If you want to clone someone else’s voice, get explicit permission and confirm both the intended use and the service’s rules: consent alone may not qualify you to use a particular feature.
Before you clone a voice: confirm permission and intended use
Voice cloning can help someone who has lost their voice communicate in a voice that sounds like their own. It can also enable fraud, extortion, deceptive impersonation, or appropriation of creative work. The Federal Trade Commission (FTC) discusses both the potential benefits and harms in its November 2023 overview.
Use your own voice, or get explicit permission from the person whose voice you plan to clone. Confirm that you have the legal right to use the voice for the specific purpose, and do not use a clone to deceive, harass, or harm others. If you are working with another person, keeping a record of the permission, intended uses, duration, and any restrictions is a practical way to avoid misunderstandings; it is not a universal legal requirement.
Can you clone someone else’s voice if they agree?
Not necessarily. Consent and a platform’s feature rules are separate checks. For example, ElevenLabs says its Professional Voice Clone feature is limited to the verified speaker’s own voice. Even with consent, you cannot create that feature’s clone on someone else’s behalf; the speaker must create and verify their own clone and can then share it privately. That is a rule for this provider and feature, not a rule for every service. Before recording or uploading anyone’s voice, check the exact feature’s current requirements and the intended use’s legal limits.
Check what happens to your recordings and data
Before uploading samples, read the provider’s current terms and settings for audio retention, model improvement or training, opt-out, and deletion. Look for whether those controls apply to future uploads only or also to data already submitted.

ElevenLabs says it uses certain submitted data to improve its audio models, does not use a user’s data to clone that user’s voice without consent, and excludes Enterprise data from training by default except as needed to provide Enterprise services. It also says users can opt out of future data use in settings. Review its data-use documentation for the provider’s current details.
The FTC’s privacy guidance for AI companies emphasizes clear notice and affirmative express consent when companies use consumer data for other purposes. Those principles are useful when evaluating a service, but they do not replace reading its specific data terms.

Disclose synthetic audio when the rules or context call for it
Disclosure requirements vary by platform and context. YouTube’s help guidance gives cloning your own voice for voiceovers or dubbing as an example that does not require altered-content disclosure. That example does not establish the rule for other platforms, jurisdictions, or situations involving impersonation. Check the platform’s live guidance for the specific content you plan to publish: YouTube’s altered or synthetic content guidance.
Even when a platform does not require a label, explain that audio is synthetic when leaving that out could mislead your audience. Follow applicable platform rules and local law; do not assume one service’s disclosure threshold applies elsewhere.

Treat platform safeguards as safeguards, not guarantees
Services may use identity checks, restrictions on high-risk voices, monitoring, and reporting tools to reduce misuse. ElevenLabs describes measures it uses on its safety page. These controls can help, but they cannot prove every recording is authentic or ensure a clone will never be misused.
The FTC identifies multiple points for addressing voice-cloning risks, including prevention and authentication, real-time detection, and evaluation after use. It says there is no single solution. Its April 2024 discussion states: “There is no AI exemption from the laws on the books and the FTC remains committed to protecting consumers from the misuse of ‘AI’-enabled voice cloning technologies.”

A practical safety checklist
- Choose the voice and purpose. Use your own voice or obtain explicit permission and confirm you have the legal right to the intended use.
- Check the feature’s rules. Confirm who must create and verify the clone; another person’s consent may not make you eligible to create it yourself.
- Review data controls before uploading. Understand the provider’s policies on retention, model improvement, opt-out, and deletion.
- Use the clone responsibly. Do not use it to deceive, harass, impersonate someone without authorization, or cause harm.
- Check disclosure obligations before publishing. Follow the relevant platform’s current policy and disclose synthetic audio when needed to avoid misleading people.
- Keep safeguards in perspective. Verification, detection, watermarking, and reporting can reduce risk; none is proof of authenticity or a guarantee against misuse.
