Yes, stolen crypto can sometimes be frozen, seized or included in a court-supervised distribution—but there is no universal crypto recovery plan, and tracing funds is not the same as getting them back. The route may involve an exchange freeze, a law-enforcement seizure and forfeiture, a victim-compensation process, a civil claim, or a bankrupt exchange’s claims plan. Each has separate rules for controlling assets, proving eligibility and distributing money. The U.S.-focused examples below explain those distinctions; laws and procedures vary by country.

What “crypto recovery” can mean

After a theft, people often use “recovery” to describe several different steps. Funds may be traced without being frozen; frozen assets may not be legally forfeited; forfeited money may still require a victim petition; and an approved claim may pay less than the amount claimed. Success at one stage does not guarantee success at the next.

  1. Trace: identify where transactions went. A tracing report alone does not compel an exchange or anyone else to act.
  2. Control: an exchange may freeze an account under its own process or in response to legal process; law enforcement and courts control legal seizure and forfeiture pathways.
  3. Establish eligibility and amount: a court, claims administrator or remission process applies its own definitions, evidence rules and valuation method.
  4. Distribute: available assets or proceeds are paid according to the relevant case’s rules, priorities and procedures.

The FBI’s Internet Crime Complaint Center (IC3) states that “Private sector recovery companies cannot issue seizure orders to recover cryptocurrency.” A private firm may offer tracing or other services, but it cannot create the legal authority to seize assets.

Which recovery route applies?

Route What it can do What it does not guarantee
Exchange freeze An exchange may hold assets in an account under its internal process or in response to legal process. A freeze is not a final return of funds or proof that the assets belong to a particular claimant.
Law-enforcement seizure and forfeiture Authorities may investigate, seize suspected criminal proceeds and seek forfeiture through legal proceedings. A seizure or complaint is not a completed forfeiture or a payment to victims.
Remission or victim-compensation process After assets are forfeited, eligible victims may be invited to petition for a share of funds available in that case. Petitioning does not guarantee eligibility, a particular amount or a payment date.
Civil claim or lawsuit A claimant may seek a remedy through a civil proceeding, subject to applicable law and the facts. A judgment or claim does not ensure that assets can be collected or that proceeds will cover losses.
Insolvency or bankruptcy distribution A court-supervised plan may distribute estate assets to holders of allowed claims under case-specific terms. It does not necessarily return the original coins or pay the full claimed value.

Exchange freezes and law-enforcement action

The FBI says exchanges freeze accounts through internal processes or in response to legal process. Whether funds can be held depends on the exchange’s procedures and any applicable investigation or legal action. Reporting promptly and supplying transaction details can help authorities assess a matter, but it does not itself order an exchange to freeze or return funds.

Forfeiture and remission

In a forfeiture case, authorities seek legal control of assets believed to be connected to crime. If assets are forfeited, a separate remission or victim-compensation process may allow eligible people to petition for a share. These are distinct stages: an investigation or seizure does not by itself establish a victim’s right to payment.

For example, the U.S. Department of Justice (DOJ) said on March 21, 2025, that it had recovered $7 million in investment-fraud proceeds and cleared title through civil asset forfeiture; victims would be invited to submit petitions for remission. This is an example of one case’s process, not a recovery-rate template.

On June 18, 2025, the DOJ announced a civil forfeiture complaint involving more than $225.3 million in cryptocurrency allegedly connected to fraud and laundering. A complaint sets out allegations and begins a legal process; it is not a finding that the assets have been forfeited or distributed.

Bankruptcy and insolvency claims

A bankrupt exchange’s process concerns the estate and its creditors; it is not automatically a mechanism for returning each customer’s original tokens. In its general Chapter 11 overview, the U.S. Courts says creditors whose claims are not scheduled, or are listed as disputed, contingent or unliquidated, generally need to file a proof of claim with supporting evidence to participate in voting and distribution. The specific court orders and plan govern deadlines and exceptions.

FTX’s customer FAQ says only holders of allowed claims are eligible for distributions. Its case-specific prerequisites include KYC checks, tax forms, onboarding with a distribution provider and sanctions screening. FTX also warns that a holder who does not complete onboarding within six months of the July 31, 2026 distribution date may forfeit the right to distributions on that claim. These requirements and that deadline apply to the stated FTX process, not to bankruptcies generally; check the relevant case administrator’s current instructions.

Why a claim amount can be much larger than the payment

The available assets may not cover all losses

Funds may have been spent, moved, mixed or hidden before they could be recovered. A bankruptcy estate may also owe money to multiple creditor groups. Only assets that are legally recovered or otherwise available under the applicable plan can be distributed, and expenses, reserves, claim classes and priority rules can affect each claimant’s share.

Valuation rules may not match today’s token price

A case may value a claim using a specified date or conversion table rather than the current market price, and it may pay cash instead of returning the original quantity of a token. FTX says a bankruptcy court approved a digital-asset conversion table on February 7, 2024, for estimating claims in that proceeding for solicitation, voting and distribution. FTX cautions that the estimate is not the asset’s value on the filing date.

Terraform’s court-approved crypto-loss claims procedures distinguish the loss amount from the eventual payment: “your Crypto Loss Amount is the amount of your Crypto Loss Claim, but it is not the amount of your recovery.” The procedures say a holder’s pro-rata share of amounts approved for distribution may be materially less. An asserted or allowed amount is therefore not, by itself, a promise of payment in that amount.

Evidence, deadlines and eligibility matter

A claim may be disputed, unsupported, ineligible or late, or may require additional identity, tax or payment steps. The claim process and definition of an eligible victim depend on the particular case and legal authority. In a DOJ notice dated November 7, 2024, concerning the Bitfinex hack, the government opened a channel for potential victims to provide information and assert rights, while stating that its position for purposes of the Crime Victims’ Rights Act was that there were no victims of the offenses of conviction. That case illustrates why “victim” status and related rights cannot be assumed to mean the same thing in every proceeding.

What to do after a crypto theft

  1. Preserve records. Save transaction hashes, wallet addresses, exchange names and account details, dates, amounts, and communications. Keep original messages and files where possible.
  2. Report through official channels. For suspected investment fraud in the United States, the FBI advises reporting to IC3 or a local FBI field office and providing transaction and contact information where possible. Reporting does not guarantee restitution.
  3. Check for an actual case process. If an exchange, court, government agency or claims administrator names a process, verify it through that organization’s official channel. Follow the case’s current instructions and deadlines.
  4. Use the case’s claim procedure. Read the relevant order, plan, claims portal or remission notice to confirm eligibility, required evidence, valuation method, identity checks and payment steps. Do not rely on a deadline from a different case.
  5. Protect accounts that remain at risk. Secure unaffected exchange and email accounts and review access to wallets. These steps may limit further loss, but they do not recover already stolen funds.

For context, More than $2.5 billion in cryptocurrency investment-fraud losses reported in 2022 — FBI Internet Crime Complaint Center, 2023. That figure concerns reported investment-fraud losses, not hacks alone, the amount recovered or a recovery rate.

How to spot a recovery scam

The FBI warns that recovery scammers may contact victims through social media or messaging apps, advertise in comments or search results, present themselves as law enforcement or legal services, and charge an upfront fee. Some provide incomplete or inaccurate tracing reports, then demand more money. The FBI also says that almost all victims of cryptocurrency investment schemes are contacted by recovery scammers after losing money.

  • Be wary of unsolicited contact, guaranteed results, claims of official affiliation that you cannot verify, upfront fees and repeated requests for more payments.
  • Do not share personal or financial details or send money to an unknown person claiming they can recover your crypto.
  • Verify any named case, lawyer, service or government contact independently through the relevant official organization.
  • The FBI says law enforcement does not charge victims a fee for investigating crimes.

A recovery company’s tracing ability, legal representation, fees and claimed results are separate claims that require separate verification. No private provider can issue a seizure order, and a purported connection to law enforcement should not be treated as an endorsement.

What the case examples do—and do not—tell you

The DOJ announced on April 13, 2026, a OneCoin remission process using forfeited assets. In that notice, the DOJ reported that its Criminal Division’s Money Laundering, Narcotics and Forfeiture Section had returned more than $12.5 billion in forfeited assets to victims of crime since 2000. That is a DOJ-reported, program-wide total across crimes, not a crypto-only figure or an estimate of any OneCoin claimant’s recovery.

These examples show different procedural stages and legal routes, not a typical percentage victims should expect. No universal crypto recovery percentage follows from them. The FBI’s IC3 figure describes reported investment-fraud losses, not recoveries. The amount any individual receives depends on the case’s available assets, rules, claims and distribution process.

Where to check current rules

This article uses U.S. government, court and case-administrator examples. Recovery rights and procedures differ across jurisdictions, and claim deadlines or distribution steps can change. For a live matter, consult the official court docket, claims administrator, exchange or trust portal, or remission administrator named in that specific case.
