Yes—EU law requires employers to use a system that can measure each worker’s daily working time. The Court of Justice of the European Union (CJEU) set out that requirement in its 14 May 2019 judgment in CCOO v Deutsche Bank SAE, Case C-55/18. The ruling does not require a particular time clock, app, or software. Member States determine the details, so employers must check the rules that apply in their country.
Is time tracking mandatory in the EU?
At EU level, the CJEU held that Member States must require employers to establish an objective, reliable, and accessible system enabling the duration of time worked each day by each worker to be measured. The ruling came in a case referred from Spain and interprets working-time protections under EU law. Read the CJEU judgment.
The decision concerns Articles 3, 5, and 6 of the Working Time Directive (Directive 2003/88/EC), read in light of Article 31(2) of the EU Charter of Fundamental Rights, and provisions of Directive 89/391/EEC. The Court reasoned that measuring working time helps make rights to daily and weekly rest and limits on maximum weekly working time effective. Without reliable records, it is harder to establish whether those protections are being observed or for authorities to supervise compliance.
Does EU law require a time clock or a specific app?
No. The judgment does not prescribe a product or format. It leaves Member States to set the detailed arrangements, including the system’s form, taking account where appropriate of the characteristics of particular sectors and undertakings. A physical clock, digital tool, or another method may be used if it meets the applicable national rules and the system can measure daily working time objectively, reliably, and accessibly.

The CJEU did not endorse vendors or compare recording methods. Employers choosing a method can assess whether it produces dependable records that can be accessed for the relevant purpose, then verify that it satisfies their country’s requirements.
What does the CJEU C-55/18 ruling mean for employers?
The ruling establishes an EU-level principle, not a complete compliance checklist. It does not settle every national question, such as which workers are covered, how long records must be kept, who may access them, what exceptions apply, or what penalties follow. Those details depend on the relevant Member State’s current law and guidance.

Before selecting or changing a time-recording process, employers should check the legislation and official labor-authority guidance for the country where the workers are employed. In particular, confirm the system’s scope, retention and access rules, any applicable exceptions, and enforcement provisions.

The judgment refers to Article 17(1) of Directive 2003/88/EC, which allows derogations for certain activities where working time is not measured or predetermined, or can be determined by the workers themselves, subject to the directive’s conditions and principles protecting workers’ safety and health. That reference is not a blanket exemption for a job, sector, or worker category. Whether a derogation applies must be checked against the relevant national law and the particular facts.
