In the United States, an AI-generated cartoon is not automatically infringing just because it resembles an artist’s general style. The U.S. Copyright Office says artistic style is not protected by copyright as a separate element. But that is not blanket permission to use every image commercially: a cartoon that copies recognizable details from a particular work, suggests the artist endorsed it, or exploits the artist’s identity can raise other legal issues. Whether you own copyright in the AI-generated image is a separate question.
Is it copyright infringement to make AI art in an artist’s style?
Not solely because of the style. In its Copyright and Artificial Intelligence, Part 1: Digital Replicas report, published July 31, 2024, the U.S. Copyright Office explains that copyright does not protect artistic style as a separate element. A broad resemblance—such as a similar use of line, color, or visual mood—is different from copying protected expression in a specific work.
That distinction does not clear a particular image. Look at the cartoon itself: does it reproduce distinctive characters, poses, compositions, settings, or other details from an identifiable work? A style label in a prompt does not answer that question, and calling an image “in the style of” an artist does not make copied details safe. The Office does not offer a universal test that guarantees a commercial use is lawful.
What changes when you use the cartoon commercially?
Commercial use does not automatically make a style imitation unlawful, but the way you present and monetize the image can matter. The Copyright Office’s Part 1 report discusses possible concerns beyond copyright, including passing off, unfair competition, and deceptive practices. Those are fact- and jurisdiction-dependent possibilities, not automatic claims.

Be especially careful if the promotion could lead customers to think the artist created, approved, sponsored, or is affiliated with the cartoon. Using an artist’s name, logo, brand, or recognizable identity in advertising or merchandising can raise issues distinct from whether the image copies a copyrighted work. The Office’s Copyright and Artificial Intelligence, Part 1 report discusses false endorsement and commercial exploitation of identity; applicable state laws vary.

Can you sell an AI image that looks like a particular cartoonist’s work?
Possibly, but the resemblance alone does not settle the answer. Before selling it, separate two questions: whether the image borrows protected expression from an identifiable work, and whether the sales page, packaging, or advertising implies the cartoonist’s involvement. A cartoon can raise concerns on one of those grounds even if the other is not present.
Fair use is not a shortcut or a percentage rule. The U.S. Copyright Office’s fair-use FAQ explains that there is no fixed number of words, notes, or percentage that automatically qualifies as fair use; the circumstances matter, and only a federal court can decide whether a particular use is fair. Do not treat a commercial purpose or a change to the image as an automatic answer.

Do you own the copyright in the AI-generated cartoon?
That is separate from whether you may use the image. In its Copyright and Artificial Intelligence, Part 2: Copyrightability report, released January 29, 2025, the U.S. Copyright Office says copyright can cover human-authored contributions to an AI-assisted work when a person determines sufficient expressive elements. Merely supplying prompts does not, by itself, make the AI-determined expressive elements human-authored. Human selection, arrangement, or modification may qualify for protection to the extent of that human contribution.
The Office’s registration guidance, dated March 10, 2023, says the human-authorship inquiry is case-specific. Applicants should disclose AI-generated material, exclude more-than-de-minimis AI-generated content from the claim, and identify the human-authored contributions. Having a copyright claim in your own contribution would not, by itself, establish that the image is cleared to use someone else’s protected expression or identity.

How to assess a proposed commercial use
- Inspect the actual image. Identify any specific existing cartoon, character, or illustration that it may resemble, then compare the expressive details—not just the broad style.
- Review the whole presentation. Check captions, product listings, packaging, ads, and social posts for the artist’s name, logo, branding, or language that could suggest approval or affiliation.
- Separate permission from ownership. Determine whether the output may copy protected expression, then separately consider what human-authored contributions, if any, you could claim as your own.
- Check the relevant jurisdiction. The cited Copyright Office guidance is U.S.-focused; it does not resolve laws in other countries or provide a state-by-state assessment.
- Get advice for consequential uses. For a major campaign, product launch, or image closely tied to a specific artist or work, ask an intellectual-property lawyer to assess the image and its planned use.
What the U.S. guidance does—and does not—establish
The U.S. Copyright Office’s guidance supports a limited conclusion: artistic style, by itself, is not a separate copyright element. It does not declare every AI imitation lawful, provide a universal commercial-use clearance, or decide how a particular image will fare under state law or the law of another country. The image, its promotion, and the applicable jurisdiction all matter.
