The Investigatory Powers Tribunal (IPT) rejected the Home Office’s bid to keep basic details of Apple’s case secret, ruling on 7 April 2025 that revealing those details would not damage the public interest or prejudice national security. The decision concerned secrecy and open justice—not whether a reported encryption notice existed, what it required, or whether it was lawful.

What did the tribunal decide?

The case, Apple Inc v Secretary of State for the Home Department, was before the IPT. The Home Office initially asked the tribunal to prevent public disclosure of the case’s existence or substance and the parties’ identities. The tribunal made a temporary order while it arranged a hearing on that request.

The Home Office then sought to prevent even the fact that a hearing had taken place on 14 March 2025 from appearing publicly. The tribunal refused that broader request and later dismissed the application to keep the case’s bare details secret. Its judgment said: “We do not accept that the revelation of the bare details of the case would be damaging to the public interest or prejudicial to national security.” Computer Weekly reported the quotation from the judgment on 7 April 2025.

Why is the ruling limited?

The tribunal weighed open justice against its statutory duty to protect information when disclosure could prejudice national security or other protected interests. Rejecting secrecy for the case’s basic details did not amount to a general rejection of confidentiality in IPT proceedings. It did not mean that evidence, pleadings, or every later hearing had to be public.

The judgment left open whether later hearings might include a public element, with or without reporting restrictions. It also did not resolve whether pleadings would be published or whether Liberty and Privacy International could intervene; the tribunal described those questions as premature while no defence had been filed.

Did the tribunal confirm the reported Apple encryption notice?

No. Media reports described a technical capability notice (TCN) requiring Apple to maintain access to user data in decrypted form. The tribunal recorded that reporting but expressly cautioned: “This judgment should not be taken as an indication that the media reporting is or is not accurate.” The 7 April 2025 decision therefore did not establish whether the reported notice existed or confirm its scope. The IPT’s judgment is the controlling source for that distinction.

Contemporaneous reporting connected the dispute to Apple’s Advanced Data Protection service, but that background does not change what the tribunal decided: the secrecy application, not the technical or legal merits of the alleged notice. Computer Weekly’s account provides that context.

September 2026: earlier challenge and a fresh complaint

On 11 September 2026, The Guardian reported that Apple’s earlier challenge was thrown out after the Home Office withdrew the original notice and issued a narrower one targeting British users’ data. The newspaper also reported that Apple lodged a fresh complaint in August 2026 challenging the government’s power to issue TCNs, with a case-management hearing listed for September.

September 2026: related civil-liberties case

On 17 September 2026, Liberty reported that the tribunal was considering how to manage two cases against the government: Apple’s complaint and a separate challenge brought by Liberty, Privacy International, and two individuals. Liberty’s descriptions of the notices and claims concern the organization’s separate case and should be read as its account. These reports describe case-management proceedings, not a final judgment on Apple’s newer complaint.
