There are documented wrongful arrests associated with police facial recognition technology (FRT), but no reliable national count or rate. A 2024 National Academies review identified at least six high-profile wrongful arrests of Black people linked to FRT—not a complete tally—and said comprehensive data on how often police use the technology or how often it contributes to arrests and convictions do not exist. The evidence supports serious concerns about documented cases and weak measurement; it does not establish that every AI surveillance system causes wrongful arrests.
How many people have been wrongfully arrested because of facial recognition?
No complete total is known. In its 2024 report, Facial Recognition Technology: Current Capabilities, Future Prospects, and Governance, the National Academies of Sciences, Engineering, and Medicine reported at least six high-profile wrongful arrests of Black individuals associated with FRT. The report treats these as known cases, not a national count, a prevalence estimate, or a measure of the technology’s error rate.
The committee explained that inadequate data on law-enforcement use makes it difficult to put even the known cases in a broader context. It found no comprehensive data on FRT’s prevalence, its role in arrests and convictions, or the total number of wrongful arrests. Without consistent records of searches, matches, arrests, and later findings that an arrest was erroneous, there is no sound denominator for calculating a national wrongful-arrest rate.
That gap matters in both directions: the known cases establish that serious harm has occurred, but they cannot show how often it occurs. Nor should “false positive” be used as a synonym for wrongful arrest. A false positive in a technical test or matching process is not automatically an arrest, and an arrest later found to be mistaken does not, by itself, identify which part of the process failed.

What facial recognition does—and what it does not establish
In a typical investigative search, a system compares an image of an unknown person, called a probe, with reference images in a gallery. It may return one or more candidate images or a similarity result. That output can help investigators generate a lead, but it is not proof that the person in the probe is the person in a candidate image.
The underlying comparison is only one part of a chain of decisions. Image quality, the reference gallery, search settings, how a result is reviewed, investigators’ training, and the steps taken to corroborate a candidate can all affect what happens next. The National Academies’ review of known cases identified overconfidence in matches, low-quality probe or gallery photographs, weak procedures, inadequate training, and deficient investigative practice as contributing factors.
It is therefore misleading to say an algorithm independently “arrested” someone. Officers and agencies make operational decisions; their procedures determine whether a candidate is treated as a tentative lead or as conclusive identity evidence. The risk is greatest when a match substitutes for ordinary investigation and independent corroboration.

Why different facial-recognition deployments should not be lumped together
“Facial recognition” can refer to different uses with different inputs and consequences. An after-the-fact search of a crime-scene image is not the same as a camera scanning passersby against a watchlist. Arrest figures from these systems, jurisdictions, and periods are not directly comparable.

The UK Government’s 2025 facial-recognition factsheet reported over 1,300 arrests following London live facial-recognition deployments between January 2024 and September 2025. That is an arrest count reported by the government, not a wrongful-arrest count, an accuracy measure, or a comparison with retrospective searches. The factsheet also describes other outcomes, including safeguarding and locating people wanted for serious offences; those government-reported outcomes do not independently establish accuracy or erase documented wrongful-arrest cases.
The same distinction applies to reporting about a particular police force. In a May 2024 response to an information request, the Metropolitan Police said it held no information on people “wrongly arrested” after a live match since January 1, 2023. It separately said that some arrests were followed by prompt de-arrest when the arrest threshold was no longer met, while maintaining that the original decisions were justified at the time. This is the force’s stated position about live facial recognition within its defined scope; it is not a national finding and does not cover retrospective searches.

Can police arrest someone based on a facial-recognition match?
The answer depends on the jurisdiction and the facts of the case. The National Academies makes a governance recommendation, not a universal statement of law: FRT should be only part of a multifactor basis for an arrest or investigation, consistent with fact-sensitive determinations of probable cause and reasonable suspicion. A match alone should not be presented as proof of identity or treated as a substitute for corroborating evidence.
For any particular arrest, relevant questions include what the system actually returned, what image and gallery were used, who reviewed the result, what independent evidence supported the identification, and what legal standard applied. The National Academies also recommends that the role of FRT be disclosed to suspects, defense counsel, and judges in a timely way.
What safeguards would make errors more visible and less likely?
The National Academies recommended safeguards that address both individual decisions and the absence of reliable public information. These are recommendations, not rules shown to be adopted everywhere.

- Use multiple factors. Treat FRT as one element in the basis for an investigation or arrest, not as conclusive identification.
- Disclose its role. Provide timely information to suspects, counsel, and judges when facial recognition contributed to a case.
- Publish de-identified outcomes. Report positive matches, false positives, and non-matches, and cumulatively report arrests later found to be erroneous.
- Audit independently. Periodically assess technical performance as well as the skills of the people who use and review the systems.
For these safeguards to support meaningful oversight, reporting definitions must distinguish a search, a candidate match, a confirmed identification, an arrest, and an arrest later found erroneous. Those are different events. Publishing only deployment or arrest totals cannot answer how often a system misidentified someone or how often an erroneous match contributed to an arrest.

U.S. Government Accountability Office reviews point to oversight concerns but have limited scopes. Its 2024 review examined facial-recognition use by selected federal law-enforcement agencies, including civil-rights and training issues. It noted DHS and DOJ policy developments that GAO had not independently reviewed; the existence of a policy development is not the same as an independently verified result.
A separate 2025 GAO report on DHS detection, observation, and monitoring technologies found that agency policies did not address all bias risks and did not always cover key privacy protections. Recommendations related to that review remained open on the GAO page reviewed for the report. These findings concern selected agencies and technologies, not every police department, every federal program, or every AI surveillance system.

What a meaningful comparison of systems would need to include
Headline totals do not tell readers whether one deployment is safer or more reliable than another. A useful comparison would need to identify the deployment model and examine the process around the algorithm, including:
- whether the system performs retrospective searches or live watchlist matching;
- the source image quality and the conditions in which images were captured;
- whether the tool returns ranked candidates or alerts, and what threshold is used;
- whether a trained human examiner reviews the result;
- what independent corroboration is required before a stop, warrant request, or arrest;
- whether the system’s role is disclosed to defendants; and
- whether public reports distinguish searches, false positives, non-matches, arrests, and arrests later found erroneous.
Without comparable definitions and outcome data, a high number of arrests cannot establish a low error rate, and a small number of documented wrongful arrests cannot establish that the total harm is small. The evidence supports scrutiny of how facial-recognition results are used, alongside better data capable of measuring outcomes.
