Keeping a game you lawfully acquired is a different legal question from bypassing its authentication, modifying it, running a replacement server or sharing altered files. The answer depends on your country, the game’s terms and technical design, and exactly what you want to do after shutdown.
First, identify what the shutdown makes unavailable
A server closure does not automatically make every part of a game unplayable. Some games retain offline or local modes; others use a server only to authenticate a copy; still others rely on remote systems for multiplayer, progression, content or core gameplay. A game may therefore remain playable in one mode while another stops working.
That technical distinction matters legally. Ordinary offline play is not the same action as defeating an access control, and neither is the same as recreating an online service or distributing a modified client.
What U.S. law allows—and what it does not
A narrow U.S. exemption to the DMCA circumvention prohibition appears in 37 C.F.R. § 201.40(b)(19). It can permit circumvention to restore personal local gameplay when an owner or authorized representative has ended access to an external server needed for authentication, but only for a lawfully acquired complete game and within the rule’s conditions. The exemption is codified by the U.S. Copyright Office.

Conditions for personal local play
- The game must be lawfully acquired in physical or downloaded form and qualify as a complete game.
- For this purpose, a complete game must be playable without accessing or reproducing copyrightable content stored, or previously stored, on an external server. If the game needs server-hosted content to play, it may not meet this definition.
- The owner or authorized representative must have affirmatively ended support and made it unavailable, or support must have been discontinued for at least six months and not restored.
- The restored play must be local gameplay on a PC or console, or on locally connected PCs or consoles—not through an online service or facility.
This is not general permission to revive online play. It does not, by itself, authorize operating a private server, accessing an online service, obtaining server-side copyrighted content, distributing a modified game or ignoring other applicable laws. Those activities need separate analysis.
Institutional preservation is a separate, restricted route
The same regulation provides limited preservation allowances for eligible libraries, archives and museums. Among the conditions, preservation activity must be noncommercial, and the game cannot be distributed or made available outside the institution’s physical premises. A separate part covers certain games that no longer depend on a server but are no longer reasonably available commercially. These institutional provisions are not a general public right to play a preserved copy remotely.

What EU rules say about a game’s end of service
EU law does not currently guarantee that every game must remain playable forever. In a statement published on 16 June 2026, the European Commission said it could not at that stage propose a general legal obligation to keep games playable after they stop being provided commercially. It cited rights holders’ intellectual-property rights while noting that consumer safeguards still apply.
In its answer issued on 5 June 2024 about disabled or delisted games, the Commission said EU consumer-protection legislation “does not set specific requirements as to the duration of the supply of products, including of online video games.” The answer describes potential remedies when a digital product or service does not conform to the contract: bringing it into conformity, or, where the supplier makes clear it will not do so, a proportionate price reduction or contract termination. For a terminated time-based digital supply, reimbursement may cover the prepaid portion of the remaining affected period.

These are not automatic refunds whenever a server closes. The contract, what the provider promised about duration or termination, the circumstances of the shutdown and the applicable national process matter. National courts and administrative authorities handle individual disputes. The Commission said in June 2026 that it would begin an exchange with industry and consumer representatives by the end of 2026, with the aim of drawing up an industry code of conduct for game end-of-life. That planned process is not an enacted universal playability right.

What to check for a specific game
- Establish the jurisdiction. Identify your country and check whether the game’s terms specify a governing law. U.S. federal copyright rules and EU consumer protections address different issues.
- Read the shutdown notice and terms. Look for what ends, when support ends, and any statements about duration, termination, offline play or refunds.
- Map the server dependency. Determine whether the server handles authentication only or supplies multiplayer, progression, game content, anti-cheat or other functions essential to play.
- Describe the workaround precisely. Distinguish ordinary offline play from circumvention, client modification, private-server operation and sharing files. The legality of one does not establish the legality of another.
- Keep purchase and service records if seeking a remedy. Save the receipt, the product page and terms shown at purchase, the shutdown notice, and any statements about promised duration or termination. These may matter to a case-specific consumer claim.
A physical disc or downloaded copy establishes possession of a copy, but does not by itself resolve questions about circumvention, service access, licensing or distributing altered files. For a named title—especially if the proposed workaround involves a private server or modified client—the relevant facts and local law need to be assessed separately.
