Sometimes, but there is no single yes-or-no answer across the United States. Federal law generally allows a person who is part of a conversation to record it with the consent of one participant, but some states require everyone’s consent, and interstate calls can raise questions under more than one state’s law. Your employer may also prohibit recordings even when recording would otherwise be lawful. If you are unsure, do not secretly record: identify where everyone is, check your workplace policy, and ask for clear consent.

This is general U.S. information, not legal advice for a particular state or employment dispute.

What does “one-party consent” mean?

One-party consent generally means that a conversation may be recorded when at least one participant has consented. Under the federal Wiretap Act, a private person may generally intercept a wire, oral, or electronic communication if they are a party to it or if one party has given prior consent. The statute includes an important limitation: the consent exception does not apply when the interception is made for the purpose of committing a criminal or tortious act. See 18 U.S.C. § 2511.

In practical terms, if you are speaking with your manager, you are a participant. Federal law may permit you to record that conversation without getting the manager’s consent, subject to the statute’s limits and any more protective state law. That is not the same as permission for an outsider to secretly record you and your manager. The participant-consent rule is materially different when the recorder is not part of the conversation and has no participant’s consent.

One-party consent is a federal baseline, not a nationwide guarantee. The Internal Revenue Service summarizes the issue simply: “The law for recording others varies by state.” State statutes and court decisions can impose additional limits, and the circumstances—including whether the conversation is private—can matter.

Can I record my boss or a meeting with HR without telling anyone?

Possibly, but do not rely on the federal baseline alone. First check the recording laws for the states where the participants are located; then check your employer’s rules. Even if a participant recording is lawful under the applicable recording statute, making it secretly may violate workplace policy or create a separate employment risk.

If your goal is to document harassment, discrimination, retaliation, or another workplace concern, the fact that a recording might be useful does not automatically make it lawful to create. Before recording an HR meeting, consider asking for consent, bringing a permitted support person, taking contemporaneous notes, or sending a follow-up email that neutrally confirms what you understood was discussed. If a recording seems important and consent is uncertain, get advice from an employment lawyer in the relevant state before making it.

A secret recording can also change the dynamics of a dispute. A recording may be relevant to a complaint, but it can draw attention to the way it was obtained, the employer’s policy, the privacy of the conversation, and how the file was later used or shared.

Which states require everyone’s consent?

Some states are commonly described as all-party-consent states, meaning every participant generally must consent before a covered conversation is recorded. The Reporters Committee for Freedom of the Press explains that “these laws require consent of all parties involved in a conversation before it can be recorded.” Other states have mixed or context-specific rules, including differences between in-person conversations and phone calls or electronic communications.

Examples identified in the Reporters Committee’s guide as primarily all-party-consent jurisdictions include California, Delaware, Florida, Illinois, Maryland, Massachusetts, Montana, New Hampshire, Pennsylvania, and Washington. The guide also identifies mixed or context-specific rules in states including Connecticut, Hawaii, Maine, Michigan, Missouri, Nevada, and Oregon. This is an orientation list, not a definitive or permanent legal chart: state law can change, and a label such as “two-party consent” can oversimplify a statute’s actual scope and exceptions.

For example, Washington’s statute provides that consent is considered obtained when one party announces to all other participants, in a reasonably effective manner, that the conversation is about to be recorded, and the announcement itself is recorded. Pennsylvania’s Wiretapping and Electronic Surveillance Control Act contains detailed prohibitions and exceptions for wire, electronic, and oral communications; a shorthand label should not substitute for reading the statute that governs the situation.

Before recording, check the current law in the state where you are and in the states where other participants are located. When the relevant rule is unclear, the safe practical approach is to tell everyone the conversation will be recorded and obtain affirmative consent before continuing.

What if a call or video meeting includes people in different states?

Identify every participant’s location before recording a phone call, video meeting, or remote workplace conversation. Laws in more than one state may be relevant, so do not assume the rule where you are automatically controls what happens to people elsewhere.

If one participant is in a state that may require all-party consent—or you cannot confidently determine which law applies—announce the recording and ask each participant to agree. If anyone declines, stop the recording and continue without it, or ask whether everyone is comfortable rescheduling or using another way to document the discussion.

For Zoom, Teams, or another meeting platform, a recording indicator or automated notice can help alert participants, but it is not a universal legal answer. The notice may not resolve questions about applicable state law or whether each person actually consented. When necessary, ask for verbal or written confirmation as well as using the platform’s notice.

Can my employer record conversations without my consent?

Not automatically just because the conversation takes place at work or on company property. The analysis can depend on who is recording, whether the employer or another participant has consented, what state law requires, whether the conversation is private, and what notice or policy applies. Audio recording and video-only surveillance can raise different issues; a rule about capturing audio does not, by itself, answer every question about silent video.

Workplace systems may record audio as well as video, and customer-service or support calls may begin with an announcement that the call is being recorded. Notice may support consent in some circumstances, but the governing law and the locations of the people on the call still matter. Do not assume that a device’s visibility or a company’s ownership of the premises settles the question.

Privacy-sensitive locations deserve particular caution. A private office, restroom, locker room, or similar area is not automatically a public space merely because it is at work. Privacy expectations and other privacy laws can create additional exposure, so an employer or employee should not treat a general workplace recording rule as permission to capture private conversations in such places.

Can my employer prohibit me from recording?

An employer may have a workplace rule requiring notice, consent, or approval even where recording law might otherwise allow a participant to record. The U.S. Department of Labor’s policy, for example, prohibits recording devices at meetings, teleconferences, interviews, and conversations unless participants are notified and all parties agree, or a court order authorizes the recording. That is an agency’s own policy—not a rule that automatically binds every private employer.

Federal employment guidance from the Department of Justice also explains that management may prohibit recordings as part of its authority to maintain an orderly workplace, even if state law might otherwise permit a secret participant recording. The practical distinction is important: legal permission under a recording statute and permission under an employer’s policy are separate questions.

Read the policy that applies to you and consider how it could affect discipline, confidentiality, or workplace relationships. If the policy appears to conflict with an employee’s efforts to raise collective workplace concerns, do not assume either that the policy is automatically valid in every situation or that it can safely be ignored. Labor-law protections may matter, as discussed below.

Could labor law protect a workplace recording?

Sometimes, a recording connected to employees acting together over workplace conditions can raise a National Labor Relations Act issue. Section 7 protects certain concerted activity, and Section 8(a)(1) makes it an unfair labor practice for an employer to interfere with, restrain, or coerce employees in exercising those rights.

The National Labor Relations Board’s bench book discusses circumstances in which workplace recordings may be admissible in Board proceedings and cites authority recognizing that enforcement of a state recording restriction may be preempted when a recording is itself protected Section 7 activity—for example, preserving what was said in a management meeting for a future employment-related action.

This is a narrow, fact-specific issue, not a general right to secretly record every manager, HR meeting, or coworker. It does not erase federal interception-law limits or guarantee that a neutral workplace rule is invalid. If a recording relates to organizing, safety, collective complaints, or discipline connected to concerted activity, consult a labor or employment lawyer promptly rather than assuming the exception applies.

Can I record workplace harassment or discrimination?

A recording may preserve evidence, but the seriousness of the underlying complaint does not automatically change the consent rules. Check the law where all participants are located and your employer’s policy before recording. If you are in a state that may require everyone’s consent, or the conversation will include people in multiple states, do not assume a participant recording is permitted.

You can still document events without secretly recording. Write down the date, time, location, people present, and what was said as soon as possible afterward. Preserve relevant emails, messages, schedules, or other records you are allowed to access. A calm follow-up message summarizing your understanding can create a contemporaneous written record; avoid adding facts you cannot support. For a serious concern, an employment lawyer or the appropriate workplace or government channel can help you decide what documentation is lawful and useful.

Can I use a recording in an employment dispute?

Whether a recording can be used as evidence is a separate question from whether it was lawful to make. The NLRB bench book’s discussion of admissibility concerns Board proceedings; it is not a promise that a court, arbitrator, agency, or employer will accept every recording. The forum, the circumstances of the recording, and applicable evidence rules can affect whether and how it may be considered.

If you already have a recording, preserve the original file and make a note of when and where it was made, who was present, and whether anyone was notified or consented. Do not edit the original. Keep any related consent or notice, and limit access to people who need it for the matter. Sharing or publishing it can create additional privacy, confidentiality, defamation, trade-secret, or employment-law problems beyond the initial act of recording. Ask a lawyer before circulating it broadly or posting it online.

What should I check before recording a work conversation?

  1. List every participant and location. This includes remote attendees and people joining by phone. A multi-state meeting can implicate more than one state’s law.
  2. Check the current state rule. Determine whether the relevant law is one-party, all-party, or mixed, and whether it treats in-person, phone, and electronic conversations differently. Do not rely only on a state-label list.
  3. Confirm you are a participant. Do not assume that consent rules for a person in the conversation allow you to record other people when you are not part of it.
  4. Read the employer’s policy. Look for rules covering meetings, calls, interviews, phones, recording devices, confidentiality, and approval. Statutory legality does not necessarily make recording policy-compliant.
  5. Ask for clear consent when uncertain. Tell everyone before recording begins and obtain affirmative agreement. For remote meetings, use the platform’s notice and ask directly when needed.
  6. Choose another recordkeeping method if consent is denied. Take notes, send a factual follow-up email, or seek legal advice about appropriate documentation.
  7. Protect any file you lawfully make. Preserve the original, keep related notices, limit distribution, and get advice before using or sharing it in a dispute.

The safest decision rule is simple: when the participants’ locations, state law, or workplace policy are uncertain, do not make a secret recording. Ask for consent or use another way to document the conversation, and get state-specific legal advice when the stakes are significant.

Frequently Asked Questions

Do I have to tell coworkers if my phone is recording in an open office?

An open office does not automatically make every conversation public or remove privacy protections. The answer can depend on what was recorded, the participants’ locations, and state law; do not infer permission from the fact that coworkers were nearby.

What if someone says no after I announce a recording?

Do not continue recording on the assumption that the initial announcement is enough. Stop the recording and document the conversation another way, or ask a lawyer about lawful options for the particular situation.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Can I send a recording to my coworkers or post it online?

A recording’s initial legality does not settle whether disclosure is lawful or safe. Wider distribution can raise separate privacy, confidentiality, defamation, trade-secret, and employment concerns, so limit sharing and get legal advice before publishing.

Should I keep the original recording if I need to report what happened?

If you lawfully made a recording, preserve the unedited original and keep any related consent or notice. A note of when, where, and with whom it was made can help explain its context, but an attorney can advise whether and how to submit it.
