Neither label tells you which delivery-work option is better—or settles your legal status. Compare the actual work terms, expenses, tax responsibilities and protections that apply where you work. For legal classification, federal wage law and federal tax law use separate tests, and state or local rules may also matter.
What the employee or contractor label does—and doesn’t—tell you
A job title, contract clause or Form 1099 does not by itself establish that a delivery worker is an independent contractor under the Fair Labor Standards Act (FLSA). The U.S. Department of Labor (DOL) says the FLSA question is based on the economic reality of the working relationship: whether the worker is economically dependent on the potential employer or is in business for themself. The relationship as a whole matters; no single factor automatically decides the result.
That classification question is different from deciding which arrangement suits your budget, schedule or preferences. An option can appear flexible but still leave you with substantial costs or administrative work. Conversely, a worker’s preferred label does not determine how the law applies. The actual practices and the law governing the particular issue matter.
How the federal wage-law and tax tests differ
The DOL’s FLSA analysis and the IRS’s federal tax analysis are separate. A conclusion under one does not automatically settle the other.

The DOL rulemaking page reported that, on February 26, 2026, the department proposed rescinding the 2024 rule and replacing its guidance. That is a proposal, not a final rule in the materials described here. Rulemaking can change, so check the DOL’s current rulemaking information and guidance before relying on the status of that proposal.
Apply the questions to the delivery work itself
Use the following questions to understand both the arrangement and the facts that may matter to classification. A delivery app or employer’s contract is only part of the picture; consider how work is actually assigned and performed.

- Control and schedule: Who sets routes, delivery methods, pay or prices, performance requirements and the schedule? Can you genuinely accept or decline jobs in practice, and what happens when you do?
- Business opportunity: Can you make meaningful management decisions that increase profit or create a risk of loss beyond earning more by completing more deliveries? Consider whether you can influence costs, pricing, customers or how the work is organized.
- Investment and expenses: Who provides and pays for the vehicle, fuel, equipment, insurance and maintenance? Are any costs reimbursed? Compare what you invest with the hiring entity’s investment rather than looking only at who owns the vehicle.
- Relationship and work: Is the work ongoing or intermittent? How central is delivery to the potential employer’s business? What skill and initiative does the work require?
- Practical terms: What do the current written terms say about pay, work availability, expenses, scheduling, benefits and eligibility—and how do those terms compare with what happens day to day?
These are evidence to consider, not a do-it-yourself scorecard: the DOL says the factors are weighed in the context of the whole relationship, and the IRS has a different framework for tax purposes.
Compare the money, time and administration
Do not compare only the advertised pay rate. Build a realistic estimate using the specific offer and your expected work pattern. Without the location, written pay terms, hours, mileage, costs and tax assumptions, there is no sound basis for declaring one arrangement more profitable.

- Write down the pay terms. Record how pay is calculated, when it is paid, whether rates or incentives can change, and whether any time spent waiting, traveling between jobs or handling work-related tasks is paid. Do not assume a particular treatment without checking the offer and applicable law.
- Estimate work-related costs. Include the vehicle, fuel, maintenance, insurance, equipment and any other costs you would bear. Note which expenses, if any, are reimbursed and what conditions apply.
- Account for unpaid time and flexibility. Estimate the time required to be available, travel, wait and complete deliveries, not just time on an active delivery. Consider whether the schedule you want is actually available under the arrangement.
- Plan for tax administration. Employee pay usually has employer withholding. Self-employed workers generally need to plan for income tax payments and may owe self-employment tax; the exact result depends on the worker’s circumstances and tax year. Check current-year IRS forms and guidance rather than relying on a generic estimate.
- Compare protections and benefits for your location. Check which wage, leave, insurance, benefits, expense-reimbursement and classification rules apply to this work where you will perform it. Federal guidance alone does not establish every right or benefit available in a particular state or locality.
For gig income, the IRS says income is generally taxable even if you do not receive a Form 1099, W-2 or other income statement. Business expenses may be deductible subject to tax rules and limits. Keep adequate records of income and expenses; a mileage log or other recordkeeping method can be one part of that process, but no particular format is endorsed here.
Check current rulemaking and local terms before deciding
The DOL’s materials describe the February 26, 2026 action as a proposal to replace the 2024 guidance. Because that status can change, consult the DOL’s latest rulemaking information when making a classification decision. The federal materials do not establish the rules for every state or locality, and the available information here does not establish current openings, pay, schedules, benefits or eligibility for any delivery employer in your market. Compare the current written terms of the specific options and check the law where you will work.

What a delivery-worker determination can show
An IRS public determination concerning one food-delivery worker found employee status for the particular relationship it examined, while considering facts that pointed in different directions. It illustrates why the details matter; it is not a general ruling about all food-delivery companies or app-based delivery work.
The federal sources discussed here do not establish that delivery workers as a class are employees or contractors. A reliable answer for a particular job depends on its actual facts, the legal test being applied and the potentially relevant state or local law.
