Sometimes, but there is no single Canada-wide rule that lets you keep a fossil you find. The answer depends on the province or territory, who manages the land, whether the site is protected, and whether the fossil is common or scientifically significant. In British Columbia, limited surface collection of common fossils is allowed for personal use under specific conditions. In places administered by Parks Canada, visitors may not collect fossils. Check the rules for the exact location before moving a find.

What determines whether you can keep a fossil?

Four separate questions matter: who owns or administers the land, whether you have permission to access it, whether collection is allowed there, and whether the specimen may be kept or transferred. Permission to enter land does not automatically grant permission to collect. Nor does a rule for one kind of land apply to all public land across Canada.

  • Jurisdiction and land manager: Identify the province or territory and the specific administrator—such as a private landholder, provincial agency, federal department, or park authority.
  • Protected status: Parks, reserves, and other lands governed by special statutes may have rules that differ from general Crown-land guidance.
  • Collection method: Surface pickup and excavation are not interchangeable. Do not dig, break rock, or use tools at an unfamiliar site unless the applicable authority confirms it is allowed.
  • Specimen and intended use: A common fossil, a significant find, personal possession, sale, removal from a province, and research collection can all be treated differently.

“Crown land” is not a blanket permission to collect. The examples below explain rules established for British Columbia and Parks Canada; they are not a survey of every province and territory.

Can you keep a fossil you find in Canada?

There is no reliable yes-or-no answer without the exact location and land status. British Columbia provides a narrow recreational exception for common fossils on the land surface, while Parks Canada prohibits visitor collecting in its national parks and historic sites. For private land and jurisdictions not covered here, do not infer ownership or collection rights from either example: verify the rules with the relevant landholder and provincial or territorial authority.

British Columbia: limited collection of common fossils

B.C. says recreational surface collection of small amounts of common fossils is allowed, subject to access, safety, land-use, and other legal restrictions. A “common” fossil is one that is not considered scientifically significant and is abundant enough that collecting a few would not deplete the site. The Province describes collectors as caretakers, not owners, of fossils.

Common fossils collected under this recreational guidance may be kept only for personal use: they must not be sold or removed from B.C. Significant fossils, including vertebrate fossils, must not be collected. The Province also asks the public to report sites with vertebrate fossils or trackways, exceptionally preserved or diverse fossils, and important new fossil sites. If a find is unusual, rare, or from a site with only a small quantity, contact the Royal BC Museum, a local museum, or the B.C. Fossil Management Office. Before visiting a B.C. site, check its land status and access conditions. Resource authorizations may make an area incompatible with collecting or unsafe, and recreational access guidance does not override other laws. B.C. generally administers fossils on Crown land under the Land Act unless the land is administered under another government portfolio. Parks and other lands governed by separate statutes have their own requirements. The Province’s fossil management overview, also last updated May 1, 2026, explains that the 2005 regulation excluded fossils from the Mineral Tenure Act definition of “mineral,” with specified exceptions including limestone, dolomite, coal, petroleum, and natural gas.

Parks Canada: visitors may not collect

Taking fossils and other natural objects from Parks Canada-administered national parks and national historic sites is illegal. If you find a fossil there, leave it where it is and tell park staff. Parks Canada’s visitor rules list fossils among the objects visitors may not collect.

What should you do if the fossil may be significant?

  1. Leave it in place. Do not pick it up, dig around it, break rock, or attempt to remove it. B.C. prohibits collecting significant fossils; Parks Canada requires finds to remain undisturbed until inspected.
  2. Record the location without disturbing the find. Note where you are and, if safe and permitted, document the location and visible features without moving or altering the specimen.
  3. Notify the land manager or appropriate authority. In a Parks Canada location, report a fossil to park staff. In B.C., report significant, unusual, rare, or vulnerable-site finds to the Royal BC Museum, a local museum, or the B.C. Fossil Management Office.
  4. Wait for instructions. Do not treat silence, public access, or a general collecting rule as authorization to remove a potentially important specimen.

Do you need a permit to collect fossils?

It depends on the place and purpose. A visitor may not collect fossils in Parks Canada-administered locations. Scientific research collection is a separate, restricted activity: the Parks Canada permit process authorizes only the approved project, location, period, objects, and conditions. It is not a recreational collecting licence.

Parks Canada’s research and collection permit guidance says fossils or evidence of past human occupation must be reported immediately to the Superintendent and left undisturbed until inspected by a Parks Canada paleontologist or archaeologist. Natural objects collected under permit remain Crown property and are considered on loan to the permit holder, subject to permit terms and final disposition.

Scientific collection in B.C. also requires prior approval under the applicable route. The Province says fossils collected for research must be returned to a recognized B.C. fossil repository after study. Its scientific research collection guidance was last updated March 21, 2025. A research permit or approval does not by itself transfer ownership of a specimen.

Check current access rules for Mount Stephen

Mount Stephen fossil beds in Yoho National Park are subject to a site-specific restriction. A Parks Canada bulletin issued June 5, 2024, and stated to remain in effect until further notice, closes the fossil beds and surrounding area unless visitors are accompanied by an authorized Burgess Shale guide. It states a maximum penalty of $100,000. Because closures and access conditions can change, check the current Yoho National Park bulletins before travelling.

How to check the rules for your exact find

  1. Pin down the location. Record the nearest town, park or protected area, and the precise site or parcel if you can do so without disturbing the fossil.
  2. Identify who manages the land. Establish whether it is private, provincial or territorial Crown land, federal land, or a protected area, and contact that land manager.
  3. Ask about both access and collection. Confirm whether you may enter, whether surface collection is permitted, and whether excavation or tools are prohibited.
  4. Describe the specimen and your intended use. Ask how the authority treats significant or uncertain fossils, and distinguish personal keeping from sale, removal across a provincial boundary, or research.
  5. Do not move an uncertain find while checking. If it appears unusual, rare, exceptionally preserved, or scientifically important, document its location and report it instead.
