EU export controls can affect a defence technology company before anything is shipped: software, technical information, brokering and some transfers may be regulated alongside physical exports. The route depends on whether a product is military or dual-use, where it is going, who will receive it and how it will be used. Companies must also account for national licensing rules and sanctions, which are separate layers of review.
Which export-control regime applies?
There is no single EU licence that covers every defence-related product or transaction. The starting point is classification: military products and dual-use items generally follow different legal routes, while destination, end use and national rules can add controls.

“Dual-use” refers to items, including software and technology, that can be used for both civil and military purposes. The category is broad: the EU list spans areas such as electronics, computers, information security, sensors and lasers, navigation and avionics, marine, aerospace and propulsion. A product’s commercial label or intended market does not settle its legal classification.
Why classification is only the first check
A listed item may need an authorisation, but an item’s absence from the common list does not automatically make a transaction unrestricted. The EU framework includes end-use controls, and Member States may impose controls on unlisted goods or transfers in specified circumstances. Destination, recipient, intended use and diversion risk therefore matter alongside the item’s technical characteristics.

Sanctions are a separate transaction-screening layer. EU Russia-related measures cover diverse goods and specified entities, including products identified as relevant to Russia’s military-industrial capacity. Check current measures and lists for each relevant transaction rather than relying on an earlier screening result. The Commission’s sanctions guidance is one starting point; the applicable measure and current listing must still be checked for the transaction at hand.
What companies need to do before a shipment or transfer
A workable review connects product classification to the actual transaction. The same hardware or software can raise different authorisation questions when its specifications, destination, recipient or intended use changes.

- Describe and classify the item. Keep technical descriptions and classifications for hardware, software and relevant technical information. Check the applicable military or dual-use control lists against the product’s actual capabilities.
- Identify the transaction route. Determine whether the activity is an export outside the EU, an intra-EU transfer, brokering, technical assistance, transit or another regulated activity. Do not treat a transfer as unregulated simply because it is not a conventional shipment.
- Check destination, end user and end use. Gather enough information to assess the recipient, the intended application and the risk of diversion. Ask for clarifications when the proposed use or supply chain is unclear.
- Screen sanctions and other applicable restrictions. Check the parties, goods, destination and activity against current EU measures, and determine whether any restriction applies independently of the export-control classification.
- Confirm the authorisation route with the relevant national rules. Identify whether an EU or national general authorisation, an individual or global authorisation, or a qualifying large-project authorisation could apply. Verify eligibility, conditions and competent authority before committing to a shipment or transfer.
- Record the decision and keep required records. Preserve the classification rationale, transaction details, licence or authorisation conditions, and relevant commercial and shipment documents. Regulation (EU) 2021/821, as summarized by EUR-Lex, requires exporters to retain specified export records for five years.
This is a compliance workflow, not a substitute for advice from the competent authority or qualified counsel on a specific transaction. The governing route and authority depend on the item, activity, destination and national implementation.
How authorisations affect operations
The EU dual-use framework provides several authorisation paths, but no single path is available for every item or destination. EU general authorisations apply only to specified destinations and conditions; national general authorisations may also exist. Individual and global authorisations are issued by national authorities, while large-project authorisations may cover qualifying projects. Companies need to confirm the applicable route, eligibility and conditions rather than treating a general authorisation as blanket permission.

Applications may require complete information about the end user, destination and end use. This makes export controls a commercial and operational concern as well as a legal one: sales, engineering, logistics and compliance teams may all need to contribute accurate information before a transaction can proceed. Licence conditions also need to be communicated to the people responsible for carrying out the shipment, transfer or technical support.
What intra-EU defence transfers change—and what they do not
Directive 2009/43/EC establishes a licensing framework intended to make transfers of defence-related products between EU Member States simpler. It provides for general, global and individual licences and encourages use of general licences where risk is controlled. It does not create unrestricted circulation of defence goods: Member States decide which products qualify and set licence terms.

National certification of recipient undertakings can support transfers under relevant general licences. The Commission’s defence-transfer guidance links to CERTIDER, which provides public information on certified recipients. A company still needs to confirm that its product, recipient and planned transfer meet the relevant national licence conditions.

EU-level rules operate alongside national authorities and implementation. In its defence-transfer guidance, the European Commission says differing national approaches and burdensome administrative procedures have caused problems for the European defence industry, particularly small and medium-sized enterprises. The Transfer Directive is intended to reduce those obstacles while preserving Member State control over essential security interests.

For a company, that fragmentation can mean more work to identify the competent authority, understand product eligibility and meet licence conditions across markets. Compliance procedures, reliable product data and clear internal ownership can help teams handle those steps. The available evidence does not establish a representative euro cost, average licence delay or quantified sales impact for European defence technology companies, so such figures should not be treated as general industry facts.
Control lists change: the September 2026 update
On 14 September 2026, the Commission announced adoption of a delegated act updating Annex I of Regulation (EU) 2021/821. The notice identifies new or revised controls involving semiconductor manufacturing and testing equipment and materials, advanced computing integrated circuits and electronic assemblies, certain ceramic matrix composites, inductive rotary encoders, additive manufacturing for energetic materials, silicon-carbide fibre production equipment, and gas-turbine axial-compressor development technology. Read the Commission’s 14 September 2026 update notice.
The notice says the updated list enters into force upon publication in the Official Journal following the scrutiny period. Adoption alone should not be treated as proof that the amendments are already effective. Before relying on the amended list for a transaction, check the Official Journal publication and the applicable effective date, then review whether the change affects existing classifications or planned shipments.
