For Indian organizations deploying AI, cloud choice is not just a price-and-speed comparison. The rules that apply to a particular organization and workload can limit which services, data locations, and control arrangements are acceptable. That makes governance a first-stage filter for some workloads—not a universal reason to choose one provider, and not proof that every workload must run in India.
Which Indian policy measures affect cloud and AI decisions?
Three policy developments matter, but they do different jobs: RBI directions set concrete cloud-governance expectations for covered regulated entities; India’s AI Governance Guidelines provide a broader governance framework; and the IndiaAI Mission includes planned public AI infrastructure. They should not be treated as interchangeable or as a single cloud-location rule.

A government statement dated 29 July 2026 reported that the AI Governance and Economic Group, Technology and Policy Expert Committee, and AI Safety Institute mechanisms had been initiated. That status report does not establish that every mechanism is fully operational. The same statement describes the Digital Personal Data Protection Act, 2023 as covering personal-data processing, purpose limitation, data minimisation, informed consent, and data principals’ access, correction, and erasure rights, as well as duties for Significant Data Fiduciaries. For an actual deployment, check the Act, applicable rules and commencement dates, and relevant sector requirements rather than relying on this summary. Read the government statement.
Does data have to stay in India?
The cited material does not establish a universal rule that every Indian business must store all data in India or use only Indian cloud infrastructure. The RBI Directions are relevant to entities covered by them; they require cloud adoption policies to address data sovereignty and storage requirements, and recognize that cloud services may involve storage or processing across multiple locations. A requirement to assess or govern those issues is not, by itself, the same as a blanket India-only hosting rule.

For a specific workload, identify the organization’s sector, the data involved, the applicable legal and regulatory requirements, and the locations where the provider and its subprocessors may store or process it. Then determine what those obligations require. Do not infer a location restriction—or assume there is none—from a general statement about AI or cloud governance.
How should an organization compare cloud options for an AI workload?
Apply governance as a feasibility screen, then compare cost and measured performance among the options that remain. The following sequence is a practical synthesis of the cited concerns, not an official India-wide scoring standard.

- Identify the obligations. Establish which sector rules, data-protection duties, security requirements, and internal policies apply to the organization and this workload. If the organization is RBI-regulated, check whether the 2023 Directions apply and map the workload to its documented cloud adoption policy.
- Map data and processing. Record the data categories the AI system will use, where storage and processing occur, where data moves, and whether the service uses multi-tenancy or multiple locations. Include data sent to model, training, logging, monitoring, and support services where relevant to the deployment.
- Allocate security responsibilities. Document which controls the provider supplies and which remain with the customer. Assess the evidence, access management, and incident-handling arrangements needed for the workload; do not assume that using a cloud service transfers all security responsibility to the provider.
- Test recovery and continuity requirements. Evaluate whether the proposed design can meet the workload’s recovery needs, including dependencies on a provider or region. Compare the provider’s recovery arrangements with the organization’s obligations and documented policy.
- Check AI capability and availability. Compare the accelerators, models, datasets, and AI services the workload needs. Treat IndiaAI Mission resources as an option only if the relevant service is available to the organization on suitable terms; the 2024 announcement alone does not establish that it is.
- Compare total cost and measured performance. Once options pass the preceding checks, compare their total cost and performance for the actual workload. A low quote or attractive benchmark cannot make an otherwise unsuitable data-handling or control arrangement acceptable.
What do the AI Guidelines change—and what remains unsettled?
The guidelines place AI governance within a wider framework of principles and implementation guidance rather than making cloud selection a simple provider-ranking exercise. Their release announcement describes seven “Sutras,” six pillars, and an action plan across short-, medium-, and long-term timelines. MeitY Secretary S. Krishnan said at the 5 November 2025 release: “Our focus remains on using existing legislation wherever possible. At the heart of it all is human centricity, ensuring AI serves humanity and benefits people’s lives while addressing potential harms.” (PIB release.)
The government’s account of the framework says many AI risks can be addressed under existing laws, while identifying subjects for continued review: classification and liability across the AI value chain, applying data-protection principles to AI development, generative-AI misuse and provenance, copyright, and risks in sensitive sectors. These open questions make it important to assess the complete AI service and its use—not only the underlying cloud infrastructure. The government’s framework account describes these issues and the broader approach.

What this means for a cloud strategy
Governance can determine which cloud arrangements are viable when a workload is subject to sector rules, handles sensitive data, or depends on controls that a provider must demonstrate. It does not follow that governance always outranks cost or performance for every Indian buyer. Screen each workload against its actual obligations and risk controls, then make the commercial and technical comparison among the feasible choices.
