To check a crypto exchange’s U.S. registration, first identify the legal company operating the service and what it offers. Then search the matching official database: BrokerCheck or Investor.gov for broker-dealers, SEC IAPD for investment advisers, and NFA BASIC for CFTC-regulated derivatives firms. A spot-crypto exchange may not need CFTC registration solely to let customers buy or sell crypto on the cash market, so a missing result is not, by itself, proof that a platform is illegal.
Which registration check should you use?
There is no single SEC or CFTC lookup that covers every crypto exchange. The right database depends on the service and the legal entity providing it. A platform can also use separate companies for different products, so check the entity named in the relevant terms, custody disclosures, or product documents.

How to check an exchange step by step
- Identify the counterparty. Write down the website domain, app publisher, legal company name, jurisdiction, and any subsidiaries named in the terms or product disclosures. A familiar brand name alone is not enough; the company operating a spot service may differ from the entity offering derivatives or advice.
- Classify the product or service. Determine whether you are checking spot crypto buying and selling, securities trading, futures, options, swaps, or individualized investment advice. This determines which regulator records may be relevant.
- Search the matching official database. Use BrokerCheck or Investor.gov for a broker-dealer and its professionals, IAPD for an investment adviser, and NFA BASIC for derivatives intermediaries. Search the legal entity name as well as relevant individuals.
- Open and read the record. Compare the database entry with the exchange’s legal name, address, domain, registration category and current status. For a person, confirm the current employer and relationship to the firm. Read disclosures and forms rather than relying on a search-results snippet.
- Follow up on a mismatch or missing result. Ask the exchange to name the exact regulated entity, the registration category it claims, and the regulator record. If the name differs, determine whether the listed company is actually an affiliate or service provider for the product you plan to use.
- Check for impersonation and separate licensing. Search SEC PAUSE for known warnings, then independently match the domain and contact details against official records. Where applicable, check FinCEN’s MSB search or NMLS for a separate money-services registration or state license; neither substitutes for an SEC or CFTC registration check.
Why a crypto exchange may not appear in CFTC records
The CFTC distinguishes the cash or spot market from derivatives. Its consumer guidance says that companies offering customers the ability to buy or trade virtual currencies on the cash or spot market are not required to register with the CFTC solely for that activity. The agency does retain anti-fraud and anti-manipulation authority over virtual-currency spot markets. By contrast, intermediaries advising on or facilitating virtual-currency commodity futures must register with the CFTC and NFA. See the CFTC’s registration and background-check guidance.
Consequently, searching NFA BASIC is useful when a platform offers a relevant derivatives service, but it is not a universal test of whether a spot exchange is legitimate or lawful. CFTC guidance also notes that some entities may be exempt or outside CFTC regulation; if a firm is absent from BASIC, ask it to explain the basis for its activity and check the regulator appropriate to that service.

What a registration result does—and does not—tell you
A matching result
A matching entry shows that the named firm or person appears in that database in the category and status displayed. It does not establish that every product under a brand is covered, or that a person is associated with the particular exchange service you are considering. Confirm the entity, activity, and relationship shown in the record.
No result
A missing entry can have several explanations: a different legal name, an affiliate, an exemption, a non-U.S. entity, or an activity that does not require that particular registration. It warrants follow-up, but alone does not settle whether the service is operating unlawfully. Ask the platform for its legal entity and the reason it believes the activity does not require registration.

Registration is not an endorsement or guarantee
Registration does not mean the SEC or CFTC endorses an exchange, insures customer assets, guarantees against fraud, or promises recovery of losses. The CFTC cautions that registration and a clean disciplinary record do not protect customers from fraud. Review the record and disclosures, and independently verify who you are contacting.
FinCEN registration is a different check
FinCEN MSB registration is not SEC or CFTC registration and does not mean FinCEN has approved or endorsed a business. Likewise, an applicable state license found through NMLS is a separate check, not proof of federal securities or derivatives registration.

When to pause before using a platform
- The exchange will not identify the legal entity providing the product.
- It claims government endorsement or registration but cannot provide a matching official record and category.
- The domain, address, or contact information differs from independently located official records.
- A listing appears to belong to another company or person, with no verified connection to the exchange.
- The exchange pressures you to send money or act before you can verify the entity and its claims.
SEC PAUSE can help identify known false-registration claims and impersonators, but the SEC says the list is incomplete. A clean result is not clearance. Verify identity through official records and independently sourced contact details.
