The United States has no single divided-highway exception that applies everywhere. Florida allows opposing-direction traffic to continue only when specified types of separation are present; Texas uses a separate-roadway test. Check the current law where you are driving rather than assuming that any median or painted line means you may pass.
What determines whether you must stop?
Check the law for the state where you are driving, then compare the road and bus situation with that law. The key questions are whether the bus is stopped and displaying the required signal, whether you are traveling in the same or opposite direction, and whether the roadway separation meets the state’s legal test.
- Direction: Some exceptions apply only to drivers traveling opposite the bus.
- Separation: A state may specify a type of divider or instead refer to separate roadways.
- Bus and location: Stop-signal requirements and special loading-zone rules can affect the result.
A U.S. Department of Transportation report reviewing selected provisions in 54 jurisdictions cautions that states differ in what counts as a divided highway. It summarized five jurisdictions as requiring a stop on divided roadways and 40 as not requiring one; those counts concern the report’s selected provisions and do not classify every jurisdiction or establish every state’s current law. How Florida and Texas illustrate different legal tests
These examples show why the word “divided” alone is not enough to determine what to do. They are not a complete survey of state laws.

Florida: specified dividers and a five-foot threshold
Florida Statutes § 316.172(2) states: “The driver of a vehicle upon a divided highway with an unpaved space of at least 5 feet, a raised median, or a physical barrier is not required to stop when traveling in the opposite direction of a school bus which is stopped in accordance with the provisions of this section.” The exception is tied to the listed separation and opposite-direction travel; it does not say that any painted marking is enough. Texas: separate roadways
Texas law says a driver on a highway with separate roadways need not stop for a school bus on a different roadway. It also has a separate provision for certain controlled-access-highway loading zones where pedestrians may not cross. Consult the Texas statute, Section 545.066 for the full conditions.

Does a painted center turn lane count as a divider?
Do not assume that it does. The cited Florida exception names an unpaved space at least five feet wide, a raised median, or a physical barrier. Texas’s cited rule turns on separate roadways. A painted center turn lane is not identified in these provisions as qualifying separation. Whether any particular layout meets a state’s legal definition must be checked against that state’s current statute or official driver guidance.
How to check the rule for your route
- Identify the state. Use the law for the state where the bus and your vehicle are on the road.
- Find the current school-bus stopping rule. Check the state motor-vehicle code or official driver guidance, not just a general description of divided highways.
- Match the physical layout to the statute. Look for the exact divider or separate-roadway language and any measurements or exclusions.
- Check direction and bus conditions. Confirm whether the exception applies to opposing traffic and whether the bus must be stopped with a specified signal.
- Check special locations. Look for provisions involving controlled-access highways, loading zones, or restrictions on pedestrian crossing.
If the state’s rule or the road configuration is unclear, do not treat a painted line or turn lane as permission to continue; follow official state guidance.

New York bill S716 is not, by itself, proof of a current exception
The New York Senate page for bill S716 in the 2025–2026 session describes a proposed exception for opposing-direction drivers when a physical barrier is present and lists the bill as referred to the Transportation Committee. That page establishes the proposal and its listed status, not that the change was enacted or what the complete current New York rule is. See the bill page and check New York’s current statute or official guidance before relying on an exception.
