Choose a freight broker by checking two things separately: whether it is legally authorized for the transportation it will arrange, and whether its people and processes can handle your freight on the lanes you use. For U.S. truck brokerage, verify the contracting entity in the Federal Motor Carrier Safety Administration’s (FMCSA) public Licensing & Insurance system. Then compare candidates using the same shipment profile, pricing assumptions, operating questions, and contract review.
What does a freight broker do?
In the United States, a property broker arranges transportation between a shipper and a motor carrier. It is the intermediary: it does not itself transport the property, operate the vehicle, or assume responsibility for the cargo. A freight forwarder has a different role and responsibility model: it organizes shipments, may consolidate and distribute cargo, and assumes responsibility for transportation. Confirm which service your proposal and contract provide, and which entity is responsible for each leg. FMCSA explains the distinctions in its definitions of motor carrier, broker and freight forwarder authorities.
These definitions matter when evaluating a provider’s promises. A broker may coordinate a carrier and help manage communication, but that does not by itself make the broker the carrier or establish who bears cargo liability. Review the contract’s responsibility and claims terms rather than inferring them from the word “broker.”
How do I verify a freight broker?
For U.S. truck brokerage, check FMCSA records
- Open FMCSA’s Licensing & Insurance public system and search for the company that will sign your agreement. Check the legal entity name and any trade name (DBA) shown in the proposal.
- Review the broker authority and current public compliance information. FMCSA’s database help page describes records that may include insurance or bond details, active or pending filings, authority history, and revocation activity. A “Yes” status indicates compliance in the field described; “No” means the entity either lacks active authority or is not in compliance and may be subject to revocation proceedings.
- Check the financial-responsibility filing and authority history, not just a search-result label. FMCSA’s help page says the displayed bond or trust amount when compliant is the required federal minimum; it does not establish whether the broker carries a higher amount.
- Repeat the check immediately before contracting, and periodically if the relationship continues. Authority, filings, and public status can change.
FMCSA’s financial-responsibility FAQ, issued and effective June 26, 2026, explains that the agency may suspend authority in a specified case if an eligible replacement filing is not submitted within 30 days after a BMC-85 provider is determined ineligible. That is a rule-specific replacement window, not a general grace period for every filing issue. Do not confuse a filing with service quality or cargo protection
A required bond or trust filing is a regulatory financial-responsibility requirement. It does not prove that a broker has strong operating practices, guarantee payment of a particular claim, or replace written cargo-risk terms and a workable claims process. FMCSA says it does not endorse particular financial-responsibility providers or mediate individual payment or financial-security disputes. Read its 2026 financial-responsibility FAQ alongside the contract, rather than treating the filing as an assurance about your shipment.
For ocean transportation, check the relevant FMC status
Truck-broker checks do not establish that an ocean intermediary is qualified for its role. For a U.S. ocean freight forwarder or non-vessel-operating common carrier (NVOCC), consult the Federal Maritime Commission’s (FMC) Licensing and Certification resources, including licensed and bonded OTI listings and status information. Confirm which entity contracts for each transportation leg.

How to choose a freight broker for your business
1. Define the freight you need moved
Write a common shipment profile before requesting proposals. Include the modes and lanes you use, shipment volume and seasonality, commodity, equipment, pickup and delivery constraints, special handling, and required service levels. Note the consequences of missed appointments, delays, loss, or damage. This gives each candidate the same basis for explaining its fit and pricing.
2. Test capacity, carrier selection, and substitution controls
Ask how the broker finds capacity for your lanes and equipment, what contingency options it has during peaks or disruptions, and how it checks a carrier before tender. Ask how it confirms carrier identity, authority, insurance, and equipment; how often those checks are refreshed; and what happens if a load is reassigned after acceptance. Request a clear explanation of how it prevents unauthorized substitutions and notifies you when a change is proposed.

3. Walk through visibility and exception handling
Ask what shipment updates you will receive, how often, through which channel, and who is responsible for sending them. Request a sample visibility report. Use a realistic scenario—such as a late pickup, a missed delivery appointment, or a damaged shipment—and ask who responds, how quickly the issue is escalated, what information you will receive, and how resolution is tracked. Ask for the claims submission process, required documentation, deadlines, and the broker’s role in coordinating with the carrier.
4. Compare complete pricing, not just the headline rate
Have every candidate quote the same sample lanes and shipment assumptions. Compare the total charge and how the proposal treats accessorials, fuel or other surcharges where applicable, detention, re-delivery, cancellation, and other charges relevant to your freight. Ask when charges can change and what approval is needed. Review payment timing and any other payment terms alongside the quoted amount.

5. Check references and put expectations in writing
Ask for references from shippers with comparable lanes, commodities, shipment patterns, or service requirements. Where possible, request performance reporting relevant to your needs, such as pickup and delivery reliability, response time, or claims workflow. Put required service levels, reporting cadence, escalation contacts, substitution approval, liability allocation, claims process and deadlines, cancellation terms, and payment terms in the agreement. A useful proposal explains how performance will be measured and what happens when expectations are missed.
What should I ask a freight broker before hiring?
- Which legal entity will contract with us, and what role will it perform on each transportation leg?
- Can you provide your FMCSA broker authority details, and how should we match your legal name and DBA to the public record?
- How do you select and verify carriers, confirm equipment and insurance, and control changes after tender?
- What capacity and contingency options do you have for our lanes, equipment, and seasonal peaks?
- What shipment updates will we receive, how often, and who handles exceptions outside normal business hours?
- How do you manage missed appointments, delays, damage, loss, and claims, including deadlines and documentation?
- What is included in the quote, which accessorials may be added, and how are added charges approved?
- What are the payment, cancellation, liability, and dispute terms, and can you provide comparable-shipment references?
How to compare broker proposals
Score candidates against your requirements, not a universal ranking. Federal records establish important facts about authority and filings, but FMCSA does not rank brokers or prescribe commercial service criteria. Use the same freight profile and lane set for each proposal, then compare:

There is no evidence-based universal weighting for these factors. Give the most weight to the risks that matter in your operation: a time-critical lane may call for stronger escalation commitments, while high-value or specialized cargo may warrant closer scrutiny of equipment, handling, and claims terms.
When is a broker the wrong fit?
Pause or seek another provider if the contracting entity does not match the regulatory record, the candidate cannot explain its carrier checks or substitution controls, pricing leaves material charges unclear, or the agreement does not define responsibility and claims handling to your satisfaction.
