Sometimes—it depends on the generator, its current terms, and what you mean by “own.” A tool may let you edit a game and share or publish it without giving you exclusive copyright in every generated element or permission to use every asset commercially. Check the tool’s terms, your plan, the platform’s rules, and the law where you live before distributing or selling a game.
What “owning” an AI-made game can mean
There are several different questions hidden inside “Do I own this game?” A generator’s terms set the contractual permissions between you and that service. Copyright law separately determines whether particular material is protected and who holds those rights. A game can also contain assets or other material subject to third-party rights.
- Permission to use: The service may permit personal or commercial use under its terms, sometimes depending on whether you use a free or paid plan.
- Copyright protection: Whether you can claim copyright in the game or parts of it depends on the applicable law and the human contribution involved.
- Rights in included material: A generator’s permission does not necessarily clear every character, image, sound, name, or other material in the output.
So permission to publish is not the same thing as exclusive ownership, and a platform’s share or publish feature does not settle copyright questions.
Can you sell a game made with AI?
Possibly, but first check whether your specific generator and plan permit commercial use. Then review the distribution platform’s rules and make sure you have rights to the material you supplied and the content you plan to release.

Rosebud AI: free and paid plans differ
Rosebud AI’s terms distinguish between plans: user-generated content made with the free version is for personal, non-commercial use, while content made with the paid version may be used commercially subject to the terms. The same terms grant Rosebud a non-exclusive, royalty-free, perpetual, irrevocable, fully sublicensable license to use user-generated content for business purposes connected with operating, providing, improving, or publicizing its services. Read the Rosebud AI Terms of Service for the conditions that apply to your use; this is a Rosebud-specific example, not a rule for other generators.
Roblox: check the operative terms before relying on them
Roblox’s Terms of Use page surfaced Creator Terms with an effective date of November 1, 2026, which is later than October 7, 2026. That future-dated text should not be treated as already operative on October 8, 2026. Check the current terms and effective date before making a commercial decision. The surfaced terms also say users are responsible for prompts and outputs, should evaluate output before use or sharing, and may receive non-unique output; they describe a broad UGC license and say Roblox does not assert ownership rights in new intellectual property created in outputs.

Can you copyright an AI-generated game?
In the United States, prompting alone is not enough to establish copyright in AI-generated output. The U.S. Copyright Office says output may qualify for copyright where a human determines sufficient expressive elements. It identifies human-authored work perceptible in the output and creative arrangement or modification as possible grounds. Using AI as an aid, or including AI-generated material in a larger human-generated work, does not automatically prevent copyrightability. These are U.S. conclusions and should not be assumed to apply in other countries.
In its January 29, 2025 announcement, the Office said it had reviewed more than 10,000 responsive comments while preparing its conclusions. That figure describes the report process, not the number of AI-made games that qualify for copyright. See the U.S. Copyright Office’s Part 2 AI report announcement.

For a particular game, the key question is not simply whether AI was involved. Consider what a person created or determined—such as expressive material, modifications, or a creative arrangement—and what came from the generator. The Office’s guidance does not establish that every AI-assisted game, or every part of one, is copyrightable.
Can you edit the code or content a generator creates?
That depends on the product’s actual editing and export features. Editing access is a capability of the tool; by itself, it does not establish copyright ownership, commercial permission, or a right to take the project outside the service.

Rosebud’s AI Game Creator page says users can open and edit generated JavaScript and share a playable link. Roblox describes Build as a mobile-first AI game creation tool that turns ideas into playable, publishable Roblox games in its Build documentation. Those descriptions explain what the products advertise; they do not settle whether a specific project can be exported or used commercially under the applicable terms.

- Plan and renewal: Determine whether commercial permission applies to your plan and whether it changes if your subscription ends.
- Code, assets, and export: Find out what you can edit, download, or move to another platform, and whether the terms impose conditions on those actions.
- Prompts and output: Check who is responsible for supplied material and generated results, and whether output may be non-unique.
- Third-party rights: Do not assume that a tool’s output review clears material you asked it to reproduce or that you supplied.
- Platform rules: Review moderation, disclosure, and content-rating obligations for the destination where you will publish.
- Jurisdiction and date: Confirm which country’s law and which current version of the terms apply before relying on an ownership or commercial-use claim.
Roblox-specific rules for games involving generative AI
Roblox says AI-generated content must comply with its Community Standards and describes moderation of inputs and outputs through Roblox APIs. For content delivered through third-party AI tools, creators remain responsible for what is delivered. Its Games with Generative AI guidance also says games that let players interact with generative AI must disclose that interaction in the Content Maturity questionnaire. It requires a Restricted content maturity label for extended interactions; that label is unavailable to users under 18. Follow the guidance’s visible-disclosure instructions if the requirement applies to your game.
Roblox’s AI data-sharing documentation describes controls for choosing whether individual games, avatar items, and paid Creator Store assets are shared for AI data use. A data-sharing setting is not a copyright grant or a general license to distribute a game.
