Confirm separately that the clinician is authorized to practice and prescribe there. An AI feature, a company’s national availability claim, or a software’s FDA status does not establish those permissions.
This guide covers U.S. telehealth. The answer for a particular service depends on the patient’s state, the clinician’s profession, the care model, and sometimes the medication.
Is an AI prescriber licensed?
“AI prescriber” can describe different arrangements: software may organize information or suggest options for a clinician, or it may generate more direct treatment recommendations. Ask the service whether a named clinician reviews your information and makes the prescribing decision. Get that person’s full name, professional role, and license type. If the service does not identify who is responsible for your care and prescription, you cannot verify an individual clinician through a licensing board.
Professional licensing and software regulation are separate questions. The FDA’s clinical decision support guidance considers how a software function works, including whether a clinician can independently review the basis for its recommendations. That classification does not verify a clinician’s state license or establish that a service complies with state telehealth or prescribing rules. The Federation of State Medical Boards (FSMB) announced a workgroup on AI in medical practice on May 19, 2026; its announcement described work in progress, not a completed nationwide rule. Which state’s rules apply to an online appointment?
Start with the state where you will physically be when you receive care—not just where the company is based or where the clinician is sitting. HHS says professionals must meet the requirements of the state where they are located and be licensed or otherwise legally permitted to practice in the state where the patient is located. Its guidance advises providers to verify patient location before an appointment. See HHS’s licensing across state lines and getting started with licensure pages.
An out-of-state clinician is not automatically unauthorized, but an out-of-state license alone does not prove permission to treat you. Depending on state law and the circumstances, the clinician may rely on a full license, a temporary-practice provision, reciprocity, an interstate compact privilege, or telehealth registration. Ask which route applies in your state and verify it with the relevant board. HHS’s behavioral health licensure guidance also illustrates that rules can vary by profession and service.

How do I check whether an online doctor is licensed in my state?
- Ask for the responsible clinician’s details. Request their full name, professional role (for example, physician, nurse practitioner, or physician assistant), license type, and the state or states where they are authorized to provide care. Ask who reviews your patient-specific information, decides whether to prescribe, signs the prescription, and handles follow-up.
- Identify your location for the appointment. Use the state where you will physically be during the visit. If you travel or move before the appointment, tell the service; authorization may depend on your location at the time care is delivered.
- Find the official board for the clinician’s profession in that state. Search the state government’s licensing department or professional board website. A physician’s record, for example, is not a substitute for checking a nurse practitioner’s or physician assistant’s appropriate board or license. Match the clinician by full name and, if available, license number.
- Review the public record. Check the license type and status, expiration or renewal details, and any publicly posted restrictions or disciplinary actions. Board websites differ in what they display. If the name, credential, status, or authorization route is unclear, contact the board using its official contact information.
- Confirm the out-of-state authorization route, if applicable. Ask the clinician or board whether the clinician has a state license or another state-recognized permission to practice for your situation. Do not treat compact participation, a license in another state, or a company’s statement that it serves your state as proof by itself.
- Ask how prescribing rules apply to your medication. A license lookup does not answer whether an online prescription is allowed under the applicable state and federal rules. Ask whether an in-person visit or an established patient-provider relationship is required, and whether additional requirements apply to the medication.
- Save the result and clarify mismatches. Keep the board result and the service’s explanation, with the date you checked. If the public record does not clearly match the prescriber or the service cannot explain its authorization, contact the board. It is safer to resolve an unclear record with the board and clinician than to assume the record proves misconduct or to stop medication without appropriate medical advice.
Does a valid license mean the clinician can prescribe any medication online?
No. Verify the clinician’s professional status and state authorization, then consider prescribing rules separately. HHS says online prescribing must follow federal law and the laws of the states where the provider is licensed and where the patient is located; in most cases, a patient-provider relationship must be established. State rules can differ on online prescribing and whether an in-person visit is required.
For controlled medications, additional federal conditions apply. As of October 7, 2026, HHS’s page, last updated January 5, 2026, says the federal telemedicine flexibilities for controlled medications are extended through December 31, 2026. Under the stated conditions, a DEA-registered practitioner may prescribe Schedule II–V medications by telemedicine without first conducting an in-person medical evaluation. This is a time-limited federal policy, not a waiver of state law or other applicable conditions. Check HHS’s controlled-substance telehealth prescribing guidance for the current status.

What can a national physician database tell me?
The FSMB’s Physician Data Center is not a replacement for the current state-board check. FSMB says its physician and physician assistant data are intended for health organizations, and board data may arrive at different intervals. It does not cover every licensed profession or guarantee a real-time state record. Use the relevant state board as the primary source, and consult the Physician Data Center FAQ or Physician Data Center only with those limits in mind.

- Who is the named clinician responsible, and what is their professional license type?
- How is that clinician authorized to practice in the state where you will receive care?
- Who reviews your information, makes the treatment decision, signs the prescription, and provides follow-up?
- Does the AI summarize information, suggest options, or generate treatment directives—and can the clinician review the basis for its recommendations?
- What state-specific prescribing requirements apply, including any extra conditions for controlled medications?
- Which licensing board governs the clinician, and how can you contact it if the record or service’s explanation is unclear?
These checks can help you assess transparency, but they do not resolve every state’s rules for a particular AI care model. If a service says software makes treatment decisions without direct clinician involvement, ask the state board how the relevant law applies; the sources cited here do not establish a single nationwide rule for autonomous AI prescribing.
