Choose a Bitcoin custodian by checking who controls the private keys, how customer assets are safeguarded and treated, what happens if the provider fails, and whether you can withdraw bitcoin to an address you control. Then compare the full fee schedule and account protections using the provider’s current written terms for your location and account type. A custodian can reduce the burden of managing keys, but it also becomes part of your access and failure risk.
First, decide whether you want third-party custody or self-custody
A wallet does not contain bitcoin; it manages the private keys that authorize transactions. With third-party custody, a provider controls access to those keys. With self-custody, you control them and take responsibility for protecting and recovering them. The SEC’s retail custody bulletin, dated Dec. 12, 2025, describes both approaches and the risks of each.

A hardware wallet is an optional self-custody tool, not a custodian and not an upgrade to a third-party custodian. For example, Ledger’s Bitcoin documentation describes a device-based self-custody approach. Product descriptions are not independent comparisons of wallet brands.
How to assess a custodian’s security
Do not stop at labels such as “institutional-grade,” “cold storage,” or “insured.” Ask for specific written answers about the controls that apply to the service and account you would use.

- Key access: Which people, teams or systems can authorize access to keys or transactions? What approvals or separation of duties are required?
- Storage: What share of assets, if any, is held in hot wallets for faster transactions, and what is held in cold storage? How does the provider protect each?
- Security controls: What physical safeguards, cybersecurity measures, access controls and incident-response processes protect the keys and the systems around them?
- Other parties: Does the provider rely on subcontractors or other custody providers? Ask who they are and what responsibilities they have.
- Account access: How are sign-ins and withdrawals protected? Check whether multi-factor authentication is available and whether stronger options, such as an authenticator app, can be used. Fidelity’s custodian guidance also highlights authentication as a selection consideration.
Compare answers at the level of the actual legal entity and service holding your bitcoin. A provider’s brand name or security summary alone may not tell you which entity controls the keys or which protections apply to your account.
Find out what happens to customer assets if the provider fails
Custody risk includes more than theft. A hack, operational disruption or insolvency could affect your ability to access bitcoin held by a third party. Before depositing funds, investigate the provider’s legal and operational arrangements and ask what happens to customer assets if service stops or the provider fails.

Ask how customer bitcoin is treated
- Are customer assets held separately from the provider’s own assets, or are they commingled?
- Can the provider lend customer bitcoin, use it as collateral, or otherwise reuse it? If so, is your explicit consent required, and what terms govern that use?
- What records identify your holdings, and what process applies if there is a dispute or service interruption?
Read insurance terms, not just the headline
Ask which events and assets a policy covers, who is insured, what exclusions or caps apply, and whether coverage protects customers directly or the provider. A general statement that a service has insurance does not establish that every customer loss will be reimbursed.
Interpret proof-of-reserves reports narrowly
A proof-of-reserves report can provide information about assets at a particular point, but it is not a complete financial statement or a full account of liabilities. The SEC’s bulletin on alternatives to financial statement audits cautions that these reports do not tell investors the whole story about an entity’s liabilities. Treat one as limited evidence, not proof that the provider can meet every customer claim.

Check that you can withdraw bitcoin when you need to
If you want the option to move bitcoin to an external wallet, verify that the provider supports withdrawals to an address you control. Read the current written rules for your jurisdiction and account type; withdrawal access can depend on limits, reviews, holds and processing procedures.
- Eligibility and address rules: Can your account send bitcoin to an external address? Are there verification steps or restrictions on adding or changing withdrawal addresses?
- Limits and holds: What minimum and maximum amounts apply? Can deposits or withdrawals be held, and under what circumstances?
- Timing and review: What processing windows are stated? Can a withdrawal require a manual review, and how will you be notified?
- Charges: Is there a provider withdrawal fee, a bitcoin network fee, or both? Does the provider explain how each is calculated?
- Recovery and support: If a withdrawal is delayed or an account is locked, what support channel and recovery process are available?
Do not infer withdrawal rights from the fact that a platform lets you buy or sell bitcoin. Look for the external-withdrawal terms themselves and confirm they apply to your account before transferring a substantial balance.

Compare the full cost, not just the trading fee
The SEC lists several fee categories investors should examine, but there is no neutral, directly comparable set of current provider fees or withdrawal limits established here. Check each provider’s current fee schedule and terms rather than relying on a market average or a quoted trading fee.

For a realistic comparison, estimate the costs for how you expect to use the account: holding a balance, making purchases or sales, and withdrawing bitcoin. Record the date you checked the terms, since fees can change.

Compare providers with the same questions
Use one checklist for each candidate, and keep the answers tied to the provider’s current documents rather than sales language.
- Identify the entity and service: Record the legal entity that provides custody, the service terms that govern your account, and the location or regulator relevant to that activity. Regulatory status depends on the entity, activity and jurisdiction; do not treat a general claim that a service is “regulated” as a complete answer.
- Document key safeguards: Note who controls key access, the storage approach, the security controls and any subcontractors.
- Establish asset treatment and failure arrangements: Confirm segregation or commingling, any lending or reuse rights, the provider’s failure procedures and the exact scope of insurance.
- Verify the exit path: Find the external bitcoin withdrawal rules, including limits, holds, reviews, timing and charges.
- Calculate likely costs: Include custody, transaction, withdrawal and account fees that apply to your intended use.
- Test the account-protection plan: Review multi-factor authentication, account recovery and customer-support procedures before relying on the account.
If a material answer is missing, ambiguous or only given verbally, treat that as an unresolved comparison point. The SEC’s retail custody bulletin offers general investor guidance; it is not a ranking of providers or a rule creating new obligations.
If you choose self-custody instead
Self-custody shifts responsibility from a provider to you. A hardware wallet may help keep keys on a dedicated device and let you confirm transactions there, but you still need a reliable backup and careful transaction habits. The SEC explains that a seed phrase can restore a wallet after loss or damage and should be stored securely and never shared. It also warns that losing the private key can permanently remove access to the assets.
