Article II requires a natural-born U.S. citizen, at least 35 years old, and 14 years of U.S. residence. Applying those human-centered qualifications to an AI is a reading of the text, not the result of an AI-specific court ruling.
What the Constitution requires of a president
Article II, Section 1, Clause 5 says that no person is eligible for the presidency unless they are a natural-born U.S. citizen (with a narrow exception for citizens at the Constitution’s adoption), have reached age 35, and have been a U.S. resident for 14 years. USAGov summarizes the requirements as being a natural-born U.S. citizen, at least 35 years old, and a U.S. resident for 14 years. It also says a person who raises or spends more than $5,000 for a presidential campaign must register with the Federal Election Commission (FEC) and name a principal campaign committee. That is a campaign-finance obligation, not confirmation that a candidate is constitutionally eligible to take office. See USAGov’s requirements for presidential candidates.
The Twenty-Second Amendment separately limits how often a person may be elected President: no person may be elected more than twice, with a special rule for someone who served more than two years of another president’s term. That limit does not address AI eligibility; the central obstacle is Article II’s qualifications. Read the Twenty-Second Amendment.

AI as president versus a human president using AI
The key question is who would legally hold the office. If the proposed officeholder is the AI system, the Article II requirements do not plausibly fit a machine: an AI is not naturally a U.S. citizen, 35 years old, or a U.S. resident. The constitutional text does not explain how those terms would apply to an autonomous machine, and the official sources cited here do not establish an AI-specific ruling.
If a human candidate uses AI to draft speeches, advise on policy, or help run a campaign, the human—not the software—remains the proposed officeholder and must meet the same constitutional qualifications. The sources cited here do not define the legal boundaries of particular AI-assisted campaign practices, so this distinction should not be taken as a ruling on every way a campaign might use AI.

Can a candidate campaign without being eligible to serve?
Campaign activity and constitutional eligibility are distinct issues. In Advisory Opinion AO 2011-15, dated September 2, 2011, the FEC said that a naturalized citizen was not barred by the Federal Election Campaign Act from being a “candidate” under that law if the campaign-finance criteria were met—even though the individual acknowledged not meeting Article II’s natural-born-citizen requirement. The FEC also found the individual ineligible for presidential matching funds because he had acknowledged that constitutional ineligibility. Read FEC Advisory Opinion AO 2011-15.
That opinion concerned a human candidate. It does not decide whether an AI could register as a candidate, campaign, or be recognized as a candidate under election law. A campaign organized around an AI concept would not, by itself, make the AI constitutionally eligible to hold office.

Could the Constitution be changed to allow an AI president?
Yes, in principle: a constitutional amendment could change the eligibility rules. Article V provides two routes for proposing an amendment: approval by two-thirds of both houses of Congress, or a convention called by Congress after applications from two-thirds of state legislatures. Ratification then requires approval by three-fourths of state legislatures or conventions. The National Archives explains the Constitution and Article V.
Changing the listed qualifications would not, by itself, settle the practical questions of an AI presidency. Any such proposal would need to define what kind of AI or legal entity could hold office and address accountability for presidential acts, command authority, succession, and how voters could evaluate or remove the officeholder. Those are design and policy questions, not rules already established by the Constitution.

What remains legally unsettled
The constitutional text uses terms such as “Person,” “Citizen,” age, and residence, but the official materials cited here do not determine whether an AI could acquire legal personhood or citizenship, or how the age and residence qualifications would apply to a genuinely autonomous machine. No AI-specific judicial ruling is established here. The conclusion that an AI itself is not plausibly eligible follows from the current text; it should not be presented as a definitive court decision.
