Before buying a game, check its exact store listing, the publisher’s privacy policy, and any separate platform or third-party notices. Look for what data the game collects, why it is used, who receives it, how long it is kept, and whether player inputs or gameplay data may be reused to train or improve AI models. A rating or AI label can be a clue, but neither is a complete account of a game’s data practices.

Start with the exact game listing

Open the store page for the specific game, edition, and platform you plan to buy. Identify the publisher and developer, then look for links to privacy information, terms, AI or generative-AI disclosures, online-service requirements, and account requirements. On Epic Games Store, publisher information may appear on the product listing, in the Publisher Index, or in the Library menu; follow the listing’s links to the full policy rather than relying on a brief summary. Record the policy’s last-updated or effective date and check that it applies to your country or region. Company-wide policies may cover services beyond the game, while a title’s terms or feature-specific notice may add details.

Map the organizations and services involved

A purchase can involve more than one privacy notice. Consider the platform or storefront, publisher, developer, any game account, and providers of optional or embedded features. Voice and text chat, cloud saves, cross-play, user-generated content, analytics, anti-cheat, and AI assistants may involve separate services. Do not assume that the platform’s notice also explains what the publisher does with information.

The Spanish Data Protection Agency (AEPD) discusses how roles can differ by activity and organization in its Recommendations and best practices for data protection in video games. Microsoft’s Store policy also says developers receiving personal data through Xbox Network must have a privacy statement governing its use. That is developer-facing policy language, not individualized legal advice for buyers. Microsoft Store Policies

Search for specific data, not reassuring labels

Use the policy’s page search to look for terms such as gameplay, telemetry, device, identifier, IP address, voice, chat, content, crash, analytics, AI, model, training, third party, retain, and delete. Compare what the policy describes with the features the game actually offers.

Examples in company policies illustrate the kinds of detail to look for, but they are not universal claims about every game. Epic lists categories including gameplay and application usage, progression, results, crash reports, device details, and identifiers. EA describes device identifiers, feature engagement, gameplay and usage statistics, and online gameplay information in its Privacy and Cookie Policy.

Separate AI content from AI-related data use

“Uses AI” can describe very different things. A game might ship with content created using AI, generate content live during play, or include a feature that processes a player’s prompt, voice, chat, or other submission. Those uses do not by themselves answer whether the submitted information is retained or used to train or improve a model.

  • Live generation: Does it generate dialogue, images, quests, or other content while being played?
  • Player inputs: Does an AI feature process prompts, voice, chat, or uploaded content?
  • Training and improvement: Are player inputs, gameplay telemetry, or player-created content retained or reused to train, tune, or improve models, including across titles?
  • Providers: Which model, hosting, or other service providers may receive information, and what do the applicable notices say about their use and retention?

Epic’s policy names large language model providers among service-provider categories for AI-powered features. That disclosure identifies a type of provider; on its own, it does not establish that a particular game sends player inputs to a model provider or uses those inputs for training. The AEPD guide specifically raises the possibility of reusing telemetry across titles to improve design, balancing, or AI models, making reuse a separate question to check.

Trace purposes, recipients, retention, and controls

For each data category you find, note its stated purpose, recipients, retention period, deletion process, and available settings or opt-outs. Look for service operation, analytics, personalization, advertising, fraud prevention or anti-cheat, cross-game profiling, AI inference, and model improvement. If the policy does not explain a material point—such as whether voice input is retained—treat it as unresolved rather than assuming the data is not collected.

Transmission may not happen immediately. EA says information gathered during offline play may remain on the device and be transmitted after the device reconnects. EA also describes third-party analytics and advertising technologies; check the policy and in-game settings for the particular title and region rather than applying those statements to all games.

Compare games on the same questions

When choosing between titles, use the same criteria for each. This makes gaps in disclosure easier to spot without treating silence as proof of a particular practice.

Data collected Are account or device identifiers, gameplay telemetry, voice or chat, uploaded content, or generated content described?
Purpose Is information used for operation, analytics, personalization, advertising, anti-cheat, AI inference, or model improvement?
Recipients Does the notice identify the publisher, platform, developer, analytics or advertising providers, or cloud and model providers?
Retention and reuse Is a retention period given? Can data be uploaded after offline play, reused across games, or used for training or tuning?
Player control Are there collection settings, opt-outs, or routes to request access or deletion?
Disclosure quality Is the notice current, region-appropriate, specific to the feature, and consistent with the store listing?

Use ratings as context, not as a privacy review

The Entertainment Software Rating Board (ESRB) describes its rating system through Rating Categories, Content Descriptors, and Interactive Elements. These can help you assess content and online-interaction context, but they do not answer every question about telemetry, AI providers, or model training. ESRB Ratings

ESRB’s separate Online Privacy Statement covers ESRB-operated websites and says it does not apply to third-party sites linked from them. It is not a substitute for the game publisher’s or platform’s privacy information.

What to do when the policy is unclear

  1. Check the game’s own store listing and follow its privacy and terms links.
  2. Check the platform notice and any separate account or feature-provider notices named for the game.
  3. Search for the specific unresolved issue—for example, whether chat is retained or player prompts are used for model improvement.
  4. If the answer matters to your purchase, ask the publisher for clarification or choose a game whose disclosures explain the practice more clearly.
