Age-verification laws can make people prove or estimate their age before they can access particular content or features. That can affect privacy because the check processes personal data, and it can affect access if someone cannot or will not complete it. The consequences depend on the country, the service, the method, and how the data is handled; there is no single global rule or one privacy impact shared by every age check.
What age-verification laws require
Rules may apply to a particular kind of content, service, or feature rather than requiring every website to check every visitor. They also differ by jurisdiction. The OECD’s 2025 comparative report maps laws and policies while distinguishing enacted requirements from proposed laws and non-enforceable initiatives, so a policy discussion or proposal should not be mistaken for a legal duty.
The United Kingdom is a useful example, not a template for other countries. Under the Online Safety Act 2023, in-scope user-to-user and search services carry out a children’s access assessment. User-to-user services likely to be accessed by children then carry out a children’s risk assessment and implement relevant protections. Publishers of pornography covered by Part 5 must use highly effective age assurance before users can access pornography. Which duties apply depends on the service and content.
In the European Union, the European Commission’s 2026 recommendation calls for age-verification methods that are robust, cybersecure, privacy-preserving, and compliant with data-protection rules. A recommendation is not evidence of one identical requirement in every country. In the United States, state laws and court orders can change independently; a report about one state, such as the Associated Press’s coverage of Texas, is not a current survey of all 50 states. For a specific place, check the applicable law and the latest court orders.

What counts as age assurance
Age assurance is a broader term than checking an identity document. It includes methods that verify age using evidence and methods that estimate whether someone is likely to be above an age threshold. Ofcom’s UK standard is “highly effective age assurance” (HEAA), assessed against technical accuracy, robustness, reliability, and fairness. Ofcom identifies the following methods as capable of meeting that standard, but the method’s name alone does not establish that a particular implementation complies.
- Credit-card checks
- Digital identity services
- Email-based age estimation
- Facial age estimation
- Mobile-network age checks
- Open banking
- Photo-ID matching
Ofcom’s list is non-exhaustive. It says self-declaration and payment methods that do not require a user to be over 18, such as debit cards, are not highly effective. Providers must also consider how the check works in practice, including challenge ages, relevant liveness checks, performance monitoring, and resistance to circumvention.

How age checks can affect privacy
An age check involves processing personal data, but the privacy implications are not identical across methods or providers. A check may involve different kinds of evidence or account information; it does not follow that every provider receives or stores a copy of an identity document or biometric data. Ofcom says providers may process personal data for age assurance when the method is necessary and proportionate to the risks and complies with data-protection legislation. It treats online-safety and data-protection duties as obligations that apply together, not as a choice between child safety and privacy.

- What information is requested? Is it an identity document, a face image, payment credentials, or account or telecom information?
- Who handles the evidence? Does the service receive the underlying evidence, or does an intermediary provide only an age result?
- What happens to the data? How long is evidence retained, who can access it, and how is it deleted?
- What if the check is wrong? Is there a way to challenge a failed or inaccurate result?
- How is the method protected against misuse? Does the provider explain its safeguards and how it oversees any third party involved?
Ofcom says a service remains responsible for its compliance when a third party supplies age assurance. Its 2026 report on the first six months of child-protection duties identifies privacy and data-protection compliance as areas for improvement, including clearer information and due diligence. The report describes its findings as early and does not offer final conclusions on age-assurance effectiveness.
How checks can affect access
A check can add a step, require evidence a person does not have or want to provide, or produce an inaccurate result that blocks access. Its scope matters: a gate can restrict access to particular content, while other safeguards may be aimed at specific features or risks. A check on an entire service is not a universal requirement for every platform.

For UK pornography services subject to the relevant duty, Ofcom instructs providers not to show pornography before or during an age check. For other services, where and how an age check is used to target safeguards can depend on the service, content, and risk. The intended protection for children and the possibility of friction or exclusion for adults are separate effects to assess; neither can be inferred just from the existence of a law.
When comparing a service’s check with another, the useful questions are whether it is effective and hard to circumvent, what data it collects, whether an intermediary handles the evidence, how retention and deletion work, how users can challenge errors, and whether the gate applies to particular content or a whole service. These factors can matter more than the label attached to the method.

What early UK figures do—and do not—show
Ofcom’s 2025 figures describe early changes around the rollout of UK age checks. They show changes in reported visits and encounters with checks, but do not by themselves establish why those changes occurred or prove a particular privacy or access outcome.

These measures do not show that adults lost access, that personal data was mishandled, or that children’s exposure fell by the same amount as site visits. Ofcom’s 2026 report covers the first six months of child-protection duties and says it does not provide final conclusions on age-assurance effectiveness.
How to judge a particular age check
For a specific service, assess the actual check and the rules that apply to it rather than assuming all age-verification systems work alike.
- Identify the jurisdiction and service. Confirm where the service operates, what kind of service it is, and whether the requirement concerns particular content or the service more broadly.
- Find out what the check asks for. Read the provider’s explanation of the method and the information it requires; do not assume that an intermediary means the service receives no personal data.
- Read the data-handling information. Look for the purpose of processing, retention period, deletion practices, access controls, and any third parties involved.
- Check how errors are handled. Find the appeal or alternative route if the check misjudges someone’s age or cannot be completed.
- Consider the gate’s scope. Determine whether it restricts access to specific content or features, or to a whole service, and whether that scope matches the stated rule.
In the UK, Ofcom’s guidance says providers should give users clear information about how personal data is processed, used, and deleted. Ofcom also notes that the UK Government announced future age restrictions for social media in June 2026 and that it was assessing assurance for age 16; existing duties continue in the meantime.
