Sometimes—but there is no universal safety answer. Before uploading an image, check the exact tool’s privacy policy, product terms, account settings, retention rules, and rights requirements. Training opt-outs do not necessarily prevent processing, human access, or storage. And asking a tool to describe a copyrighted image does not automatically make uploading it lawful.
What “safe” means for an image-to-prompt tool
An image-to-prompt generator must process an image to produce a description. The important questions are what happens during and after that processing: whether the provider may use the image to improve or train models, how long it retains the upload, whether authorized staff or service providers can access it, and whether it is shared with third parties. These are separate issues; “not used for training” does not mean “never stored or accessed.”
Rules can vary by provider, product feature, consumer or business plan, account configuration, location, and date. A brand name alone may not tell you which policy applies. The OpenAI and Stability AI policies below illustrate differences; they are not a survey of every generator, nor evidence that either provider offers a dedicated image-to-prompt product with identical handling.
What to check before uploading
- Identify the exact service and tier. Find the terms and privacy policy for the specific product or feature, not just the provider’s general landing page.
- Read the controls separately. Look for input processing, training use and opt-out settings, retention and deletion, human or service-provider access, and third-party processing. An opt-out may address training alone.
- Protect confidential images. For sensitive personal, client, workplace, or unreleased material, do not submit it to an unreviewed tool. Prefer a workflow that keeps the image under your control, or a service and agreement whose protections you have verified.
- Confirm upload rights. Check that you have permission to submit the image and that doing so does not violate privacy, publicity, confidentiality, contract, or workplace obligations.
- Check the applicable jurisdiction. Copyright and privacy rules differ by location. A provider’s terms do not settle every legal question about a particular upload.

These official policy examples show why the exact product, setting, and agreement matter. Policies can change, so check the live terms that apply to your account before uploading.

OpenAI: consumer services and business/API products
OpenAI says it may use content from individual services such as ChatGPT, Sora, and Operator to train models. Users can opt out; new conversations after opting out will not be used for training. ChatGPT Temporary Chats are not used to train models. OpenAI says business products such as ChatGPT Team, ChatGPT Enterprise, and its API do not train on inputs or outputs by default, with an explicit opt-in path for data sharing. Separately, OpenAI says a limited number of authorized personnel and trusted service providers may access user content for purposes including support, abuse or security investigations, legal matters, and model improvement unless the user has opted out. Its Help Center warns: “Please do not enter sensitive information that you would not want reviewed or used.” Read the Help Center policy before submitting a private image.

For API customers, OpenAI’s data documentation lists 30-day abuse-monitoring retention for the /v1/chat/completions and /v1/responses endpoints. Eligible customers can apply for Modified Abuse Monitoring or Zero Data Retention, but approval and additional requirements apply, and some endpoints or features may retain application state or have exceptions. This figure is specific to the documented endpoints and controls; it is not a blanket retention rule for every OpenAI product. Details are in OpenAI’s API data controls documentation.
Stability AI: training opt-out and retention are different
Stability AI’s privacy policy, effective September 30, 2026, says it may use inputs and outputs to improve and develop services and to train, fine-tune, and evaluate machine-learning models. Users can opt out of training use in account settings. The same policy says retention lasts as long as reasonably necessary for stated purposes and depends on factors such as the agreement and legal requirements; it does not promise one fixed retention period for all inputs. Stability AI’s terms make users responsible for submitted content and require them to represent that they have the rights, licenses, and permissions needed to submit it. The terms say users retain ownership of submitted content between the user and Stability, to the extent permitted by law, while granting a license for service operation, maintenance, security, support, legal compliance, and other expressly permitted purposes. They also say content may be used to improve services and provide an opt-out from model-training use. A contractual ownership statement does not establish that you had permission from a photographer, subject, employer, or other rights holder to upload the image. Consult Stability AI’s terms of service.
Does describing a copyrighted image make the upload fair use?
No general safe harbor follows from the output being text. Uploading a copyrighted image for analysis and receiving a description are not the same legal question as whether you may use that description, or whether an AI-generated output can be copyrighted. Whether a particular upload is permitted depends on the relevant rights, purpose, service terms, facts, and jurisdiction.

In the United States, the Copyright Office describes fair use under section 107 as a case-specific balancing of four factors:
- Purpose and character of the use.
- Nature of the copyrighted work.
- Amount and substantiality of the portion used.
- Effect of the use on the potential market for or value of the work.
Educational or nonprofit use is not automatically fair, and commercial use is not automatically unfair. The Copyright Office’s Fair Use Index summarizes court decisions; it does not decide whether a particular image upload is fair use.

Keep three questions separate
- May you upload the image? This can depend on copyright, privacy, publicity, confidentiality, workplace rules, contract, and local law.
- May the service process or retain it under its terms? Check the applicable privacy policy, product terms, settings, and agreement, subject to governing law.
- Who can claim rights in the generated result? Output authorship is a separate issue and does not establish permission to submit the input.
The Copyright Office’s January 29, 2025 announcement on AI-assisted output says copyright protection may apply where a human determines sufficient expressive elements, but “not the mere provision of prompts.” That statement concerns copyrightability of output, not permission to upload an existing image. Before choosing a service, compare the actual feature and plan on these points rather than relying on a broad “private” or “not used for training” claim:
- Whether image inputs may be used for training, and how to opt out.
- Retention and deletion rules, including any endpoint or feature exceptions.
- Whether staff, contractors, or service providers may access content, and for what purposes.
- Whether third parties process or receive the image.
- Whether controls such as Zero Data Retention are available to your account, require approval, or exclude particular features.
- What rights or licenses the terms require you to hold or grant.
No named statistic in the official sources cited here measures how often image-to-prompt uploads are retained or misused. The published policies can help you understand a provider’s stated practices, but they do not establish the handling of every tool or guarantee the outcome of a particular upload.
