the waste’s status or its permitted destination.
How chromium affects the federal hazardous-waste determination
Under the current U.S. federal toxicity characteristic, chromium is associated with waste code D007 when total chromium in the Toxicity Characteristic Leaching Procedure (TCLP) extract is at least 5.0 mg/L. This is a federal regulatory threshold for the TCLP leachate—not a limit for total chromium in the solid, a general cleanup standard, or proof that material below the threshold is safe to use or dispose of as ordinary waste. TCLP, EPA SW-846 Method 1311, evaluates how contaminants leach from a waste under specified test conditions. It is used for the toxicity-characteristic determination; it is not a product-safety test. A generic total-chromium measurement is not interchangeable with a TCLP extract result, and one TCLP result does not necessarily settle whether the waste is listed or has another hazardous-waste basis. What to do before arranging disposal

Pause reuse and ordinary disposal
Do not apply the material to land, compost it, place it in a household bin, or discharge it to a drain or waterway. The fact that it is biochar does not establish that any of those routes is appropriate for chromium-contaminated waste.

Record what is known about the material
Write down its source, feedstock and process if known, why chromium is suspected, the approximate amount, and any existing analytical results. EPA expects generators to make an accurate waste determination using relevant knowledge and, when necessary, testing. [EPA hazardous-waste identification]

Ask about the appropriate characterization
Contact a qualified environmental laboratory or waste professional and explain that the material is chromium-contaminated biochar. Ask whether TCLP Method 1311 is needed to assess the federal chromium toxicity characteristic, and whether the source, other constituents, or applicable state requirements call for additional evaluation. Do not assume a consumer test or total-chromium result substitutes for a regulatory waste determination.

Manage it conservatively while its status is uncertain
EPA says a generator managing potentially hazardous waste should follow generator regulations until sure the waste is not hazardous. Follow the requirements that apply to your generator category and state, and obtain storage, labeling, and packaging instructions from the relevant environmental authority or waste professional. There is no single container or protective-equipment instruction established for every chromium-contaminated biochar situation. [EPA generator FAQ]

Confirm an accepted receiving route before shipment
Contact your state environmental agency, local hazardous-waste program, or an appropriately authorized waste provider. Share the waste’s source information, approximate quantity, and test results. Ask whether the facility accepts it, what packaging and transport instructions apply, and whether a manifest or state-specific paperwork is required. EPA’s manifest system tracks covered hazardous waste from the generator to an off-site facility; requirements can differ by generator category and state. Why the final route depends on your situation
There is no responsible one-size-fits-all disposal destination without knowing the waste’s classification and where it is located. Relevant factors include whether it is listed or characteristic waste, the TCLP result and other available knowledge, whether it comes from a household, business, or laboratory, the generator category and quantity, state or local rules, and facility acceptance criteria. State-authorized programs may impose requirements beyond the federal baseline.
EPA’s framework is for the United States. It does not identify a specific facility for this material or establish a universal packaging procedure. If you are outside the U.S., consult the environmental authority responsible for waste in your jurisdiction rather than applying the federal threshold as local law.
