In the United States, the tax treatment of a cryptocurrency ETF depends first on how the product is structured. Many spot bitcoin and ether exchange-traded products are commodity trusts that say they are treated as grantor trusts; other crypto-related funds may be regulated investment companies (RICs). Selling shares can create a capital gain or loss, while trust activity or fund distributions may also have tax consequences—even if you did not sell your shares.

This is a general overview of U.S. federal income tax treatment, based on sources available October 7, 2026. It does not determine state, local, foreign, or individual tax results.

Start with the fund’s legal and tax structure

“ETF” is a common label, not a complete description of a product’s tax treatment. The SEC’s September 2024 Investor Bulletin explains that spot bitcoin and ether exchange-traded products are commodity trusts, not registered investment companies under the Investment Company Act of 1940, even though people often call them ETFs. A crypto-related strategy fund may use a different structure, such as a RIC.

The iShares Bitcoin Trust prospectus is one example of a spot trust whose sponsor says it will treat the trust as a grantor trust. The prospectus also cautions that counsel’s tax opinion is not binding on the IRS and that there is no assurance the IRS will agree. That example does not establish the treatment of every bitcoin, ether, or other crypto product.

What happens when you sell ETF or ETP shares?

If you hold the shares as a capital asset, a sale generally requires you to compare the amount realized with your adjusted basis. The difference is your gain or loss. The IRS’s general guidance treats digital assets as property and describes a holding period of one year or less as short-term and a period longer than one year as long-term. Those are general capital-asset holding-period rules; your particular circumstances can affect the result.

For capital-asset transactions, IRS instructions generally direct taxpayers to report dispositions on Form 8949 and Schedule D. Keep purchase and sale confirmations and cost-basis records, and use the forms and instructions for the tax year at issue. These general rules for a sale of shares do not cover every possible tax item from the fund itself.

Why tax items can arise even if you did not sell shares

If a spot trust is treated as a grantor trust, trust-level transactions and expenses may be allocated to shareholders under that treatment. For example, a trust may sell some crypto to pay expenses. The investor may therefore need to review trust tax information as well as records of their own share transactions.

Do not assume an ordinary broker consolidated Form 1099 necessarily captures every relevant trust-level item. Compare broker forms with the particular fund’s tax reporting materials for that year, and seek qualified tax advice if the documents differ or leave an item unclear.

How fund distributions may be taxed

A RIC may report distributions as ordinary income, capital-gain dividends, or return of capital. In one SEC-filed prospectus dated April 4, 2025, the fund says its capital-gain dividends are generally treated as long-term capital gains, while return-of-capital distributions generally are not taxable when received but may reduce the shareholder’s basis. This is a fund-specific example, not a rule for every crypto fund or every tax year. Use the fund’s own annual tax forms and distribution notices.

Does owning a cryptocurrency ETF mean you answer “Yes” to the digital-asset question?

Not automatically on the information available here. IRS forms ask about digital-asset activity, and IRS materials describe relevant activity in terms that include receiving digital assets or selling, exchanging, or otherwise disposing of a digital asset or a financial interest in one. The reviewed IRS materials do not conclusively settle how that question applies to every ETF or ETP share transaction and every tax form.

Read the exact question and instructions for the form and tax year you are filing, and consider your specific transaction facts. Merely owning a crypto-themed fund does not, by itself, establish a universal “Yes” or “No” answer.

What to check before filing

  1. Identify the wrapper. Read the current prospectus to determine whether the product is a commodity trust, RIC, partnership, or another structure.
  2. Review what the fund does. Check whether it holds crypto directly or uses derivatives, options, staking, or other activities that may affect tax reporting.
  3. Gather the year’s documents. Collect trade confirmations, basis records, broker forms, fund tax statements, distribution notices, and any other tax information the fund provides.
  4. Reconcile reported items. Check whether the sale proceeds and basis on broker forms match your records, and whether fund materials report additional items or distributions.
  5. Apply your own account and location facts. Taxable brokerage, tax-advantaged accounts, state residence, holding period, and other transactions can matter. This overview does not resolve those individual or non-federal issues.

Recent development: a limited staking safe harbor

Revenue Procedure 2025-31, published by the IRS in Internal Revenue Bulletin 2025-48 on November 24, 2025, provides a safe harbor under which certain trusts that otherwise qualify as investment trusts and grantor trusts may stake digital assets without jeopardizing that treatment if they meet the procedure’s conditions. It also provides a limited period for an existing trust to amend its agreement to adopt the requirements. This does not mean that every spot trust stakes assets or that every staking arrangement qualifies. Check the fund’s current disclosures and tax information.
