Marketing email automation sends promotional or educational messages based on a campaign schedule, audience segment, or recipient behavior. A transactional email is sent because of a specific transaction, service, or account event, such as an order receipt or password reset. Automation describes how a message is sent; transactional describes why it is sent. An automated message is not automatically transactional.

How the two types of email differ

The most useful distinction is purpose and context, not the email platform or whether a message is triggered automatically. Marketing automation can send scheduled newsletters, behavior-based product sequences, and re-engagement campaigns. Transactional email responds to an event tied to a particular recipient, such as a purchase or account change.

This is a practical comparison, not a complete legal test. The Twilio comparison also describes the distinction in terms of campaign-driven marketing and event-driven transactional messages.

Is an automated email transactional?

Not necessarily. A welcome series that promotes products, an abandoned-cart reminder, or a renewal offer may be triggered by an individual action, but its purpose can still be promotional. Conversely, a password reset can be sent through software that also runs marketing campaigns and remain transactional in purpose. How U.S. CAN-SPAM treats transactional or relationship email

In the United States, CAN-SPAM recognizes a limited transactional-or-relationship category. The FTC describes messages whose primary purpose is to facilitate, complete, or confirm a transaction the recipient agreed to; provide certain warranty, recall, safety, or security information; notify a recipient about changes to an ongoing account or subscription; provide certain account statements; convey employment-related information; or deliver goods or services agreed to in a transaction. An existing customer relationship by itself does not make every message transactional.

Mixed-content messages require particular care. The FTC says that if a message’s subject line would lead the recipient to think it is commercial, it is commercial for CAN-SPAM purposes. A receipt or account notice that includes a promotion should not be treated as categorically transactional just because it also contains necessary service information. The message’s primary purpose and content matter. This is U.S. guidance and should not be assumed to describe the rules in every country. The FTC’s CAN-SPAM rulemaking document provides the related regulatory definitions.

Unsubscribe and consent depend on the rules that apply

For Gmail subscription messages, Google recommends confirming that recipients control their addresses, implementing one-click unsubscribe, processing opt-outs within 48 hours, and using different email addresses for subscription and non-subscription traffic. Google’s FAQ says one-click unsubscribe applies to marketing and promotional messages, while examples such as password resets and reservation confirmations are excluded. These are Gmail sender requirements and guidance, not substitutes for legal advice or the laws that apply to a sender and recipient.

In the European Union, the European Commission’s GDPR guidance says a person must be able to withdraw consent as easily as they gave it, giving a visible newsletter unsubscribe link as an example. Email marketing can also be subject to ePrivacy rules and national implementation; this guidance alone is not a complete cross-border legal analysis. Authentication and sending setup are separate from classification

Sender authentication helps meet inbox-provider requirements, but it does not decide whether an email is marketing or transactional, establish consent, or guarantee inbox placement. Google’s current guidance says senders to personal Gmail accounts need SPF or DKIM authentication. For senders exceeding 5,000 messages per day to Gmail accounts, Google lists SPF, DKIM, DMARC, domain alignment, and one-click unsubscribe for marketing and subscribed messages. The threshold and requirements are specific to Gmail destinations; consult Google’s sender guidelines and FAQ when configuring a production sender. The FAQ says Google has been ramping up enforcement of non-compliant traffic since November 2025.

Setup details also vary by service. Mailchimp Transactional’s documentation describes domain verification and DKIM and DMARC setup for its service. HubSpot’s authentication guide covers connecting an email-sending domain and configuring DNS authentication. Those instructions apply to the named services, not to every email platform.

Should marketing and transactional email use separate addresses?

Google recommends different email addresses for subscription and non-subscription messages. This helps distinguish the two traffic types operationally. It does not change a message’s purpose or legal category: a promotional campaign does not become transactional because it comes from a service-notice address. Follow the current rules of your email provider and the sending platform you use.
