A “crypto trust bank” is usually shorthand for a national trust bank chartered by the Office of the Comptroller of the Currency (OCC), not a separate nationwide charter category. A state-chartered trust company gets its authority from a particular state’s law and regulator. Neither label alone tells you whether an institution may take deposits, has FDIC insurance, or is approved for a specific crypto service.
What do the two charter types mean?
A national trust bank is a national bank chartered by the OCC under the National Bank Act, including 12 U.S.C. § 27(a), with operations limited to trust-company operations and related activities. “Crypto trust bank” is a descriptive phrase for some such institutions, often those focused on digital-asset custody; the exact charter and legal entity matter more than the shorthand.
A state-chartered trust company is formed under a state’s banking law and overseen by that state’s banking regulator or equivalent authority. Its powers and restrictions depend on the state statute, its charter documents, and any regulator-imposed conditions. New York is a useful example, but its rules should not be treated as a nationwide template.
How do their authority and activities compare?

Does a trust-bank charter mean the institution only does fiduciary work?
No. The OCC’s January 11, 2021 Interpretive Letter 1176 explains that a national bank chartered under § 27(a) may conduct permissible trust-company operations and related activities, including non-fiduciary functions such as custody. The distinction matters because “trust” in the charter name does not make every service fiduciary activity.

Fiduciary status is a separate legal question. For national banks, 12 U.S.C. § 92a and 12 C.F.R. Part 9 govern activities performed in a fiduciary capacity. A trust bank may also provide non-fiduciary custody or other related services if those activities are permissible under its charter and applicable requirements.
On April 1, 2026, the OCC’s final rule clarified the wording of its chartering regulation concerning trust-company operations and related activities. OCC Bulletin 2026-4 said the rule clarifies longstanding authority for national trust banks to conduct non-fiduciary activities as well as fiduciary ones, and “would neither expand nor contract the OCC’s authority to charter a national bank.” The rule is not blanket permission for any service: the institution still must comply with its charter, relevant law, supervisory requirements, and any conditions attached to its approval.

What does New York’s state-chartered trust-company example show?
New York DFS charters and regulates banks and trust companies under Article III of the New York Banking Law. DFS describes a trust company as an entity authorized by the Superintendent to exercise fiduciary powers. For a limited-purpose trust company, the stated basic restriction is that it cannot take deposits or make loans except where they arise directly from fiduciary powers.
That restriction is specific to the New York limited-purpose framework; it should not be generalized to trust companies in other states. In New York, the organization certificate sets out the scope of services and limitations, and a limited-purpose trust company may not materially change its products, services, or activities without prior Superintendent approval. The charter name therefore cannot substitute for reviewing the certificate, approval order, and regulator records.

New York Banking Law § 100 provides examples of fiduciary powers, including acting as a fiscal or transfer agent and serving as trustee under specified instruments, subject to statutory limits. The state statute and the particular company’s charter terms determine what those powers mean in practice.
Can either charter holder custody crypto?
Federal and state charter pathways can support crypto custody, but the permissions are not interchangeable or automatic. In July 2020, the OCC stated that national banks and federal savings associations may provide cryptocurrency custody, including holding the associated unique cryptographic keys. That statement addresses custody; it does not by itself authorize an institution to operate an exchange, trade crypto, provide payments, or issue stablecoins.

In November 2021, the OCC said certain crypto, distributed-ledger, and stablecoin activities discussed in earlier interpretive letters could be conducted after the bank notified its supervisory office and received written non-objection. The OCC also retained discretion to determine whether an activity qualifies as fiduciary under federal law. That dated process should not be treated as a timeless, universal approval rule: the applicable requirements depend on the particular activity and current supervisory guidance.
In New York, DFS says a firm may conduct virtual-currency business activity through a New York Banking Law charter, including a limited-purpose trust company or state bank, only with Superintendent approval. DFS distinguishes that approval pathway from the BitLicense framework. A state banking charter alone is therefore not proof that the company has approval for every virtual-currency activity it offers or proposes.

How should you read a crypto trust-bank approval or application?
Regulatory status is time-sensitive, and an application or conditional approval is not proof that the institution has begun operating all proposed services. The OCC’s “Digital Assets Licensing Applications” page describes its list as pending applications. As of the page reviewed on October 7, 2026, it included 2026-dated applicants such as zerohash National Trust Bank, Dakota National Trust Bank, Payward National Trust Company, and EDX Trust. A listing establishes the page’s stated application status, not final approval or operational status.
For example, the OCC issued a conditional approval for Ripple National Trust Bank on December 12, 2025. The letter described proposed cryptocurrency custody and collateral trustee services and identified Standard Custody & Trust Company, LLC as a New York limited-purpose trust charter regulated by NYDFS. The letter is evidence of that case’s conditional approval and proposed activities; it should not be read as proof that every condition was satisfied, that business commenced, or that every proposed service is currently operating.
The same OCC letter reported that OCC-supervised uninsured national trust banks had $6.8 trillion in assets under administration as of September 30, 2025, including $1.6 trillion in custody and safekeeping accounts and $5.2 trillion in fiduciary accounts. These are OCC-reported aggregate figures for those banks, not crypto-only totals.

What should you check before relying on a trust-company label?
- Identify the legal entity and regulator. Confirm whether the institution is federally chartered by the OCC or chartered under a particular state’s law.
- Read the charter and approval conditions. Look for authorized products and services, restrictions, and requirements for material changes.
- Separate the activities. Fiduciary custody, non-fiduciary safekeeping, exchange or trading, payments, and stablecoin issuance are different services and may have different requirements.
- Verify deposits, lending, and insurance separately. A trust charter does not establish that deposits are accepted, loans are permitted, or customer funds are FDIC insured.
- Check current regulator records. Applications, conditional approvals, operating status, and activity permissions can change; use the relevant regulator’s latest records rather than relying on a company’s shorthand description.
