There is no single worldwide rule that makes every crypto mixer legal or illegal. The answer depends on the jurisdiction, whether you are using or operating the service, where the funds came from and where they are going, and whether sanctions or other laws apply. In the United States, merely using virtual currency does not by itself make someone a money services business; operating a service that accepts and transmits it can raise separate money-transmission obligations. Neither distinction makes transactions involving criminal proceeds or sanctioned parties safe.

What makes a mixer transaction legally risky?

“Crypto mixer” describes a service or technology intended to make links between cryptocurrency transactions harder to trace. That description alone does not settle the legal question. Different rules address different conduct, and one transaction can raise more than one issue.

  • Money-transmission rules: These may apply to a service operator that accepts and transmits virtual currency, depending on the facts and applicable law.
  • Sanctions: Restrictions can apply to dealings involving a specifically designated person or entity. A service’s status and applicable sanctions information can change.
  • Criminal proceeds and facilitation: Concealing or moving funds connected with crime, or knowingly facilitating criminal activity, can create exposure separate from whether a mixer is regulated.
  • Provider compliance: A regulated exchange or other financial provider may treat mixer-related activity as higher risk and apply additional checks or restrictions.

Privacy intent is not proof that funds are lawful, and using a mixer does not automatically prove criminal intent. The facts, conduct, jurisdiction, and applicable rules matter.

How U.S. rules distinguish users from operators

FinCEN’s virtual-currency guidance distinguishes a person using virtual currency from a business that accepts and transmits it. The guidance says a “user” who obtains convertible virtual currency to purchase goods or services is not a money services business (MSB) on that basis alone. It separately treats an administrator or exchanger that accepts and transmits convertible virtual currency, or buys or sells it, as generally subject to money-transmitter requirements unless a limitation or exemption applies. FinCEN’s 2019 administrative ruling emphasizes that classification depends on the facts and circumstances, including whether the business accepts and transmits value.

Question What the distinction means
Does someone become an MSB just by using virtual currency? Not under the user example in FinCEN’s guidance merely because they obtain virtual currency to purchase goods or services.
Could a mixer operator be a money transmitter? Yes. Accepting and transmitting convertible virtual currency can trigger money-transmission treatment, subject to applicable limitations or exemptions and the facts of the service.
Does that answer whether a particular transaction is lawful? No. MSB classification is only one legal question; sanctions, criminal-proceeds, fraud, and other laws may also matter.

A service’s label, software design, or claim that it is decentralized does not by itself resolve the legal analysis. Nor does the user-versus-operator distinction grant users permission to handle unlawful funds.

What the Tornado Cash decision and delisting do—and do not—mean

On November 26, 2024, the U.S. Court of Appeals for the Fifth Circuit held that Tornado Cash’s immutable smart contracts were not “property” of a foreign national or entity under the International Emergency Economic Powers Act (IEEPA), and that OFAC had exceeded its authority by sanctioning those contracts. On March 21, 2025, the U.S. Treasury Department announced that it had removed economic sanctions against Tornado Cash; OFAC’s same-day update showed its Tornado Cash entries removed from the Specially Designated Nationals (SDN) list.

Those developments concern a specific sanctions action and the treatment of immutable contracts under IEEPA. They are not a general ruling that every mixer is lawful, that every person associated with a mixer is free of sanctions, or that transactions involving criminal proceeds are safe. Sanctions questions should be assessed against the current status of the specific parties and transaction, not inferred from a past designation or delisting alone.

Why enforcement cases are not a blanket rule about users

Tornado Cash founder Roman Storm

On August 6, 2025, the U.S. Department of Justice (DOJ) announced that a jury had convicted Roman Storm of willfully conspiring to operate a money-transmitting business. DOJ said the jury found that the business moved more than $1 billion in criminal proceeds, and its release reported that Storm and co-founders cashed out more than $12 million in profits. Those are DOJ’s descriptions of the evidence and verdict in that case, not independent estimates of all mixer activity. The verdict is evidence of the risks alleged and proved in a particular prosecution; it does not establish that every mixer user commits a crime.

Blender.io and Sinbad.io allegations

A January 2025 DOJ release reported indictments charging alleged Blender.io and Sinbad.io operators with money-laundering conspiracy and operating unlicensed money-transmitting businesses. DOJ described Blender as operating approximately from 2018 to 2022 and Sinbad as taken down in November 2023. An indictment is an accusation, not a conviction; the allegations should not be described as proven findings unless a later court outcome establishes them.

What the cases show about anonymity claims

DOJ case records describe services that claimed not to keep logs while allegedly or demonstrably serving criminal flows. A mixer’s privacy or no-logs claim is not immunity from legal process, proof that funds are lawful, or a guarantee that on-chain and off-chain activity cannot be linked.

How EU rules treat mixer-related transfers

EU Regulation 2023/1113 identifies transfers related to technologies designed to enhance anonymity—including privacy wallets, mixers, and tumblers—as specific high-risk factors for crypto-asset service providers to consider. This is a compliance and risk-treatment requirement for covered providers; it is not, by itself, a blanket prohibition on an individual’s use of every mixer.

Rules in the EU and United States address different actors and risks. The evidence summarized here does not establish a country-by-country rule for every jurisdiction, so a conclusion about one region should not be applied worldwide.

FinCEN’s mixing proposal: what was proposed

On October 19, 2023, FinCEN proposed a special measure that would require covered financial institutions to report information about certain transactions when they know, suspect, or have reason to suspect that convertible virtual currency mixing is involved. The notice was a proposal; it should not be described as an enacted final rule on the basis of that notice alone. FinCEN’s 2023 notice also stated, citing OFAC, that Tornado Cash had obfuscated the movement of over $455 million stolen by the DPRK-controlled Lazarus Group in March 2022. That figure is the agency’s account of a specific theft-related flow, not a measure of all mixer use.

Before using or discussing a specific mixer transaction

  1. Identify the jurisdiction. Determine which country’s laws apply to the user, service, and transaction; do not assume U.S. or EU rules answer the question elsewhere.
  2. Separate user conduct from service operation. Ask whether the person is simply using virtual currency or is running a service that accepts and transmits value.
  3. Consider the source and destination of funds. Privacy intent does not establish lawful provenance or remove risk tied to criminal proceeds, fraud, or knowing facilitation.
  4. Check current sanctions information. If a specific party, address, or transaction is involved, check the applicable sanctions authority’s current information rather than relying on an old designation or a broad claim about a service.
  5. Do not rely on anonymity promises as legal protection. A service cannot promise immunity from legal process or eliminate every on-chain and off-chain risk.
  6. Get jurisdiction-specific legal advice for a live matter. A transaction, business, or investigation calls for advice from qualified counsel in the relevant jurisdiction, not a general article’s categorical yes-or-no answer.
