Deepfake bans can make certain harmful acts illegal, but a ban alone does not tell a victim how to get content removed or limit its recirculation. A fuller response combines targeted criminal rules with usable reporting and removal processes, platform duties, transparency requirements, and technical measures that may help identify synthetic content. The U.S., EU, and UK examples illustrate different parts of that toolkit; the available official sources describe legal requirements, not proof that the measures reduce harm in practice.

What can deepfake bans do—and what can’t they do?

A prohibition targets conduct that lawmakers define as unlawful. It can establish consequences for making or sharing particular material, but it does not automatically remove a post, prevent copies from spreading, or explain how a person should report abuse. Those tasks require processes and duties that sit alongside criminal law.

Policy tools address different points in the chain: rules can prohibit certain acts; reporting systems can give affected people a route to request action; platform duties can require a response; transparency rules can make some synthetic content recognizable; and technical marks or image hashes may help systems identify content or copies. These tools are complements, not interchangeable guarantees. A label is not a takedown, and a takedown rule is not a criminal conviction.

The examples below are bounded comparisons, not a ranking of national approaches. Their scopes differ: the U.S. federal law and the UK measures described in a 2026 government factsheet focus on intimate-image abuse, while the EU AI Act sets transparency duties for covered AI systems and content.

How the U.S. TAKE IT DOWN Act combines a prohibition with a reporting process

Which conduct the federal law targets

Public Law 119-12, the TAKE IT DOWN Act, was enacted on May 19, 2025. It criminalizes certain knowing online publications of nonconsensual intimate depictions, including certain digitally forged depictions. The statute defines a digitally forged depiction as one created or altered using software, machine learning, artificial intelligence, or other technological means that is indistinguishable from an authentic depiction when viewed as a whole by a reasonable person.

For adult depictions, the law includes conditions concerning lack of consent, public exposure, public concern, and intent to cause or actual harm. The statute provides different maximum imprisonment terms for offenses involving adults and minors; those distinctions do not make the act a blanket ban on deepfakes generally. The law is directed at specified intimate depictions and circumstances, not every synthetic image, video, or audio recording.

It also makes clear that consent to creating an intimate depiction does not, by itself, establish consent to publishing it: “the fact that the identifiable individual provided consent for the creation of the intimate visual depiction shall not establish that the individual provided consent for the publication” (TAKE IT DOWN Act, Section 2).

What covered platforms must provide

The Act requires covered platforms to establish a notice process for removal. That process is a distinct tool from criminal prosecution: it gives a person a channel to request platform action, but the existence of a notice process does not establish how quickly a particular report will be handled or whether copies elsewhere will be removed. The statute’s platform process should not be confused with a blanket promise that every deepfake will be taken down.

How the EU AI Act separates machine marking from visible disclosure

Two duties, directed at different actors

Article 50 of the EU AI Act uses a broader transparency approach for covered AI systems and content. As described by the European Commission, Article 50 applies from August 2, 2026. Providers of covered systems must mark synthetic content in a machine-readable format and enable its detection, subject to the provision’s scope and exceptions. Deployers of covered systems must disclose covered deepfakes in a clear, perceivable way.

These are separate duties. A machine-readable mark is intended to be processed by technical systems; a visible disclosure is meant to be understandable to people. The Commission’s FAQ says: “Therefore, deployers cannot simply rely on the machine-readable marking embedded in the content by the provider.” A mark embedded by a provider does not, on its own, satisfy a deployer’s disclosure duty.

What counts as a covered deepfake—and what is excluded

The Commission describes a deepfake in contextual terms: content that resembles existing persons, objects, places, entities, or events and would falsely appear authentic or truthful. The transparency rules are not a requirement to label every edit or every item produced with AI. Commission guidance describes exceptions, including standard editing and certain other circumstances.

Timing also matters. Content generated before August 2, 2026 does not need retroactive labeling under the Commission’s guidance. A limited transition through December 2, 2026 applies to marking and detection by systems placed on the market before August 2, 2026. These dates and exceptions are part of the rule’s scope, not a general exemption from every transparency obligation.

What the voluntary code adds

The European Commission’s Code of Practice on Transparency of AI-Generated Content is voluntary. It offers practical guidance on marking, detection, and labels to help providers and deployers demonstrate compliance; it does not add requirements beyond the AI Act. The Commission says the code is subject to review as technology and practice change.

What the UK factsheet describes for intimate-image abuse

A UK Government factsheet updated September 30, 2026 describes measures in the Crime and Policing Act 2026. It covers a different policy mix from the EU’s general transparency framework: specified offences related to intimate-image generators, additional duties for regulated platforms, a possible secure registry of verified non-consensual intimate-image hashes, and a platform removal requirement.

Tool-related offences and safeguards

The factsheet describes offences concerning making, supplying, or offering certain intimate-image generators, sometimes called “nudification” tools. It also describes a defense for certain tools intended for consensual image generation where reasonable precautions were taken against misuse. The distinction matters: the described measures concern specified tools and circumstances, not every image-generation tool or every synthetic image.

Reported images and the 48-hour deadline

For a valid report of a non-consensual intimate image, the factsheet says regulated platforms must take it down as soon as reasonably practicable and within 48 hours. That is a stated maximum time after a valid report, not evidence that all reports are valid, that platforms consistently meet the deadline, or that removal stops later uploads.

Hash registry and commencement

The factsheet also describes a power to establish a secure registry of hashes of verified non-consensual intimate images. Hashes can be used as identifiers for matching content, but the factsheet’s description does not establish that the registry is operational or that it will prevent reuploads. Nor does the factsheet alone settle when each provision commences. Readers should distinguish the measures it describes from provisions confirmed to be in force on a particular date.

What a more complete policy response needs to answer

These laws show why a response need not stop at prohibiting a specific harmful act. A more complete framework can define covered abuse, give people a usable route to report it, set duties for relevant platforms or AI actors, and use transparency or technical mechanisms where appropriate. That is a conclusion about the breadth of the tools on paper, not a finding that the tools succeed in practice.

  • Can people report abuse safely and clearly? A notice route is useful only if affected people can identify it, understand what information is needed, and receive a meaningful response.
  • Can platforms act consistently and promptly? A legal deadline or process requirement does not itself demonstrate compliance or explain how disputes and mistaken reports are handled.
  • Will marking or disclosure survive distribution? A machine-readable mark may be lost when content is edited, copied, or reposted; a visible label can also be separated from the content it describes. The cited requirements do not establish how often either problem occurs.
  • Can repeat uploads be addressed? A hash registry is intended to aid identification of known material, but the UK factsheet does not establish its operational performance or whether it can address altered copies.
  • How will enforcement cross borders? Content, victims, platforms, and perpetrators may be in different jurisdictions. The examples do not settle how reliably authorities can coordinate across those boundaries.
  • How are free-expression safeguards applied? Removal systems and criminal rules need to distinguish covered abuse from lawful expression, commentary, reporting, or other protected uses. The measures described do not by themselves answer every difficult case.

The official sources cited here set out legal requirements and government descriptions, not measured outcomes. They do not establish that bans deter abuse, that labels change audience beliefs, that detection works reliably, that hash matching prevents reuploads, or that platforms consistently meet their duties. Those are questions for evidence about implementation and results, rather than assumptions to attach to a law’s existence.
