A narrow exception can apply when a judge enters an acquittal only after a jury has returned a guilty verdict. The fact that a case involves cryptocurrency does not change these rules.
What happens after a jury finds a defendant not guilty?
Under the general federal rule, the defendant is released and the government may not appeal a jury’s finding of not guilty. The U.S. Courts explains that a person acquitted of an offense may not be charged again for that same offense in federal court. U.S. Courts: Criminal Cases
The constitutional protection against double jeopardy is central. Prosecutors cannot use an appeal to obtain a second trial or renewed fact-finding on the elements of an offense after an acquittal. When can the government appeal an acquittal entered by a judge?
A different situation arises if a jury first returns a guilty verdict and the judge then enters a judgment of acquittal. In that limited posture, the government may be able to appeal if a successful appeal would reinstate the jury’s existing guilty verdict rather than require a new trial. The distinction is what would happen after a successful appeal: restoring the verdict is not the same as retrying the defendant.

Federal rule advisory materials and Supreme Court decisions provide the legal context for this distinction. The Department of Justice has also described it in a court filing; that filing presents the government’s argument, rather than neutral court guidance. U.S. Department of Justice
What does the federal government’s appeal statute allow?
Under 18 U.S.C. § 3731, the government may appeal certain specified district-court decisions, subject to statutory conditions and constitutional limits. It is not an unrestricted right to appeal an acquittal. The statute expressly preserves the bar on further prosecution where the Constitution prohibits it. Its 30-day deadline applies to certain appeals covered by the statute; it is not a general deadline for appealing a jury’s not-guilty verdict. 18 U.S.C. § 3731

How is an ordinary criminal appeal different?
In a typical federal criminal appeal, the defendant challenges an adverse outcome, such as a guilty verdict. The appellant submits a brief explaining the claimed legal errors, and the appellee responds with arguments for upholding the result or explaining why any error did not affect it. Appeals review legal arguments about the lower court’s decision; they do not provide a general opportunity to retry the case. U.S. Courts: Appeals
Does the cryptocurrency subject matter change the rule?
No cryptocurrency-specific appellate exception is established by the federal authorities described here. The relevant questions are procedural: which court handled the case, who entered the acquittal, and whether a successful government appeal would restore an existing verdict or require further proceedings.

These rules describe U.S. federal criminal cases. State courts and courts in other countries may follow different procedures, so the federal rule should not be treated as universal.

- The jurisdiction and court: federal, state, or another country’s system.
- Whether a jury returned a not-guilty verdict, a judge entered an acquittal after a guilty verdict, or the court issued a different dismissal or ruling.
- What the government is appealing and whether success would reinstate an existing verdict or require a new trial or further factual proceedings.
Without the case name, court, and exact order, its appeal status or likely result cannot be established from the general rule alone.
