Yes. AI image generators can produce images that evoke recognizable features associated with a living artist. In the United States, that resemblance alone does not answer whether an image infringes copyright or violates another law: the key questions include whether it copies protected expression from a particular work, misleads people about who made or endorsed it, or implicates rights tied to a person’s identity. The same questions also raise ethical concerns about consent, markets, and reputation.

What does it mean for an image to imitate an artist?

People may use “imitate” to mean anything from borrowing a broad visual approach to reproducing elements of a particular image. Those are not the same thing. A generated picture may remind viewers of an artist without copying a specific work; alternatively, it may reproduce protected expression from one or more works. A style reference, a copied image, a false endorsement, and a realistic likeness each call for different analysis.

This article focuses on U.S. law and policy. It is not a rule for every country: copyright, publicity, and related rights differ by jurisdiction, and the sources cited here do not establish how other countries would treat a particular output.

Is an artist’s style protected by copyright?

The U.S. Copyright Office’s Copyright and Artificial Intelligence, Part 1: Digital Replicas (July 31, 2024) says it does not recommend adding style itself as protected subject matter under a federal digital-replica law. That is not a blanket ruling that every style imitation is lawful, nor does it prevent a dispute over a particular image from turning on other rights or facts.

Copyright analysis can still ask whether an output reproduces protected expression from a specific work. The Office also notes that some state right-of-publicity laws, or common-law protections, may protect a style closely identified with an individual performer. It describes that area as not fully developed. The legal treatment of a broad stylistic resemblance therefore should not be confused with the treatment of a copied work or an identifiable person’s replica.

How do style, copying, attribution, and replicas differ?

The following distinctions help identify the question at issue. They are not automatic verdicts: the result depends on the work, presentation, jurisdiction, and other facts.

Attribution and integrity are also relevant concepts. In Authors, Attribution, and Integrity: Examining Moral Rights in the United States (April 23, 2019), the Copyright Office describes moral rights as personal, non-economic interests that include being credited as an author and preventing prejudicial distortion of a work. The Office characterizes U.S. protection as spread across federal and state laws, and discusses possible legislative changes involving the Visual Artists Rights Act, the Lanham Act, and copyright-management-information protections. Those interests are related to, but not interchangeable with, copyright ownership or a right to control every reference to a person’s style.

Does AI training make the generated image unlawful?

Training a model on works and distributing a generated output are related but separate legal questions. The U.S. Copyright Office’s Copyright and Artificial Intelligence, Part 3: Generative AI Training was released as a pre-publication report on May 9, 2025. It discusses the four-factor fair-use framework, possible effects on markets for works and derivative works, and whether outputs can expose protected material. It does not establish a categorical result for every training use, model, dataset, or output.

The report discusses safeguards that developers may use, including input filters, training techniques, system prompts, and output filters. It also says the effectiveness of guardrails is factually disputed. The presence of a safeguard, or a model’s ability to produce a style-like image, does not by itself decide whether a particular use is lawful. The Copyright Office’s AI study page reports that the Office received over 10,000 comments by the December 2023 deadline; that figure counts submissions, not a poll or measure of public consensus. The study page identified Part 3 as pre-publication with a final version forthcoming, so the May 2025 report should be understood in that status when cited.

Can someone copyright an AI-generated image?

In its January 29, 2025 Part 2 release, the U.S. Copyright Office said an AI-generated output may receive copyright protection where a human author determined sufficient expressive elements. Human creativity can be expressed through an AI system, but providing prompts alone does not establish authorship by itself.

Human contribution may matter when it is perceptible in the output as human-authored material, or when a person makes creative arrangements or modifications. Including AI-generated material within a larger human-created work also does not automatically prevent the human work from being copyrightable. The question is what expressive contribution a human made, not merely whether a person used an image generator.

What are the ethical and market risks?

The Copyright Office’s Part 1 report records stakeholder concerns that a generator could produce large volumes of work evoking a particular creator and affect that creator’s market. Part 3 separately discusses possible competition with creators and lost licensing opportunities in the training context. These are reported concerns and possible effects, not quantified findings that establish how much harm a particular artist has suffered.

  • Consent and use of work: Consider whether the artist’s work was used with permission and whether the model or output is being used in a context where permission or licensing matters.
  • Confusion about authorship: Avoid presenting an AI-generated image in a way that falsely implies the artist made it, approved it, or is involved.
  • Competition with commissions or licensing: Ask whether the output is being marketed as a substitute for work the artist might otherwise be commissioned or licensed to create. The possibility of competition is a concern, not a guaranteed legal conclusion.
  • Identity and reputation: Consider whether invoking the artist’s name or recognizable identity could mislead audiences or affect the person’s reputation.

These are useful ethical checks even when the legal answer is uncertain. They should not be treated as a substitute for legal analysis of a specific image or use.

What should users and publishers check before using an imitation?

  1. Identify what the output resembles. Is it a broad aesthetic resemblance, a specific artwork, or a realistic depiction of a person? Do not treat those categories as interchangeable.
  2. Review the presentation. Check titles, captions, tags, and promotional copy for language that could imply the artist created, approved, or endorsed the image.
  3. Consider the use and market. Commercial use, licensing, commissions, and competition may make the context especially important; no single factor supplies a universal answer.
  4. Check the relevant jurisdiction and rights. This article describes U.S. sources. State law may matter, and other countries may apply different rules.
  5. Seek qualified advice for a consequential use. If a specific work, person, or commercial campaign is involved, an attorney can assess the relevant facts and applicable law.

What the available U.S. guidance does—and does not—settle

The Copyright Office’s reports offer distinctions and policy analysis, not a universal ruling for every prompt or generated image. Part 1 addresses digital replicas and style; Part 2 addresses when human contributions can support copyright in AI-assisted output; and the May 9, 2025 Part 3 is a pre-publication discussion of training, fair use, safeguards, and market effects. Together, they support a careful answer: an image generator can evoke a living artist, but style resemblance alone does not resolve the separate questions of copying, attribution, identity, training, or ethical impact.
