Cryptocurrency and artificial intelligence are not governed by one shared U.S. rulebook. At the federal level, crypto is chiefly being addressed through financial-law categories and the jurisdictions of the SEC and CFTC, while AI policy in the sources reviewed is shaped by executive actions, agency programs, standards work, and debate over federal and state authority. Both fields remain layered: the rules that apply depend on the activity, instrument, and legal authority involved.

Are cryptocurrency and AI regulated by the same federal agencies?

No. The main federal crypto actors in the current materials are the Securities and Exchange Commission (SEC) and the Commodity Futures Trading Commission (CFTC), applying their distinct securities-law and Commodity Exchange Act roles. The SEC and CFTC issued a joint interpretation in March 2026; the CFTC joined to explain that it will administer the Commodity Exchange Act consistently with that interpretation. The action is an agency interpretation and guidance, not a statute that replaces every other applicable law. It took effect March 23, 2026. The Federal Register text sets out its status and effective date.

AI does not have an equivalent single pair of regulators in these materials. Federal involvement varies with the policy instrument and the sector or activity involved. The White House sets executive policy; NIST conducts standards work; and agencies such as Commerce, the Department of Justice, and the Federal Trade Commission appear in particular policy or implementation roles. That does not mean those agencies share a single, comprehensive AI mandate.

The useful comparison is therefore not “which agency regulates each technology?” in isolation. It is which legal domain applies, whether the instrument is binding law or policy, what conduct it addresses, and how federal action interacts with other authorities.

How the federal crypto framework works

Classification depends on the asset and transaction

The SEC’s March 2026 interpretation describes five categories: digital commodities, digital collectibles, digital tools, stablecoins, and digital securities. It also addresses investment-contract questions, including how a crypto asset that is not itself a security may become subject to, or cease to be subject to, an investment contract. Topics discussed include airdrops, protocol mining, protocol staking, and wrapping. The practical point is that a category label alone does not settle the treatment of every sale or transaction: the asset, the transaction, and the promises or efforts at issue matter. The interpretation is not a basis for saying that all crypto is—or is not—a security. The SEC’s announcement summarizes the categories and topics.

The SEC said the interpretation was intended to draw clearer lines. But clarification through an agency interpretation is different from Congress enacting a comprehensive code for every crypto asset and use. The CFTC’s participation likewise does not merge the agencies’ statutory roles: its stated role is administering the Commodity Exchange Act consistently with the interpretation.

Stablecoins have more than one relevant federal instrument

The SEC Division of Corporation Finance’s April 4, 2025 staff statement addressed a defined kind of stablecoin: one designed to maintain a one-to-one value to the U.S. dollar, redeemable one-to-one for dollars, and backed by low-risk, readily liquid reserves whose dollar value meets or exceeds the outstanding redemption value. The statement did not express a view on other designs, including non-dollar, commodity-linked, crypto-backed, or algorithmic stablecoins. It is a staff statement, not a blanket classification of all stablecoins. Read the SEC staff statement for its stated scope.

A separate development is the GENIUS Act, enacted in July 2025. The March 2026 SEC/CFTC interpretation describes its payment-stablecoin framework and the condition governing when that statutory treatment becomes effective. That framework should not be conflated with the narrower 2025 SEC staff statement or extended to every token marketed as a stablecoin. The SEC offering regime is still a proposal

On August 18, 2026, the SEC issued a proposed “Regulation Crypto Assets,” published August 21. It would create tailored offering provisions, including proposed exemptions for offerings of up to $5 million over a four-year period and up to $75 million in each 12-month period, alongside principles-based disclosure and anti-fraud and anti-manipulation provisions. It also proposes a conditional safe harbor. These are proposed terms, not adopted exemptions or current law. The SEC listed October 20, 2026, as the comment deadline, which is still in the future as of October 4, 2026. The SEC proposal page provides the proposal and comment information.

How the federal AI approach differs

Executive policy and agency programs are prominent

The federal AI materials describe a policy-and-implementation approach rather than one omnibus AI statute. Executive Order 14110, issued October 30, 2023, was rescinded on January 20, 2025, according to NIST’s timeline. Executive Order 14179, issued January 23, 2025, called for an AI action plan and a review of actions taken under the rescinded order. On July 23, 2025, the White House released an action plan containing more than 90 federal policy actions across three pillars: accelerating innovation, building American AI infrastructure, and international diplomacy and security. The action-plan figure describes federal policy actions, not a count of enacted AI laws. NIST’s timeline, EO 14179, and the White House plan document these steps.

Executive orders direct executive-branch action within their scope; they are not the same instrument as an act of Congress. Similarly, an action plan sets an agenda but does not by itself create a single uniform set of duties for every private AI developer or deployer. Sector-specific federal laws and authorities may also be relevant, but the federal sources summarized here do not inventory them all.

NIST standards work is not automatically a private-sector mandate

NIST’s plan for federal engagement in AI standards identifies focus areas including terminology, data and knowledge, human interaction, measurement, networking, performance testing and reporting, safety, risk management, and trustworthiness. It calls for sustained federal participation and public-private work. Those are standards-engagement priorities and technical work; they do not, by themselves, impose generally binding duties on private AI developers. The plan, created August 10, 2021 and updated August 14, 2026, says the government should “commit to deeper, consistent, long-term engagement in AI standards development activities to help the United States to speed the pace of reliable, robust, and trustworthy AI technology development.” See NIST’s plan.

Federal-state authority remains contested

Executive Order 14365, dated December 11, 2025, states a preference for a minimally burdensome national AI framework. It directs the Attorney General to establish a task force to challenge certain state AI laws, directs Commerce to evaluate state laws, and calls for legislative recommendations. Those are executive directions; the order does not establish that every state AI law has been invalidated or preempted.

The White House’s March 20, 2026 national AI legislative framework was presented as a framework for working with Congress on legislation. A recommendation to Congress is not itself enacted law. The state-by-state status of AI laws, and the outcome of challenges to particular statutes, cannot be determined from these federal actions alone. EO 14365 and the March 2026 framework describe the administration’s position and proposed next steps.

A later order changes terminology, not the underlying code

Executive Order 14434, issued September 29, 2026, directs agencies, to the maximum extent permitted by law, to use “Super Intelligence” and “SI” instead of “Artificial Intelligence” and “AI” in specified non-statutory executive-branch communications. It defines the new terms by reference to the existing statutory AI definition and says prior documents need not be altered. This is a terminology direction for agency communications, not an amendment to the statutory definition or a general AI regulatory code. Read EO 14434.

This comparison is limited to the federal materials described above. It is not a complete inventory of state money-transmission, licensing, consumer-protection, privacy, or AI laws, or of every sector-specific federal rule that could apply. A question about a particular business, token, AI system, or state therefore requires looking at the specific activity and jurisdiction rather than relying on the broad labels “crypto” or “AI.”

What the comparison means in practice

  • For a crypto question, start with the transaction. Identify the asset, how it is offered or used, and any promises or efforts relevant to an investment contract; then identify which federal financial-law framework may apply.
  • For an AI question, start with the activity and sector. Separate binding statutes or rules from executive direction, policy plans, and voluntary or technical standards work.
  • For either technology, check jurisdiction. Federal policy does not eliminate the possibility of other applicable federal or state requirements. For AI in particular, EO 14365 signals a federal-state dispute but does not settle the validity of every state law.
