To challenge a video as AI-generated or manipulated, identify the specific problem and support it with evidence: for example, an unexplained source, a gap in custody, an excerpt from a longer recording, or a concrete sign of editing. Preserve the file as received and its transfer details. If the dispute matters to a case, seek a qualified examiner who can explain what was tested, how, and with what limitations. A claim that a video “might be a deepfake,” or a detector score by itself, does not settle whether a court can admit or rely on it.
What are you actually challenging?
Start by separating the possible objections. “The video is fake” is too broad to show what is disputed or what evidence could resolve it. A challenge may concern how the file was created, whether it was altered, who or what appears in it, whether it is complete, or whether the file can reliably be connected to the source it is said to come from.
- Synthetic generation or compositing: Some or all of the depicted scene, person, or sound may have been generated or combined from different material.
- Editing or missing context: The clip may be an excerpt, or its sequence, timing, or surrounding material may have been changed or left out.
- Identity or source: The person, event, camera, account, or device may not be what the proponent says it is.
- Provenance or custody: The available file may be a repost or transformed copy, and its path from capture to court may be unclear.
Point to the facts behind the concern: who supplied the file, how it was obtained, whether there is a longer recording, what version was examined, and what specific alteration is suspected. The concern should be a testable claim, not just the possibility that AI could have been used.
How do I challenge a video as a deepfake in court?
In court, the immediate question is often whether the video is sufficiently authenticated as what its proponent claims. Authentication is not the same as proving that a video is genuine in every respect, and a failure to authenticate does not establish that the video is false. The forum’s evidence rules and procedures govern how an objection must be raised and supported.

The Federal Rules of Evidence are the starting point for most U.S. federal proceedings; the U.S. Courts’ official rules page says they were last amended in 2024. State courts may apply different rules, and local procedures matter. Confirm the rules, deadlines, notice requirements, expert-disclosure obligations, and applicable case law in the court handling the case. The information here is general U.S.-oriented guidance, not a filing checklist for a particular jurisdiction.
A useful challenge explains both the disputed claim and the supporting facts. Depending on the record and the forum, those facts may include the file’s unexplained origin, a missing longer recording, signs of transformation, gaps in custody, or analysis by a qualified expert. Do not assume that raising a deepfake possibility alone establishes a legal basis to exclude the evidence.
Preserve the file and its history
Preserve the original file as received, without editing, trimming, re-encoding, or overwriting it. Keep a separate working copy for examination. Record who provided it, when and how it was received, how it was transferred, and who has handled each copy. Preserve related messages, links, device or account information, and any available original or longer recording.

A reposted or compressed copy may still be useful, but changes made during sharing can affect what an examiner can determine. Document those changes rather than treating a downloaded copy as the camera original. Preserve relevant material promptly and ask a lawyer about any preservation obligations or deadlines in the specific case.

What evidence do I need to show a video was manipulated?
There is no single piece of evidence that answers every kind of challenge. Evidence should match the claim. A missing source record may bear on provenance; a discontinuity may prompt examination of editing; a dispute about a face swap calls for a different analysis than a question about whether a clip came from a particular camera.

These are distinct tasks described by the National Institute of Standards and Technology (NIST) in its Guardians of Forensic Evidence program. Choose an analysis that addresses the actual dispute rather than treating “deepfake detection” as one all-purpose test.

How to evaluate a detector result or expert report
A detector output is evidence to interpret, not a universal verdict. NIST describes challenges including whether a method generalizes to newer generation techniques, remains useful after compression or other post-processing, and performs reliably outside laboratory conditions. A tool trained on one set of media may not answer the same question for a compressed social-media clip or a different kind of manipulation.
NIST’s Guardians of Forensic Evidence program, created in 2026 and updated on September 25, 2026, is developing evaluation methods; it is not a universal certification of commercial detectors. Its discussion of representative casework, post-processed evidence, and continuing validation underscores why a score without context is hard to assess.
When reviewing an expert’s work, ask for enough detail to understand and, where possible, reproduce the analysis:

- Which exact file and version were examined, and how was its source documented?
- Was the complete recording available, or only a short excerpt?
- What specific manipulation hypothesis and forensic task were tested?
- What method and software version were used, and when was that version assessed?
- Was the method validated on comparable media, including relevant compression or editing?
- What false-positive and false-negative limitations apply, and can another examiner reproduce the result?
These are practical questions, not a quoted legal checklist. The examiner’s qualifications, independence, methods, and compliance with the court’s expert-evidence requirements also matter. NIST’s program does not endorse individual examiners or providers.

In Matter of M.S. (M.H.), 2026 NY Slip Op 00825, the New York Court of Appeals considered recordings recovered after a substantial interval and challenged on foundation and custody grounds. The majority concluded that the proponent had not adequately authenticated the recordings on that record. It considered their unusual origin, their selection from a longer feed that was not recovered, and the delay before recovery.
The dissents disagreed, arguing that circumstantial corroboration and testimony from a forensic witness were sufficient, and warning against unsupported deepfake speculation. The disagreement makes the case useful as an example of how provenance, missing context, and expert evidence can be weighed—not as a nationwide test for video evidence.

“The failure to authenticate evidence sufficiently does not mean the evidence was false, but only that it was not properly authenticated according to the rules of evidence.”
That statement is from the New York Court of Appeals majority in Matter of M.S. (M.H.). It captures the distinction between whether evidence meets an authentication requirement and whether it is actually false.
When to get legal or forensic help
If a video could materially affect a legal dispute, consult a lawyer familiar with the court and case type before relying on a detector result or making a technical claim. A qualified video-forensics examiner may help identify what can be tested and explain the limits of the result. Check the examiner’s qualifications, methods, tool validation, potential conflicts, and fit with the court’s expert requirements.
