Online sellers have their own GST obligations even when a marketplace handles checkout or settlement. First establish whether your exact arrangement requires registration; then issue and track invoices, reconcile orders and returns against marketplace statements, report applicable outward supplies in GSTR-1, and preserve the supporting records. Marketplace TCS under section 52 is separate from your output tax, while certain notified services may be taxed by the operator under section 9(5).

This is a general guide for Indian sellers, not a registration or tax determination. GST treatment can depend on what you sell, where you supply it, turnover, registration status, current notifications, and the platform arrangement.

Start with your products, locations, and marketplace arrangement

Before deciding how to register or report a sale, establish the facts that determine its GST treatment:

  • Whether you sell goods, services, or both, and how each supply is classified.
  • Where your supplies are made and whether any are inter-State.
  • Your turnover, existing GST registration, and the states relevant to your business.
  • Whether the marketplace owns, operates, or manages a digital facility for electronic commerce, collects customer consideration, or only provides another service.
  • Whether a transaction is a notified service for which the operator pays tax under section 9(5).

CBIC defines an e-commerce operator by its role in owning, operating, or managing a digital or electronic facility or platform for electronic commerce. The marketplace’s role matters, but it does not make every online sale subject to the same registration and reporting rules. See CBIC’s e-commerce definitions and sectoral FAQs.

Do you need GST registration to sell on a marketplace?

Do not assume either that every marketplace seller must register or that a small seller is automatically exempt. CBIC’s e-commerce FAQ says the ordinary threshold exemption does not apply to persons supplying goods through an operator required to collect TCS under section 52. It also describes an exemption for certain service suppliers below specified turnover thresholds, excluding services covered by section 9(5). Those statements reflect the statutory framework addressed by the FAQ; thresholds, notifications, and other rules may have changed or may apply differently to your facts.

Check current CGST provisions and notifications for your supply type, turnover, state, and platform model before relying on an exemption. Where the facts are unclear—especially for mixed goods and services, multiple states, or section 9(5) transactions—get advice based on the actual arrangement. The relevant CBIC e-commerce FAQ is a starting point, not an individualized determination.

Know who issues invoices, collects TCS, and pays tax

Three roles are easy to confuse. The seller’s own tax and outward-supply reporting do not become the marketplace’s responsibility merely because it handles the order. Section 52 TCS is a collection mechanism applied by a qualifying operator to the net value of relevant taxable supplies; it is not the seller’s output tax. For specified notified services under section 9(5), the operator may instead be liable to pay GST on the service. Confirm which rule applies to each type of transaction.

Situation Primary role What the seller should do
Seller makes a taxable supply through an operator required to collect section 52 TCS The seller remains responsible for its applicable supply and reporting obligations; the operator collects and reports TCS as prescribed. Report the supply as applicable, reconcile the operator’s statement, and account for eligible TCS credit through the prescribed process.
Supply is a notified service covered by section 9(5) The e-commerce operator pays tax on the specified service under that provision. Identify the transaction correctly and follow the reporting treatment applicable to it; do not treat it as an ordinary section 52 TCS sale.

CBIC explains the operator’s section 52 role, including the treatment of returns and supplier credit, in its e-commerce FAQs. The applicable transaction and current law determine the exact treatment.

Issue controlled invoices and link adjustments to them

Use the applicable GST invoice rule for the full list of required particulars and any exceptions. The cited CBIC rules identify core details including supplier and recipient information, HSN or SAC, description, quantity and unit for goods, and place-of-supply information for inter-State trade. Requirements vary by transaction, so this list is not a ready-to-use invoice template. Consult the CBIC CGST Rules for the applicable rule.

Control invoice numbering

Maintain an intentional invoice series for each GSTIN and financial year. GST Portal guidance says duplicate invoice series for one GSTIN in a financial year are not accepted, although multiple series are permitted. Uploaded invoice details can be edited until the return is filed, according to the portal guide. See the GST Portal GSTR-1 guidance.

Document credits, debits, and returns

Keep credit and debit notes connected to the original invoice or transaction they adjust. Record the underlying return, refund, cancellation, or other adjustment in a way that lets you trace it from the order through the note and the relevant return entry. GSTR-1 includes credit and debit note reporting; the correct treatment depends on the facts and applicable rules.

Reconcile marketplace sales, returns, and section 52 TCS

Compare order-level activity with your invoices, return and refund records, marketplace settlement statements, and the operator’s reported tax data. Do not treat a settlement total as a substitute for the seller’s own transaction records: settlement amounts may include adjustments that are not the same as taxable outward-supply values.

  1. Match orders to invoices. Identify the supply, invoice, customer or reporting category, tax treatment, and supply period for each transaction.
  2. Match returns and adjustments. Connect returned orders, cancellations, refunds, and credit or debit notes to the original sale and the period in which the adjustment is reported.
  3. Reconcile the operator’s statement. Compare the operator’s supply and TCS figures with your order and return records, and investigate differences rather than accepting them automatically.
  4. Track TCS credit separately. CBIC describes the supplier’s TCS amount as reflected for credit based on the operator’s statement and available through the prescribed process. Keep this distinct from your invoice-level outward tax reporting.

CBIC states that an operator collects TCS on the net value of qualifying taxable supplies and that the value of returned supplies reduces that aggregate net value. Its FAQ also describes collection when the operator collects consideration, remittance within ten days after month-end, and a monthly GSTR-8 statement. Because that explanation is rooted in an older statutory framework, verify current statutory text and portal instructions before relying on those timing details. Prepare GSTR-1 using the route that fits your workflow

GSTR-1 is the outward-supply information return. GST Portal guidance lists three preparation routes: online entry on the portal, the GST Returns Offline Tool, or third-party applications through GST Suvidha Providers (GSPs). The official guidance confirms the routes but does not rank them; choose based on your record volume, integration needs, review controls, and ability to validate entries.

The portal guide lists reporting that can include B2B invoice details; specified B2C and inter-State summaries; credit and debit notes; exports; advances and adjustments; nil, exempt, and non-GST supplies; HSN/SAC summaries; and applicable e-commerce supplies. Which sections apply depends on your registration and transactions. E-commerce details are declared with the GSTIN, and the guide describes tables for section 52 and section 9(5) supplies. Check the live return and current instructions for the period you are filing.

Review the return before filing

  • Check invoice identifiers, dates, taxable values, tax amounts, and recipient details against your source records.
  • Confirm that credit and debit notes and return-related adjustments are linked to the correct transactions.
  • Compare applicable marketplace supply details with your reconciliation, while keeping section 52 TCS distinct from output tax.
  • Review the HSN/SAC summary and the applicable B2B, B2C, export, advance, and exempt-supply sections.
  • Resolve errors and mismatches before filing; GST Portal guidance says uploaded invoice details remain editable until filing.

The GST Portal states that from May 2025, the HSN-wise summary of outward supplies is furnished separately for B2B and B2C. Portal forms and instructions can change, so verify the live GSTR-1 guidance for the relevant filing period rather than relying on an old screen sequence.

Keep records that support each reported figure

CBIC’s rules call for accounts covering tax payable, tax collected and paid, input tax, and credit claimed, along with registers for tax invoices, credit and debit notes, and delivery challans. They also address an audit trail and links to source documents, whether paper or electronic. A physical sales register is optional organization, not a substitute for primary records or electronic portal filings. See the CBIC CGST Rules.

A practical record set can include:

  • Sales invoices, credit and debit notes, and delivery challans.
  • Purchase invoices and other documents supporting input-tax credit.
  • Marketplace settlement statements and relevant operator tax data.
  • Order, return, cancellation, and refund support.
  • Reconciliation workings that connect source transactions to return figures and tax records.

Organize documents so a reported amount can be traced back to its source, whether the source is a paper document or an electronic record. Keep the records in a usable, retrievable form in line with the applicable rules.
