The case details are not fully consistent across the available records: LiveLaw Biz reports a ₹6,62,077 demand in case APL/82/LCK/2026, while a separate reproduced order identifies Jai Enterprises v. Pankaj Gandhi as APL/38/LCK/2026 and states a different amount. The signed official order is needed to confirm whether these are separate cases or one record contains an error.
What the reported ruling decided
LiveLaw Biz reported that the Lucknow Bench allowed Jai Enterprises’ appeal after tax authorities inferred e-way-bill reuse from vehicle movements and toll-plaza records. The report says the vehicle appeared to travel from Kanpur toward Etawah, return toward Kanpur, and later head toward Auraiya on the same day. Authorities treated that movement as suggesting the goods had already been transported and the invoices and e-way bills reused.
According to the report, the goods’ description, quantity, value and ownership matched the accompanying documents. The Tribunal found no independent evidence that the goods had completed an earlier journey or had been delivered. LiveLaw Biz identifies the matter as APL/82/LCK/2026, decided on 16 September 2026, and reports a demand of ₹6,62,077 under the Central GST and Uttar Pradesh GST Acts. Why the case records need to be distinguished
A reproduced order hosted by TaxHeal also concerns Jai Enterprises, but it gives materially different case particulars. It is headed Jai Enterprises v. Pankaj Gandhi, Addl. Commissioner, State Tax, identifies case APL/38/LCK/2026, and is dated 25 August 2026. It describes a vehicle carrying goods from Jai Enterprises in Nayaganj, Kanpur, to Fatehpur on 1 March 2022. The report and reproduced order could concern separate matters, or one record could contain an error; the available material does not resolve that question.

TaxHeal’s reproduction says the ₹6,06,844 demand included a penalty of ₹74,382 and a cess penalty of ₹4,58,080. Those components do not add up to the stated total, so they should not be treated as verified arithmetic. The reproduction also says the original Section 129 order was dated 8 March 2022, the first appellate order was dated 11 October 2023, and the appeal was brought under Section 112 of the Central GST Act and corresponding Uttar Pradesh GST provisions. What the reproduced order says about proof of e-way-bill reuse
In the APL/38 text, the vehicle was checked at Jhakarkatti at 1:27 p.m. and checked again at 9:52 p.m. near Cooperganj/Jhakarkatti. Jai Enterprises said the vehicle had broken down and submitted a repair bill and driver affidavit. The order reproduction says the department did not establish that the repair bill was fake or forged.

The reproduced order says there was no discrepancy in the goods’ description, quantity, value or ownership, and that tax invoices or e-invoices and e-way bills accompanied them. It describes the finding of re-transportation as resting principally on an inference from an earlier verification or location, without independent and cogent proof that the same goods had completed an earlier journey and been delivered. It says the appeal was allowed, the original and first appellate orders were set aside, and ₹6,06,844 was ordered refunded in accordance with law.
The reproduced text attributes this statement to paragraph 32.8: “Intention cannot be presumed merely from suspicion, and a presumption of tax evasion cannot take the place of proof of the underlying contravention.” Because this wording comes from a secondary reproduction, it should not be treated as verified against the signed official order.

What the ruling does—and does not—establish
The evidentiary point is narrow: on the records described, an inference from vehicle movement or a prior check did not itself prove that the same goods had already completed a journey, been delivered, or travelled under reused documents. The Tribunal’s assessment, as reported and reproduced, depended on the accompanying documents matching the goods and on the absence of independent evidence establishing the alleged earlier transportation.
This is not a blanket rule that vehicle-movement records are irrelevant, or that every GST detention or penalty requires proof of subjective intent. The available records do not establish broader limits on the statutory test. Any such conclusion would require the signed order and consideration of the authorities it relies on.

How to confirm the operative order
- Search the GST Appellate Tribunal’s official website using the case number and party names. The site provides order or judgment and case-status functions.
- Compare the signed order’s case number, caption, decision date, demand amount and refund direction with both published accounts.
- Use the signed order to verify the precise findings, quotation and listed penalty components before relying on them in a filing or legal analysis.
The Tribunal is constituted under Section 109 of the Central GST Act to hear appeals against orders by appellate or revisional authorities under Sections 107 or 108 and corresponding State GST laws. The reproduced order identifies this appeal as one under Section 112.
