If construction at a nearby data center is disturbing your home, start a dated noise log, use the project’s posted complaint contact, and ask your city or county which construction-noise rules and permit conditions apply. There is no nationwide data-center construction curfew or universal decibel limit: permitted hours, complaint procedures, and enforcement depend on local rules and the project’s approvals.

What to do about construction noise near your home

Use this sequence to create a useful record and get the complaint to the people who can respond. If the noise is happening now, you can contact the project and the local enforcing office while it is occurring; you do not need to wait until you have collected a long log.

  1. Record the disturbance. Note the date, start and end time, duration, where you hear it, and the apparent activity, such as trucks, excavation, concrete work, or deliveries. Record whether you were indoors or outdoors and whether windows were open. Keep the description factual.
  2. Contact the project. Look for a construction disturbance coordinator, hotline, or other complaint contact on site notices, mailed schedules, permits, or the developer’s project page. Give the date, time, and duration, explain the effect, ask for a response, and request a reference number.
  3. Ask the local authority who enforces the rules. Contact the city or county noise-control or code-enforcement office, or the planning or building department named in project documents. Ask which ordinance and approval conditions apply, whether the work is within permitted hours, whether an after-hours permit or variance exists, and how to file a formal complaint.
  4. Request the project’s conditions and noise documents. Ask the planning office or project contact for the approved work schedule, construction noise-control plan, after-hours permissions, monitoring results, and complaint-response procedure.
  5. Follow up in writing if the problem continues. Send the log and any earlier complaint reference numbers to the responsible local office. Ask which rule or permit condition it will assess and what investigation or response to expect.

For federally funded highway work, the Federal Highway Administration directs project-specific traffic-noise questions to the state transportation agency. That transportation-specific process does not establish jurisdiction over an ordinary data center construction site. See the FHWA noise policy FAQs.

How to document construction noise

Keep a dated, specific log

For each event, write down when it began and ended, how long it lasted, where you were, and what you believe was happening. If you cannot identify the activity, say so rather than guessing. A concise record with repeated dates and times can help an investigator understand whether the issue is a recurring schedule, a particular type of work, or an isolated event.

Use recordings and readings carefully

You may preserve recordings where lawful and useful, but do not trespass or enter the work site. A sound-level meter or phone app can help you keep consistent personal observations; note the device and where and how you took each reading. Treat the result as an observation, not proof of a violation. Local compliance may require a particular measurement method, so ask the enforcing office what it recognizes before relying on a reading. FHWA’s noise measurement guidance index includes measurement resources, but it is transportation-focused and does not certify consumer devices for local enforcement.

How to report construction noise and find the permitted hours

There is no single set of construction hours or noise limit that applies to every data center in the United States. Start with the city or county where the site is located; the applicable ordinance, project approval, and any after-hours permission determine what is allowed and who can investigate.

  • Ask which office receives formal construction-noise complaints and how to submit one.
  • Ask for the allowed work hours and whether the reported activity required an after-hours permit or variance.
  • Ask whether an officer can inspect or measure noise during the disturbance, and what measurement procedure the office uses.
  • Ask how to obtain the project’s approval conditions, construction schedule, noise-control plan, and complaint procedure.

New York City, for example, publishes its own construction-noise rules and after-hours permit process. Those rules apply to NYC, not to other jurisdictions.

What mitigation or complaint procedures might be in the project approval?

Ask about measures tied to the actual site rather than assuming a particular plan exists. A San José data center project document, for example, describes construction hours, noise-minimization measures, equipment, advance notice of schedules and especially noisy work, and a disturbance coordinator. Those are useful items to ask about, but they are not guaranteed conditions for every project. See the STACK Data Center project document.

A separate San José review illustrates why project estimates should not be mistaken for general standards. The City’s 2022 Final EIR described a daytime increase of 10 dBA or more as an impact warranting additional measures for that project. A 2024 addendum described estimated levels of 53 dBA to 63 dBA for the loudest construction activities at the nearest businesses and the mitigation response. These are project-specific assessments, not universal legal thresholds or typical data-center construction levels. See the San José Data Center Final EIR and San José Data Center addendum.

FHWA’s construction guidance says, “In general, a project’s schedule can be maintained by balancing the type, time of day and duration of construction activities; adhering to local noise control requirements; and being proactive to community concerns.” It describes scheduling, compliance, and community communication as mitigation considerations for transportation projects—not as rules governing data center construction. FHWA notes that complex projects may call for detailed analysis, operational scheduling, continuous monitoring, and enforcement. Read its construction-noise guidance.

When construction ends but the noise continues

This guidance concerns temporary construction activity. If the disturbance persists after construction, report it as ongoing facility noise and ask the local authority which operating permits, noise limits, or approval conditions apply. Construction and operation may be governed by different requirements.
