What drives opposition to data centers?
Community concerns tend to be local and practical: whether electricity demand could affect grid capacity or bills, how much water a facility will use, noise and air quality, land-use effects, tax concessions, and whether promised jobs and public benefits match the project’s costs. These issues vary by location; a project’s efficiency claims alone do not establish whether it fits a community’s available resources or cumulative environmental conditions.
The scale of electricity demand makes careful local assessment important. The Urban Institute’s 2026 checklist, citing the U.S. Department of Energy, reports that data centers accounted for 4.4% of U.S. electricity consumption in 2023 and forecasts a 12% share by 2028. The 2028 figure is a forecast, not a measured outcome. The same checklist reports a 2025 study estimate that electricity bills could rise 8% nationally and as much as 25% in high-growth areas. Those are estimates of possible increases, not observed increases or guaranteed outcomes for a particular community.
Why does engagement need to start before the project is settled?
Residents can influence a project most meaningfully while its site, scale, design, zoning path, and incentives are still open to change. If public input begins only after those decisions are effectively settled, the process may collect comments without giving the community a realistic way to shape the outcome.

Start by identifying who is affected and who has relevant responsibilities: nearby residents, Indigenous rights holders where relevant, utility and water providers, emergency services, workers, and communities that have historically carried environmental burdens. Share a preliminary project profile and invite questions before negotiating incentives or pursuing final approvals. Canada’s official responsible-development principles express a similar approach: “Proponents must engage early with host communities and Indigenous rights holders to identify benefits that reflect their priorities.”
Local governments can make the process meaningful by explaining when decisions will be made, what remains changeable, how residents can comment, and how public input will be considered. The Urban Institute describes early agreements among residents, governments, and companies as one possible model, but the appropriate form and legal authority differ by jurisdiction.
What should developers disclose?
Provide a plain-language project profile that distinguishes estimates from commitments and identifies assumptions. Update it when plans change. Useful disclosures include:

- Site location, land footprint, facility size, and proposed development phases.
- Expected construction and operational employment, with the time period and whether figures describe direct or indirect jobs.
- Expected electricity demand and source, backup generation, and anticipated transmission or substation needs.
- Water source and expected use, including cooling needs where applicable.
- Noise and emissions assessments, the methods used, and any proposed screening or mitigation.
- Proposed tax treatment, incentives, and public infrastructure obligations.
Assess these plans against local conditions: water availability, grid capacity, land-use context, noise and air-quality conditions, and emergency-response needs. Consider cumulative burdens from existing and planned development, not just the performance of one facility. This gives residents and decision-makers a basis for comparing projected impacts with community priorities and available capacity.
Which local controls can shape a project?
Where local law allows, governments can use data-center-specific planning and review rather than relying only on general rules. Potential controls include location and size requirements, impact studies, setbacks, noise analysis, visual screening, building-design provisions, substation review, and public hearings. The right mix depends on local conditions and on which level of government has authority.
Fairfax County provides one example of a locality using siting and size rules, noise studies, visual screening, building-design provisions, distances from homes or transit stations, and review of substations. It is an example, not a universal template. Fairfax County also distinguishes county zoning and substation review from state control over electricity rates and transmission matters. Local officials should verify their own authority and any state preemption before adopting or promising a particular control.

Who should pay for electricity and infrastructure?
Do not assume the costs of serving a large new load will be harmlessly absorbed by utilities or existing customers. Explain the applicable utility rules and identify who is expected to pay for generation, transmission, substations, and other upgrades attributable to the project. Depending on local and state authority, protections may include customer classifications, project-specific charges, or other lawful cost-allocation measures.
Canada’s responsible-development principles say proponents should pay costs of connection and service attributable to their projects. New Jersey’s August 27, 2026 announcement describes clean-energy and rate-class measures intended to prevent costs from being shifted to other ratepayers. These are jurisdiction-specific approaches; they do not establish what another state or utility can require. Local decision-makers should coordinate with the relevant utility and regulators and explain both the rules in force and any unresolved cost allocation.

Negotiate benefits around priorities residents identify, such as public infrastructure, schools, workforce training and apprenticeships, local procurement, emergency services, or a governed community fund. Avoid broad promises that lack a responsible party, delivery date, measurement method, or remedy if they are missed.

A community benefits agreement (CBA) can provide a structure for negotiation and accountability, but it cannot resolve every question about land use, resource capacity, utility rates, permits, or environmental harm. The Urban Institute notes that some CBAs may require communities to waive future claims or renegotiation options, and that some states limit local agreement powers. Voluntary pledges can also be difficult to track without external enforcement. Distinguish signed obligations from public statements of intent, and obtain legal review of an agreement’s scope and effect.
For each commitment, specify:
- What will be delivered, by whom, and by what date.
- How completion or performance will be measured and who will verify it.
- Where any funds will go, who will govern their use, and how allocations will be reported.
- Whether obligations continue if the project changes ownership.
- How residents can raise disputes and what remedies apply if commitments are missed.
The Urban Institute’s 2026 checklist gives Cedar Rapids community-fund examples. They illustrate reported agreement terms, not standard requirements or proof that a fund resolves every impact.

What should be reported after approval?
Set a public reporting schedule that follows through from projections to actual results. Reports can cover electricity and water use, cooling, employment, noise testing, emissions, community contributions, and progress against agreement commitments. Give residents a way to review the reports and ask questions; use independent verification where feasible. Include a complaint process, periodic review, successor obligations, and defined remedies in relevant agreements.

Track fiscal and employment outcomes over time and report them alongside tax abatements, public infrastructure obligations, utility and water use, and other community burdens. Give job figures their geography, time horizon, and direct or indirect status. A forecast, pledge, or gross investment figure is not, by itself, evidence of a net local benefit.
How should communities compare proposed safeguards?
Compare options against the same local baseline rather than judging a benefit or restriction in isolation. A useful review asks:
- Can affected residents still change the project through this process?
- Does the proposal fit local water, grid, land-use, and environmental conditions?
- Who pays for electricity service and project-related infrastructure?
- Are costs and benefits measured against a credible baseline?
- How are burdens and benefits distributed, including environmental-equity considerations?
- Does the responsible government have legal authority, or is the issue controlled or preempted at another level?
- Are reporting, enforcement, remedies, and later review specified?
The Federation of American Scientists’ local-government guide reviews 42 local ordinances, 12 state actions, property-value samples across six jurisdictions, and 10 executed data-center CBAs. Those figures describe the scope of its review; they do not establish that any single policy is effective everywhere. The Urban Institute likewise cautions that an appropriate approach depends on local resident and economic needs. New Jersey Governor Mikie Sherrill framed her state’s approach as putting power back in communities’ hands while requiring data centers to pay their fair share for energy, contribute to the grid, disclose energy and water use, invest in communities, and bring good union jobs during construction. That is the governor’s stated policy framing, not independent evidence that each goal has been achieved.
