Neither option is automatically better. A small contractor should first confirm that the business is eligible for composition, then compare the input GST it can legally claim under the regular scheme with the tax, pricing, customer-invoice, and compliance effects of composition. The word “contractor” alone does not establish eligibility.
First, check whether the contractor can choose composition
Under the CGST Act, a works contract is treated as a supply of services, but the statutory definition covers specified contracts involving immovable property and transfer of property in goods. Confirm that the work and contract actually fit that definition; not every business described as a contractor does.
Composition eligibility also depends on the applicable route, aggregate turnover, supplies, registrations, and other statutory conditions. The CGST Act provides a separate composition option for certain eligible suppliers of services under section 10(2A), with a ₹50 lakh preceding-financial-year aggregate-turnover ceiling and additional conditions. Being “small” in everyday terms is not enough.
CBIC’s 2019 explanatory update described that service-provider option at 6% (3% CGST plus 3% SGST), available from 1 April 2019. That dated explanation is not a substitute for checking the current operative notification and the contractor’s circumstances; rates and eligibility should be verified against current law before choosing.

How to compare the real financial effect
- Establish eligibility. Identify the actual supply and contract classification, the applicable composition route, aggregate turnover, other supplies and registrations, and any other conditions. Do this before comparing tax rates.
- Calculate eligible input GST, not total GST paid. List materials, subcontractors, equipment, rent, professional services, and other costs. For each, separate credit that is legally available from blocked or restricted credit. In particular, check the works-contract and immovable-property restrictions rather than assuming every construction-related purchase generates ITC.
- Map customers and the invoice they need. Business customers that can use eligible ITC may place value on a regular tax invoice. Customers unable to use ITC may assess the options differently, but composition tax still does not become customer ITC.
- Compare the actual tax and price effects. For regular taxation, use the rate that applies to the specific service, contract, and notification conditions, and account for recoverable input credits. For composition, account for the applicable composition tax and GST on inputs that cannot be credited. Do not compare only headline percentages.
- Include administration and any transition. Compare the records and filings needed under each option, and account for the statutory stock-credit adjustments that apply when moving between schemes.
When each option may make sense
Regular taxation may be more attractive when
- The contractor has substantial input GST that is eligible for credit after applying statutory restrictions.
- Important business customers can use eligible ITC and value receiving a regular tax invoice.
- The applicable output-tax treatment and recoverable credits compare favorably with the composition alternative for the contractor’s actual work and pricing.
Composition may be worth considering when
- The contractor clearly meets the applicable statutory conditions.
- Eligible input credit would be modest, so losing ITC has a limited effect on costs.
- The customer and pricing mix can accommodate a bill of supply and the absence of customer ITC on composition tax.
- The contractor values its distinct, potentially simpler reporting treatment after weighing the loss of ITC and the other compliance requirements.
These are decision signals derived from the schemes’ mechanics, not legal tests or personalized tax advice. The contractor’s particular contract, inputs, customer base, turnover, and current notifications determine the result.
