Sometimes, but there is no nationwide rule that makes every item in an apartment dumpster free to take. The answer can depend on local waste laws and whether you must enter restricted property to reach the bin.
Why the answer depends on more than whether an item was thrown away
Three separate questions matter: whether the item was discarded, whether local rules allow someone other than an authorized collector to remove it, and whether reaching it involves entering property without permission. A rule about one of those issues does not settle the others.

What the court decisions do—and do not—say
California v. Greenwood is about police searches
In California v. Greenwood, 486 U.S. 35 (1988), the U.S. Supreme Court held that the Fourth Amendment did not prohibit the warrantless search and seizure of garbage left for collection outside the home’s curtilage. The decision addresses government search-and-seizure limits and expectations of privacy. It is not a general scavenging law, a ruling that every discarded item is free for the taking, or permission to enter apartment property. Read the decision.
State v. Sigarroa illustrates why access matters
In State v. Sigarroa, the Wisconsin Court of Appeals discussed a dumpster behind an apartment building that could be reached by traveling down a private driveway past a “Private Property” sign. The court considered those circumstances in addressing privacy in a police search and contrasted them with trash accessible from the street. It did not decide that every apartment dumpster is off-limits or that taking from a street-visible bin is lawful. Read the opinion.

State v. Wright shows how a local waste rule can matter
In State v. Wright, the Iowa Supreme Court discussed abandonment and quoted an ordinance that made unauthorized collection of solid waste placed out for collection unlawful unless the person was an authorized solid-waste collector. This is an Iowa example, not a rule that applies nationwide; it shows why the relevant city or county code must be checked. Read the opinion.
How to check the rules for a particular dumpster
- Identify the location. Note the state, county, and city; a general U.S. answer cannot resolve local rules.
- Check local codes. Search the city or county code for rules on scavenging, solid-waste collection, and dumpster or container access.
- Check access and permission. Determine whether reaching the bin requires entering a gated, signed, fenced, or otherwise restricted apartment area. Ask the owner or property manager before entering or removing items.
- Follow a direction to leave. Do not rely on Greenwood as a reason to stay after a property representative tells you to leave.
- Get local legal help if cited. If you have received a citation or been warned to leave, consult an attorney familiar with the jurisdiction.
