A cryptocurrency mixer tries to make it harder to connect the address that sends funds with the address that later receives them. That can support financial privacy, but it can also make it harder for exchanges, financial institutions and investigators to trace funds, screen for sanctioned parties and assess suspicious activity. Using a mixer is not, by itself, proof that a person or transaction is criminal.

How a crypto mixer works

Public blockchains record transactions between addresses, but an address does not inherently identify the person or organization behind it. A mixer is intended to weaken the visible connection between funds sent in and funds sent out.

At a high level, the U.S. Treasury described Tornado Cash as receiving transactions, mixing them and then transmitting funds to individual recipients. The aim is to obscure the origin, destination or counterparties of a transaction. This description explains the general purpose, not the technical operation of every mixer or a guarantee that transactions cannot be traced.

For example, if one address sends funds into a mixing service and another address later receives funds, the service seeks to make the relationship between those two addresses less straightforward to infer from the public transaction record. The public ledger still records transactions; the intended effect is to complicate the interpretation of links between them.

Why mixers raise compliance concerns

Financial institutions and virtual-currency businesses may need to identify where funds came from, where they went, and whether they are connected to sanctioned parties or illicit activity. When transaction links are harder to follow, screening and investigations can become more difficult. Investigators may also have a harder time reconstructing suspicious flows.

That is a compliance and investigative challenge, not an automatic judgment about every mixer user or transaction. Privacy and illicit use are not interchangeable: obscured links can create legitimate privacy benefits while also being attractive to people seeking to conceal proceeds or evade controls. Treasury’s 2022 action against Tornado Cash and FinCEN’s 2023 proposal reflect U.S. agencies’ concern about that risk; they do not establish that all mixer activity is illicit.

FinCEN’s stated concern

In announcing a proposed rule in 2023, FinCEN Director Andrea Gacki said: “CVC mixing offers a critical service that allows players in the ransomware ecosystem, rogue state actors, and other criminals to fund their unlawful activities and obfuscate the flow of ill-gotten gains.” This was the agency’s position accompanying a proposal, not a finding that every use of mixing is criminal.

What recent U.S. actions mean

The policy history matters because the status of a particular sanction or proposed rule is different from a general conclusion about whether all mixing is lawful. These developments are U.S.-specific and do not settle the legal position in other countries or every user’s circumstances.

August 2022 Treasury announced sanctions against Tornado Cash. This was a sanctions action concerning Tornado Cash at that time, based on Treasury’s stated concerns and allegations of illicit use.
October 19, 2023 FinCEN proposed a special measure under Section 311 concerning international convertible virtual currency (CVC) mixing. The proposal would have required covered financial institutions to report specified transactions they knew, suspected or had reason to suspect involved mixing. It was a proposal, not a final rule.
March 21, 2025 Treasury announced it was removing economic sanctions against Tornado Cash. Treasury cited its review of novel legal and policy issues and a court filing in Van Loon v. Treasury. This changed Tornado Cash’s sanctions status; it did not establish that all mixing is lawful or compliant.
October 5–6, 2026 FinCEN announced withdrawal of the proposed CVC-mixing rule on October 5; its status table recorded the proposal as rescinded on October 6. As of October 7, 2026, the 2023 reporting proposal is withdrawn, not an active final reporting requirement.

These statements describe the cited U.S. agency actions as of October 7, 2026. Sanctions and rulemaking status can change; readers making a decision with legal or compliance consequences should check the relevant current Treasury and FinCEN publications and seek advice for their jurisdiction and circumstances.

What mixer exposure does—and does not—show

  • It can be a risk signal. A connection to mixing may make the origin or destination of funds harder to assess and prompt additional scrutiny by a financial institution or investigator.
  • It is not proof of a crime on its own. A mixer-related transaction does not, by itself, establish who controlled an address, why funds were moved or whether a user acted unlawfully.
  • It does not guarantee anonymity. The purpose is to make transaction links harder to follow, not to erase the public transaction record or assure that tracing is impossible.
  • The legal answer depends on context. The cited actions describe U.S. policy toward specific services and a withdrawn proposal; they do not provide a universal legal rule for every mixer, user or country.
