Anonymization offers stronger protection in principle because it aims to make health records unlinkable to any person. Pseudonymization replaces direct identifiers with a code but preserves a way to reconnect records, so it can support research that needs longitudinal linkage while leaving the data privacy-sensitive. Neither label guarantees safety: the practical risk depends on the details left in the dataset, who receives it, and what other information they can access.
What is the difference between anonymization and pseudonymization?
The European Data Protection Board (EDPB) describes pseudonymization as a safeguard that reduces the linkability of data to a specific person without aiming to cut that link completely. Anonymization aims to make data unlinkable to any individual. In practice, pseudonymization commonly replaces names or other direct identifiers with a code and keeps the code-to-identity information separately under controlled access.
Removing names alone does not make a health dataset anonymous. Dates, locations, rare diagnoses, unusual treatment histories, or combinations of details may still distinguish a person, especially when compared with outside information. A dataset’s actual identifiability matters more than the technique’s name.
Which protects health data better?
If a dataset is genuinely anonymous—meaning it is not reasonably linkable to an individual—anonymization provides stronger protection because there is no retained identity link to use for reconnecting records. Pseudonymization provides less separation: someone with access to the mapping, or enough other identifying information, may be able to restore that link.

That is a comparison of goals, not a guarantee about every implementation. Anonymization can be ineffective if distinctive clinical details or external data make patients recognizable. Pseudonymized records can also carry substantial risk if the mapping is exposed or remaining fields identify people. Assess the dataset and its context rather than assuming that either method is automatically safe.
Is pseudonymized health data still personal data?
Under the EDPB’s explanation of EU data-protection concepts, pseudonymization reduces linkability but does not aim to sever the link; pseudonymized health data therefore remains personal and privacy-sensitive. The EDPB says truly anonymized data is no longer personal data and falls outside the scope of EU data-protection law. Whether a real dataset qualifies as anonymous depends on whether people can actually be identified from it, including by combining it with other information.

These are EU concepts, not universal legal definitions. The U.S. HIPAA Privacy Rule has its own methods for de-identifying protected health information, and its legal test should not be treated as interchangeable with the EDPB’s distinction.
How does HIPAA de-identify health information?
For the HIPAA Privacy Rule in the United States, the Department of Health and Human Services (HHS) Office for Civil Rights recognizes two routes for de-identifying protected health information (PHI): Safe Harbor and Expert Determination. HHS says data that meets either method’s requirements satisfies the HIPAA de-identification standard. The methods apply in the HIPAA context; they are not general definitions of anonymization.

Safe Harbor
Safe Harbor requires removing specified identifiers of the individual and their relatives, employers, and household members, and having no actual knowledge that the information left behind could identify the person alone or in combination with other information. HHS’s list includes names; many geographic subdivisions; most date elements directly related to the person; telephone and email numbers; Social Security numbers; medical record and account numbers; device identifiers and IP addresses; biometrics; full-face photographs; and other unique identifying characteristics or codes.
The rule includes detailed exceptions, including a limited allowance for some three-digit ZIP prefixes and aggregation of ages over 89. Those exceptions do not change the requirement to meet Safe Harbor as a whole.

Expert Determination
Under Expert Determination, a person with appropriate knowledge and experience applies generally accepted statistical and scientific principles, determines that the risk is very small that the anticipated recipient could identify an individual using the data alone or with other reasonably available information, and documents the methods and results.
HHS cautions that HIPAA de-identification does not make identification risk zero. Its guidance says the risk is very small, but de-identified information may still be linked back to a patient. De-identification can also reduce data utility. A data-use agreement may add protections in some settings, but it does not replace the requirements of either method.

How should an organization choose?
Choose the approach around the purpose of the data use and the risk posed by the particular dataset and recipient. These questions help make the trade-offs explicit:
- What is the residual identification risk? Consider distinctive records, the people receiving the data, and what external information they could reasonably obtain or combine with it.
- Must records be linked over time? Pseudonymization may preserve a controlled way to connect a person’s records for a legitimate research or care purpose. Anonymization aims to remove that capability.
- Who can reach the mapping or other linkage information? Identify who can access the code-to-identity key, how it is protected, and whether the recipient has other information that could support identification.
- What data utility is essential? Generalizing or removing dates, geography, rare diagnoses, or other details can reduce disclosure risk but may make some analyses less useful. Utility is a trade-off to evaluate, not proof that a legal de-identification standard has been met.
- Which rules govern this use? The EDPB’s terminology concerns EU data-protection concepts; HIPAA’s methods concern covered entities and business associates under the U.S. framework. Other laws, ethical review, contracts, and governance requirements may also apply.
The EDPB’s Guidelines 01/2025 pseudonymisation page records a consultation feedback period of 17 January to 14 March 2025, marked closed. That page does not establish final adoption, so the document should be treated as consultation guidance unless its status is confirmed separately. For a specific compliance decision, check current law and regulator guidance that apply to the organization and the data use.
