The Chief Election Commissioner (CEC) heads the Election Commission of India (ECI), the constitutional body that supervises electoral rolls and conducts elections to Parliament, state legislatures, and the offices of President and Vice-President. The CEC chairs the Commission when other Election Commissioners are appointed, but does not operate as an unchecked, one-person authority. Removal is deliberately difficult: the CEC can be removed only on the same grounds and through essentially the same parliamentary process used for removing a Supreme Court judge—proved misbehaviour or incapacity, followed by approval of both Houses of Parliament and a final presidential order.
What is the Chief Election Commissioner’s constitutional role?
The CEC is the chairperson of the Election Commission of India, which derives its core authority from Article 324 of the Constitution. Article 324(1) places the superintendence, direction and control of electoral-roll preparation and specified elections in the Commission. Those elections are for the Lok Sabha and Rajya Sabha, state legislative assemblies and councils, and the offices of President and Vice-President.
This makes the CEC the senior public face of India’s election administration, but the constitutional responsibility belongs to the ECI as an institution. The officeholder coordinates and chairs the Commission rather than replacing it with a personal command structure. The distinction matters whenever a decision is challenged: an order or policy is generally an act of the Commission under the constitutional and statutory framework, not an unrestricted personal veto exercised by the CEC.
What does the CEC do in practice?
The CEC’s work combines constitutional leadership, supervision of election operations and participation in collective decisions. The main responsibilities are:

- Lead electoral-roll administration. The ECI oversees preparation and revision of electoral rolls used for the elections within Article 324’s scope. This includes setting directions and ensuring that the roll process is administered under applicable election law.
- Supervise election conduct. The Commission plans and manages the stages of parliamentary, state-legislative, presidential and vice-presidential elections, including the exercise of powers assigned by the Constitution and statutes.
- Chair the Commission. When one or more Election Commissioners serve alongside the CEC, the CEC presides over Commission proceedings. The chairmanship gives the office institutional leadership, not a unilateral power to overrule the other Commissioners.
- Apply statutory powers through the ECI. The Commission’s operational powers can include decisions such as disqualifying a candidate who fails to lodge an election-expense account as required by law. Such action must remain within the governing constitutional and statutory rules.
- Fill legal and administrative gaps within the election field. The Supreme Court has described Article 324 as giving the ECI overall responsibility for elections. Where legislation does not occupy a particular area, the constitutional power can support directions needed to conduct a free and fair election, but it cannot be used contrary to an existing law.
In short, the CEC is the Commission’s constitutional chair and principal institutional leader. The job is broader than announcing polling dates, yet narrower than controlling every election-related decision personally.
Does the CEC make decisions alone?
No. The ECI is a multi-member constitutional body, and its decisions are taken collectively. The Election Commission has stated that all Election Commissioners have an equal say in decision-making. The CEC chairs meetings and represents the institution, but chairmanship should not be described as an unlimited personal veto.
The practical consequence is that a reader should distinguish between two statements: “the CEC leads the ECI,” which is accurate, and “the CEC can dictate every ECI decision,” which overstates the constitutional arrangement. Article 324 assigns the mandate to the Commission. The CEC’s influence is exercised through that institutional process, alongside the other Commissioners when they are appointed.
How is the CEC appointed and how long does the term last?
The President appoints the CEC under Article 324, subject to any law made by Parliament. The Election Commission describes the tenure as six years or until the officeholder reaches age 65, whichever comes first. A person who reaches 65 before completing six years therefore leaves on reaching that age; a younger appointee may serve the full six-year period unless the office becomes vacant through another constitutionally recognised event.
Appointment by the President does not mean the CEC serves at the President’s pleasure. The Constitution deliberately separates appointment from removal. Once in office, the CEC has a judge-like security of tenure that protects the Commission from ordinary executive pressure.

Who can remove the Chief Election Commissioner?
Neither the President, Prime Minister nor Union Cabinet can dismiss the CEC by an ordinary executive order. Article 324(5) says the CEC may be removed by the President only “in like manner and on the like grounds as a Judge of the Supreme Court.” The incorporated Supreme Court-judge standard is “proved misbehaviour or incapacity.”
The formal sequence is therefore parliamentary rather than executive. A qualifying motion must be initiated, investigated under the Judges (Inquiry) Act framework, approved by both Houses with the constitutional majorities, and then presented to the President. The President issues the removal order only after those steps have been completed.

What grounds are required to remove a CEC?
The constitutional grounds are limited to proved misbehaviour or incapacity. “Misbehaviour” is not a synonym for an unpopular decision, an electoral setback or a disagreement with the government. “Incapacity” refers to an inability to perform the office, and the allegation must be established through the prescribed inquiry process.
Political criticism can be intense during an election, but criticism alone does not satisfy Article 324(5). The constitutional design requires proof, an opportunity for the statutory inquiry to assess the allegations and the high voting thresholds in both Houses. This prevents a change of government or a temporary parliamentary majority from becoming an automatic dismissal mechanism.
What is the step-by-step process for removing the CEC?
The process can be understood in four stages. It is a constitutional address procedure supported by the Judges (Inquiry) Act, 1968.

- Members initiate a motion on the constitutional grounds. A notice of motion must be signed by at least 100 members of the Lok Sabha or 50 members of the Rajya Sabha. The signatures are a threshold for bringing the matter before the relevant presiding officer; they do not themselves establish misbehaviour or incapacity.
- The Speaker or Chairman decides whether to admit the notice. The Lok Sabha Speaker or Rajya Sabha Chairman considers the notice and accompanying material and may admit or refuse it. Admission begins the statutory inquiry route; it is not a finding that the CEC is guilty.
- An inquiry committee investigates the allegations. The statutory model uses a three-member committee: a Supreme Court judge, a Chief Justice of a High Court and a distinguished jurist. The committee examines the charges and reports whether misbehaviour or incapacity has been proved. If it finds no such ground, the parliamentary removal motion does not proceed. If it finds the ground proved, the motion can go forward for consideration by Parliament.
- Both Houses must adopt the address, then the President acts. Each House must approve the address with both Article 124(4) requirements: a majority of the total membership of that House and a majority of at least two-thirds of members present and voting. The address must be adopted by both Houses in the same session. Only after that does it go to the President, who issues the removal order.
The demanding sequence is intentional. It combines an evidentiary inquiry with cross-party, two-House consent before the executive branch performs the final formal act.
| Stage | What happens | Key legal requirement |
|---|---|---|
| 1. Notice | Members of one House submit a removal motion notice. | 100 Lok Sabha or 50 Rajya Sabha members must sign. |
| 2. Admission | The Speaker or Chairman decides whether to admit the notice. | Relevant material is considered; admission is not a finding of guilt. |
| 3. Inquiry | A statutory committee investigates the allegations. | Three members: Supreme Court judge, High Court Chief Justice and distinguished jurist. |
| 4. Parliamentary address | If the committee finds the ground proved, both Houses debate and vote. | Majority of total membership plus two-thirds of members present and voting in each House, in the same session. |
| 5. Presidential order | The approved address is presented to the President. | The President issues the removal order after the parliamentary requirements are met. |
Can the President remove the CEC directly?
No. The President’s appointment power does not include an at-will dismissal power. The President has two constitutionally distinct roles: appointing the CEC at the start of the tenure and issuing the final removal order after both Houses have adopted the required address. The second role is the final formal step, not a substitute for the inquiry and parliamentary votes.
Accordingly, a request from the Prime Minister, a Cabinet decision or dissatisfaction with an ECI ruling cannot by itself remove the CEC. Any lawful removal must satisfy the grounds, inquiry and voting requirements described above.
How is removing the CEC different from removing another Election Commissioner?
Article 324(5) gives the CEC a stronger, judge-like removal safeguard. An Election Commissioner or Regional Commissioner does not have exactly the same protection: that officer cannot be removed except on the recommendation of the CEC.
| Issue | Chief Election Commissioner | Other Election or Regional Commissioner |
|---|---|---|
| Removal protection | Removed by the President only in the manner and on the grounds applicable to a Supreme Court judge. | Cannot be removed except on the CEC’s recommendation. |
| Grounds and proof | Proved misbehaviour or incapacity, established through the prescribed process. | The constitutional clause gives a different recommendation-based safeguard; it should not be casually described as identical to the CEC’s judge-like protection. |
| Institutional position | Chairs the Commission when other Commissioners are appointed. | Participates in the Commission’s collective decision-making with an equal say. |
| Decision authority | Leads the institution but does not possess an unrestricted personal veto over ECI decisions. | Acts as part of the Commission rather than as a separate constitutional authority. |
This difference is why “the Election Commission” and “the CEC” should not be treated as interchangeable terms. The Commission is the constitutional decision-making body; the CEC is its chair with a specially protected tenure.

What does Article 324 allow the ECI to do, and what are its limits?
Article 324 gives the ECI overall responsibility for elections and allows it to address situations not fully covered by legislation. That residual capacity is important in a complex election, where administrative questions can arise that Parliament has not specified in detail. It does not place the Commission above the Constitution, election statutes, judicial review or other binding legal rules.
The safest way to understand the power is as a constitutional responsibility exercised within the legal framework. The ECI can issue directions needed to administer elections where the law leaves room, but it cannot disregard an express statutory command. The CEC, acting as chair, inherits that institutional setting rather than a separate power to legislate or adjudicate without legal limits.
Is calling the process “impeachment” technically correct?
“Impeachment” is commonly used in news reports because the procedure resembles the removal process for a Supreme Court judge. The constitutional text, however, speaks of an address by both Houses for removal and a subsequent presidential order. “Parliamentary address for removal” is therefore the more precise description, especially in a legal or civics explanation.
Independent reader supportYour contribution helps us test, update, and keep practical guides available for everyone. What should readers remember about the CEC’s independence?
Three safeguards work together. First, the CEC’s tenure is defined rather than dependent on the executive’s continuing confidence. Second, removal requires proved misbehaviour or incapacity, not ordinary policy disagreement. Third, both Houses must clear the address with demanding majorities before the President can act.
Do these 3 things before closing this tab:
1Scan for outdated or missing drivers - takes under a minute2Clear out junk files and repair common Windows errors3Fix the driver behind crashes, sound loss and screen glitchesThose safeguards do not make the CEC unaccountable. The Commission remains bound by election law, constitutional limits and review by the courts. They do, however, make arbitrary dismissal substantially harder and protect the administration of elections from a simple change in executive preference.

Bottom line: what does the CEC do and who can remove the officeholder?
The CEC chairs the Election Commission of India and helps direct the preparation of electoral rolls and the conduct of elections to Parliament, state legislatures, President and Vice-President. The ECI’s mandate is collective, so the CEC is not an all-powerful individual decision-maker.
Removal is possible only for proved misbehaviour or incapacity under the Supreme-Court-judge standard. After a qualifying notice, statutory inquiry and approval by both Houses using the Article 124(4) majorities, the address goes to the President for the final order. No ordinary presidential, prime-ministerial or Cabinet instruction can bypass that process.
Frequently Asked Questions
Why does the Constitution give the CEC a special removal safeguard?
Election administration must remain credible even when its decisions affect the government in power. Requiring proof, an independent-style inquiry and large majorities in both Houses makes a dismissal for short-term political reasons much harder.

Can Parliament remove the CEC without an inquiry committee?
The statutory framework requires an inquiry after a motion is admitted. If the committee does not find misbehaviour or incapacity proved, the removal address does not move forward to the final parliamentary vote.
Does a six-year appointment guarantee six years in office?
No. The stated tenure is six years or until age 65, whichever comes first. Reaching the age limit can end the tenure before six years have elapsed.
Why are the CEC and the Election Commission sometimes described differently in legal cases?
The ECI is the constitutional body that holds the election-supervision mandate. The CEC is its chair, while other Commissioners participate in collective decisions and have a different removal safeguard.
