No: May 2026 is not a confirmed effective date for CISA’s CIRCIA reporting rule. As of October 8, 2026, CISA says it is still working on the final rule, and the reviewed official sources do not establish that the rule has been published or when it will take effect. Organizations should not treat the proposed 72-hour and 24-hour reporting deadlines as current CIRCIA obligations.

When will CISA’s CIRCIA rule take effect?

There is no confirmed publication or effective date in the official sources reviewed as of October 8, 2026. CISA’s CIRCIA page says, “CISA continues to work on the final rule.” The page also says CISA will communicate rulemaking and timeline updates there.

The federal Reginfo entry for RIN 1670-AA04 lists the rule in the final-rule stage and shows a September 2026 timetable target. That is a planning entry, not evidence that the final rule was published. CISA’s current status statement remains that work on the rule is ongoing.

The May 2026 date is best understood as an earlier target that changed as rulemaking continued. A publication date and an effective date are also different: even after a final rule is published, its own effective-date provisions determine when its requirements begin. The reviewed sources do not confirm either date.

Do organizations have to report cyber incidents to CISA under CIRCIA now?

CISA says CIRCIA reporting requirements do not apply until the final rule takes effect. While the rule remains pending, CISA encourages entities to share incident information voluntarily. Its guidance states: “While covered cyber incident and ransomware payment reporting under CIRCIA will not be required until the CIRCIA final rule goes into effect, CISA encourages all entities to voluntarily share with CISA information on cyber incidents prior to the effective date of the final rule.”

This distinction is specifically about reporting obligations under CIRCIA. It does not determine whether an organization has separate reporting duties under another law, regulation, contract, or sector-specific rule.

What are the proposed 72-hour and 24-hour deadlines?

The statutory and proposed framework describes reporting covered cyber incidents within 72 hours and ransom payments within 24 hours. Those timelines are not currently operative CIRCIA final-rule obligations while the final rule is pending. Organizations should not treat them as an active deadline solely on the basis of the proposal.

The detailed scope of coverage is not final either. The February 2026 Federal Register notice identified proposed size-based and sector-based criteria among the topics for stakeholder feedback. Until the final rule is issued and takes effect, proposed coverage tests and thresholds should not be described as settled requirements.

Why has the rulemaking taken longer?

CISA says multiple funding lapses contributed to delays in its rulemaking activity. The agency published its notice of proposed rulemaking on April 4, 2024, with a comment period that ran through July 3, 2024. It held additional town halls in June 2026 to gather feedback.

A February 13, 2026 Federal Register notice recorded approximately 130 comments on an earlier request for information, about 730 listening-session attendees, and approximately 300 comments on the proposed rule. These figures describe participation in the rulemaking process, not incident frequency, compliance costs, or the impact of the delay. The notice is available at the Federal Register.

What should organizations do while the final rule is pending?

  • Check CISA’s CIRCIA page for status updates. CISA identifies it as the place where it will communicate rulemaking and timeline changes.
  • Do not rely on the May or September target as a confirmed date. Neither establishes publication or when requirements begin.
  • Keep proposed requirements distinct from active obligations. The 72-hour and 24-hour timelines and proposed coverage criteria are not final CIRCIA requirements in force while the rule is pending.
  • Consider CISA’s voluntary information-sharing invitation. CISA encourages entities to share cyber incident information before the final rule’s effective date.
  • Assess other applicable reporting duties separately. CIRCIA’s pending status does not resolve obligations imposed by other authorities or agreements.
