The federal TAKE IT DOWN Act is no longer just a proposed law: it was signed on May 19, 2025. It makes certain knowing, nonconsensual publications of intimate images—including qualifying AI-generated or altered depictions—illegal, and requires covered platforms to offer a removal process. It does not make every AI-generated sexual image illegal, and whether a specific image or publication violates the law depends on the facts.
What the TAKE IT DOWN Act prohibits
The Act, enacted as Public Law 119-12, addresses both authentic intimate images shared without consent and certain fabricated depictions called “digital forgeries.” Its criminal provision targets a person who knowingly publishes a qualifying depiction online without the depicted person’s consent. The White House summarized the law as providing for a criminal prohibition on intentional disclosure of nonconsensual intimate visual depictions and requiring covered platforms to remove them: White House announcement, May 19, 2025.
When an AI-generated image can qualify
A digital forgery is an intimate visual depiction of an identifiable person created or altered using software, machine learning, AI, or other technology. It must be indistinguishable from an authentic depiction to a reasonable person viewing it as a whole. A person may be identifiable by their face, likeness, or another distinguishing characteristic shown in connection with the image.
For an adult digital forgery, the law’s criminal prohibition also requires that the depicted matter was not voluntarily exposed by the person in a public or commercial setting, that it is not a matter of public concern, and that the publisher intended to cause harm or caused harm. The statute applies a different intent standard to depictions of minors. It also provides exceptions for certain good-faith disclosures, including for legal, medical, educational, reporting, or assistance purposes. What platforms must do when someone reports an image
The Act’s platform-removal duties are separate from its criminal prohibition on a person’s publication. Covered platforms must provide a way to submit removal requests. A valid request must identify the depiction and where it appears, include a good-faith statement that it was shared without consent, and provide contact information.
After receiving a valid request, a covered platform must remove the depiction as soon as possible and no later than 48 hours afterward. It must also make reasonable efforts to remove known identical copies. The requirement does not guarantee deletion from every website or removal of every copy: it applies to covered platforms, and the duty regarding copies is limited to reasonable efforts concerning copies the platform knows about. The statute sets out the platform definition and exclusions in the law’s text.

How the FTC is enforcing the law
The one-year deadline for covered platforms to establish their process and comply with the removal requirements was May 19, 2026. The Federal Trade Commission says it began enforcing the platform provisions after that deadline. A victim or survivor can use the FTC’s TAKE IT DOWN Act guidance and complaint information to report a covered platform that has not created the required process or has failed to respond to a valid request.

Fabricated sexually explicit images depicting Taylor Swift circulated widely online in January 2024, before the TAKE IT DOWN Act was enacted. The statute does not name Swift and was not written solely in response to her case; it establishes general federal rules for qualifying nonconsensual intimate depictions.

The Associated Press reported at the time that researchers found “at least a couple dozen unique AI-generated images.” That figure describes what was reported about the January 2024 incident, not a current estimate of how many such images exist or circulate. The episode helps explain the public concern behind efforts to address nonconsensual deepfakes, but it does not determine whether any particular image or publication meets the Act’s legal requirements.
