Regulatory checks are an important part of due diligence, but they do not establish that an exchange is safe or right for you.
Start with the company and service you will actually use
Before searching a regulator’s records, identify the legal entity that will open your account, hold or safeguard your assets, execute your trades, or offer derivatives. A parent company’s registration may not cover an affiliate or the service you intend to use. Note your state of residence too: state-level requirements can apply separately from federal rules.
Write down the specific product you want—such as cash or spot trading, a securities-related service, or futures and other derivatives. The word “exchange” in a company’s name or app does not, by itself, mean the company is registered with the SEC as a national securities exchange.
Match the product to the relevant regulatory checks

Consider the asset as well as the platform
Do not assume every token listed by one platform has the same legal status. In its March 17, 2026 interpretation, the SEC described categories that include digital commodities, digital collectibles, digital tools, stablecoins, and digital securities. The SEC’s educational page says some stablecoins may be securities depending on their features; a tokenized security represents a financial instrument that meets the legal definition of a security. For the asset and transaction you are considering, check the SEC’s latest guidance rather than inferring a legal classification from a ticker, a platform listing, or the status of a different token.
Verify records using the exact legal name
- Find the entity names. Read the exchange’s legal disclosures and terms to identify the account provider and any affiliate responsible for custody, execution, or derivatives. Record the state in which you will use the service.
- Choose the record for the activity. For securities-related services, consult relevant SEC exchange or ATS information and Investor.gov resources; use FINRA BrokerCheck for broker-dealer firms and people. For derivatives intermediaries, search NFA BASIC. For spot services, consult FinCEN’s MSB search and NMLS, then check your state regulator’s records.
- Compare the result with the company’s claim. Confirm that the entity, registration category, service, and jurisdiction match. A record for a related company is not automatically proof that the entity serving you is covered.
- Ask about mismatches or missing results. Request the exact entity, service, registration category, and jurisdiction behind the company’s claim. A missing search result alone does not prove wrongdoing: the service may rely on an exemption or a different regulated entity. Verify the explanation against the relevant regulator’s information.
For securities-related services, check relevant individuals as well as the firm. A company’s marketing language, displayed order book, or stated asset-listing standards does not, by itself, establish that it operates as an SEC-registered exchange.

Assess how the exchange operates, not just its records
Regulatory status is only one part of choosing a platform. Compare the features that affect your use and the risks you are willing to accept:
- Availability and access: Which assets and services are offered to customers in your state, and who is eligible to use them?
- Trading mechanics: How are orders matched and prices set? What are the trading protocols, and are customers treated equally?
- Costs: What fees and spreads apply to the trades you expect to make?
- Custody and withdrawals: Does the platform hold your assets? If so, how are they safeguarded, and what rules or conditions govern withdrawals?
- Information security: What does the platform say about protecting personal and trading information and its cybersecurity practices?
- Other services: What else does the operator or its affiliates provide, and does that create additional registration questions?
These are questions the SEC encourages investors to ask about digital-asset trading platforms. A clear answer should describe the actual service and its terms, not just point to a general compliance statement.

Use registration as a screen, not a guarantee
A registration record can help establish whether an entity appears in a relevant public database for a particular role. It does not prove that every product is appropriate, that customer assets are risk-free, or that the company will not fail or be targeted by fraud. The CFTC cautions: “Registration and a clean disciplinary record won’t protect you from fraud.” Assess custody, withdrawals, fees, security, and the service’s actual terms even when a record appears in good standing.

SEC guidance and public records can change; the SEC’s crypto-assets interpretation was issued March 17, 2026, and its educational page lists a review or update date of May 15, 2026. Recheck official records and current terms when making a decision.
